HomeMy WebLinkAbout820701.tiff RESOLUTION RE: APPROVE AGREEMENT WITH SHEEHAN EXPLORATION TO USE COUNTY ROAD RIGHT-OF-WAY FOR SEISMOGRAPH TESTS AND AUTHORIZATION FOR CHAIRMAN TO SIGN SAME WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, an agreement between the Board of County Commissioners of Weld County, Colorado, and Sheehan Exploration, Drawer 2414 , Casper, Wyoming 82602 has been presented to the Board of County Commissioners for approval, and WHEREAS, Sheehan Exploration desires to conduct seismograph testing for oil and gas exploration in a portion or portions of Weld County, upon and along certain public road rights-of-way within Weld County, as specified in the attached underground and utility permit, and WHEREAS, said agreement provides for restrictions and specific instructions as set forth in Exhibit "A" of said agreement, a copy of which is attached hereto and made a part hereof. NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners has studied said Agreement and Exhibit "A" between Weld County and Sheehan Exploration be, and hereby is , approved, contingent upon Sheehan Exploration contacting each adjacent landowner and obtaining their permission. BE IT FURTHER RESOLVED by the Board that the Chairman is hereby authorized to sign said agreement. Steihmark TR PRESENTED: MARCH 3 , 1982 AGREEMENT THIS AQIEFMENTI', entered into this 1st day of March , lg 82 between the BOARD OF COUNTY OC MISSIONERS of the COUNTY OF WELD, STATE OF WIORADO, hereinafter called the "County" and SHEEHAN EXPLORATION WHEREAS, SHEEHAN EXPLORATION is preparing to conduct SeiSmograph testing within the County of Weld for Oil and Gas Exploration and desires to do testing in a portion or portions of said County upon and along the right-of-way of certain public roads within said County; NOW THEREFORE, for and in return for good and valuable consideration to the County paid by SHEEHAN EXPLORATION , the receipt of which is hereby acknowledged, and operate Seismic Exploration operations in, under, upon and along the public highways situated and described on the foregoing Underground and Utility Permit: Restrictions and specific instructions: SEE ATTACHED MAP AND EXHIBIT "A" It is understood and agreed that SHEEHAN EXPLORATION may conduct Seismic operations along the rights-of-way, but that roads shall be kept open for traffic. SHEEHAN EXPLORATION agrees to leave said roads in as good condition as existed immediately prior to the beginning of said operations. SHEEHAN EXPLORATION covenants and agrees with the County that it will protect and save harmless and indemnify the County, its agencies thereof, and their officiers and e ployees from and against all liability, loss damage and expense suffered by or imposed by the County by reason of conducting and operating of said Seismic operations. It is understood and agreed that no oiled road surfarc shall be cut and will be crossed with boring only. Tb provide Weld County a list of all well owners that could be affected and provide proof each owner has been contacted and advised of this operation. 3. That no hole is to be shot within 800 feet of a well without specific written permission of the well owner. 4. That if damage should occur within the right repair-of- that at ouldand require rerreprepair ir with a motor-grader, Weld County ) perform the rate of $40.00 per hour. 5. TO provide the Weld County Engineer with weekly progress reports stating which holes have been drilled, which holes have been repaired and any damages or problems that have occurred on or off the rights-of-way. 6. TO backfill and gravel holes within ten (10) days of test completion. 7. That this agreement allows testing only on the highways described on the fore- going Underground and Utility Permit. 8. That no paved roads are to be cut or drilled. 9. This work shall be completed within 30 ( ) days fran the issue date. No work shall be • allowed on Saturdays or Sundays. IT IS UNDFIRS"1DOD that the Permittee will cause installation at no expense whatcrever to Weld County and the. Permittee will own and maintain the sane after installation. • The Cable line shall be installed beneath the surface of the right-of-way at a minimum cover of 36 inches and the disturbed portion of the right-of-way shall be restored to its original condition. All rackfilling shall be in eight inch lifts and mechanically ccnpaacted to 95% of Standard Proctor. All road crossings shall be bored. Said installation shall be encased in pipe of larger diameter when required and the crossing shall be as nearly perpendicular to the roadway as physically possible. No water shall be used in the boring and no tunneling shall be permitted. where the installation crosses any ditch, canal or water carrying structures, wherever possible it shall be pushed through and beneath in a pipe of larger diameter thereby eliminating the necessity of trenching. In no case shall the flaw of water ever be impaired or interrupted. The applicant shall obtain permission to cross all irrigation ditches from the owner of each ditch. This work must be acarrplished in accordance with aceipted good practices and conform to the recarrrendations of the National Electric Safety rain and to such statutes as arc applicable. Construction warning signs, conforming to the Uniform Traffic Control Device Manual and to the Colorado Suppleent, shall be in place daily prior to starting any work. If proper signs are not in place during any work, the County Engineer or his authorized agent shall inmediately stop all work until proper signs are in place. Traffic shall be maintained on all roads at all tines. Flagmen shall be provided at any locations where the orderly flair/ of traffic is interrupted. The Permittee shall maintain the installation at all times and agret to hold Weld County, Colorado, the agencies thereof, and their officers and employees harmless from any and all loss and damage or any claims which may rise out of or be connected with the installation, maintenance, alteration, removal or presence of the installation herein referred to or any work or facility connected herewith, within the area covered by this permit. If it becomes necessary to change the location of the proposed line, written approval must be secured from the County Engineer. Permittee will be required to shut off lines and remove all combustible materials from the'County right-of-way when requested to do so by Weld County, Colorado, because of necessary highway construction or maintenance operations. Permittee shall mark this installation with markers acceptable to Weld County, Colorado, a minimum of two signs per mile, and shall be marked by two signs at each bridge or ditch crossing, and at each road crossing. In the event any changes are made to this roadway in the future that would necessitate ruiuval for relocation of this installation, Permittee will do so prarptly at its own expense upon written request fran Weld County, Colorado. Weld County, Colorado, will not be responsible for any damage that may result in the maintenance of the highway or to the installation placed inside County right-of-way lints. The Weld County Engineering Departnent must be infante(' ill the start date of all construction in order to provide inspection during construction. Bores and encasaients under roads must be inspected. The depth of buried pipe mat be inspected. 2. Please call (303) 356-4000 extension 421 for notification of start. of construction. 3. The applicant shall notify the local police, andxilann', .nth fire department stating duration of all road closures. All road closures must be approved by the hoard or County eaindssioners by official resolution. 4. All work covered by this permit nest be nipleted within 1u drys of the issie date. Extension of the °depletion date may be granted upon proper request to the County l'xllrxvring I]epartient. 5. As a general rule, utilities will rot be Located to ter for in.idwoy surtax' or Tiljacent to the footway surface, except for under road crossings. 6. The utility carpany shall. provide all necessary signs and barricades in aL urdance with tie Manual on Uniform Traffic Control Devices and the latest Colorado Supplement. 7. As a general rule, open cutting of road surfaces will not be permitted. 8. No cleated or track equipment to work on or move over asphalt surfaces without mats. 9. All disturbed portions of right-of-way are to be returned to original condition at a tine designated by Weld County, Colorado. 10. Any materials from excavation as the result of utility installation will be removed from highway and surface each day. 11. Under no condition is an asphalt surface to be cut unless otherwise specified in the special conditions. • 12. Mud-jacking will be required where bores are larger than lines or-encasarents. 13. The ends of bored sections are not to be covered before-being inspected. 14. No plastic line is to be installed without encasement under pavarent regardless of pressure and size unless special permission to do so is granted by Weld County, Colorado. 15. Manholes and other points of access to other underground untilitics may be permitted within the right-of-way only when they are'loceted beyond ttn shoulder of the through traffic roadway. 17. All requests for installation will be reviewed in ttc field by representatives of Weld County, Colorado, prior to any issuance of any permit. 18. Where special cases warrant,Weld County will permit the installation of underground utilities paralleling high- ways along the slope of the shotdder. In the event such permits are issued, it will be required by the contractor that material removed must be replaced in like kind and with sane or better crnpaction. No segregation of material will be permitted. 19. The construction of underground installations will generally require the services of an inspector furnished by Weld County; Colorado. The decision in regard to which project requires inspection is reserved by Weld County, Colorado. All extraordinary-costs relating to the inspection of such utility installation will be home by the Permittee at a rate specified by Weld County, Colorado. • 20. All drainage facilities or siphons will be opened ineediately upon completion of work at sites of drainage or siphon installation. Damaged portion of drainage or siphon facility will be replaced. All danudged sections are to be inspected by Weld County, Colorado, before being concealed in any manner. Drainage ditches or borrow pits are to be restored to original condition bnrediately after backfilling is completed. 21. ND meters are to be placed within the highway right-of-way, excepting within corporate limits where municipal regulations allow installation. 22. Thrust blocks will be required on all vertical and horizontal bends in water pipes. - 23. Wield County, Colorado, does not warrant County right-of-way. The bond will rcmein in effect for a period of one year after all work has been completed. The total amount of the bond will be determined by Weld County, Colorado. 25. All t.ttssary new gravel shall be placed on all surfaces where any damage has occurred to the road surface from equipment, trenching, or storage of material. Weld County, Colorado, shall determine the damaged areas and depth of new gravel. 26. The installation of nen-ferrous lines in road right-of-way shall require a suitable means to facilitate future line location. 27. For all utilities, regardless of installation, permit fee shall be based upon trench width as follows: Up to 6 inches -- $0.02 per lineal foot, 7 inches through 12 inches -- $0.05 per lineal foot, 13 inches through 24 inches -- $0.09 per lineal foot, 25 inches through 36 inches — $0.14 per lineal foot, 37 inches and above -- $0.18 per lineal foot. Mlntre n permit fee will be $10.00. ADDITIONAL SPECIAL CONDITIONS The permit is being issued for Seismic Exploration for oil and gas . Requirements within this permit regarding utility installation that will remain in the right-of-way will not apply. All other require- ments and restrictions applicable to this work remain in force.
