RE: ACCEPTANCE OF OFFICIAL CLOSING DATE OF FORT LUPTON LANDFILL
SITE AND RESCIND CERTIFICATE OF DESIGNATION DUE TO SAID
CLOSURE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado has been informed that the Fort Lupton Landfill site
located in the Northwest Quarter of the Southeast Quarter of
Section 19 , Township 1 North, Range 66 West of the 6th P .M. ,
Weld County, Colorado will be closed on August 30 , 1980, and
WHEREAS, said site was posted with a Notice of Closure
on June 30, 1980 as required by the regulations of the Colorado
Department of Health, and
WHEREAS, a landfill , Southwest Weld County Landfill, will
be opened on September 2, 1980 to replace the Fort Lupton Land-
fill site, and
WHEREAS, the Board of County Commissioners desires to
accept the August 30 , 1980 closing date of the Fort Lupton
Landfill site and deems it advisable to rescind the Certificate
of Designation issued to the Fort Lupton Landfill site due to
said closing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the August 30 , 1980
closing date of the Fort Lupton Landfill site be, and hereby is,
accepted.
BE IT FURTHER RESOLVED by the Board that the Certificate of
Designation for the Fort Lupton Landfill site be, and hereby is ,
rescinded due to said closure.

The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
August, A.D. , 1980 .

Re: Fort Lupton Landfill
Dear Chairman Kirby:
Pursuant to your request that Colorado Landfill , Inc. keep your
office updated as to the progress of opening the Southwest Weld County
Landfill (Erie) , and the closing of the Fort Lupton Landfill , please
let this letter serve as a status report as of August 1 , 1980.
As you had been previously notified, Colorado Landfill , Inc,
contemplates opening the Southwest Landfill on September 2, 1980.
With the intervening Labor Day holiday, this means that the Fort Lupton
Landfill would be closed on August 30, 1980. I can inform you that
the Fort Lupton Landfill was posted with a Notice of Closure on June 30,
1980, as required by the regulations of the Colorado Department of Health.
Assuming that this schedule remains in effect, I would request that
the Board of County Commissioners issue an official Notice of Closing the
Fort Lupton Landfill , to be effective as of August 30, 1980. By my reading
of the regulations of the Colorado Department of Health, no hearing for
the closing is required. However, should the Board of County Commissioners
desire some type of hearing, either this office or a representative of
Colorado Landfill , Inc. would be more than pleased to attend any scheduled
hearing.
Should you have any questions concerning the closing of Fort Lupton
Landfill , or the opening of the Southwest Landfill site, please contact me
at your convenience. Additionally, please be advised that should this
schedule be modified in any way by Colorado Landfill , Inc. , the Board of
