WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the

Colorado has reviewed the request of Viola Carlson, et al . for
an exemption from the definitions of "subdivision" and "sub-
divided land" in Section 30-28-101(10) , CRS 1973 , as amended,
and
LL1 WHEREAS, the Board of County Commissioners finds that
Viola Carlson is the owner of certain parcels of land located
in part of Section 35, Township 7 North, Range 67 West of the
6th P.M. , Weld County, Colorado. The legal descriptions of
the parcels of land being exempted are as follows:

that part of the Southeast Quarter of Sec-

of the 6th P.M. lying West of the Outlet
Ditch of the said Eaton-Law Reservoir, to-
gether with any and all water rights, water
ditches, reservoirs, and water easements
and profits thereunto belonging or in any-
wise appertaining which are now or here-
after may be used on said premises , speci-
fically including a total of 237 acre-feet
allotted to the above described property
by the Northern Colorado Water Conservancy
District and two shares of the capital

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the above described par-
cels of land be, and hereby are, declared to be exempt from the
definitions of "subdivision" and "subdivided land" as set forth
in Section 30-28-101 (10) , CRS 1973 , as amended, and Section 2-1
of the Weld County Subdivision Regulations, and
BE IT FURTHER RESOLVED by the Board that the above described
parcels of land be, and hereby are, considered to be single lots.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
January, A.D. , 1981 .

subdivision
I respectfully request that you approve the reeerded exemption
which is enclosed.
I decided to sell my farm and have an opportunity to make a
favorable transaction by selling the land only to my adjoining
neighbor on the west.
Also, I have several people interested in the remaining house,
corrals, and milking parlor.
I anticipate that this split of the land will not change its
historic use.

Re: Request for a subdivision exemption on a parcel of land described
as Pt. SZ Sec. 35, T7N, R67W of the 6th P. M. , Weld County, Colorado
Dear Mrs. Carlson:
Your application and related materials for the request described above
are complete and in order at the present time. I have scheduled a
meeting with the County Commissioners for Wednesday, January 28, 1981 ,
at approximately 9:30 a.m. This meeting will take place in the County
Commissioners' Hearing Room, first Floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you and/or
a representative be in attendance to answer any questions the Board
might have with respect to your application.
It is the policy of Weld County to refer an application of this nature
to any town or municipality lying within three miles of the property
in question. Therefore, our office has forwarded a copy of the submitted
materials to the Town of Severance for their review and' comments. Please
contact Richard Tallman at 686-5366 for further details regarding the
Town of Severance's referral and review process . You may need to be in
attendance at a Town of Severance meeting should it require action by
the Town Board.
Please be aware that the Department of Planning Services staff will
make a recommendation concerning this application to the Board of
County Commissioners. It is the responsibility of the applicant to
contact the Department of Planning Services office a few days before
the date of the Commissioner's hearing to obtain that recommendation.
