RE: APPROVAL OF RECORDED EXEMPTION NO. 544 - BRUCE AND GENEVA
MARRS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 544, being the property of Bruce
and Geneva Marrs, described as part of the NW;, Section 22, T1N,
R67W and part of the NEa, Section 21, T1N, R67W of the 6th P.M. ,
Weld County, Colorado, being more particularly described in Ex-
hibit "A" , attached hereto and incorporated herein by reference,
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS, 1973, as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners that the hereinabove described parcel of land owned
by Bruce and Geneva Marrs be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land" .
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 21st day of
April, A.D. , 1982.

Dear Commissioners:
The attached letter and related materials are in reference to a request
from Greg and Karen Marrs for a subdivision exemption and Bruce and
Geneva Marrs for a recorded exemption. The property is described as
part of the NW1Z, Section 22, T1N, R67W and part of the NE1 , Section 21
T1N, R67W of the 6th P.M. , Weld County, Colorado. The property is located
3.5 miles southwest of the town of Fort Lupton.
The Department of Planning Services staff has reviewed both requests
and recommends that both requests be approved for the following reasons:
The subdivision exemption of Parcel "A", containing 2.616 acres, more
or less, will continue to allow Greg and Karen Marrs to reside next to
the dairy operation which is their full-time occupation.
The proposed recorded exemption contains a dairy operation and irrigated
cropland on 159.125 acres, more or less. The request is to split the
property into parcels of 1.125 acres, more or less and 158 acres, more or
less.
The recorded exemption request complies with the subdivision requirements
of Section 9-2 C. of the Weld County Subdivision Regulations. The request
also complies with Section 9-2 E. Agricultural uses will continue as
the primary use and there would appear to be no encroachment of incompatible
uses to the area.

The purpose for requesting an amended Recorded Exemption,
2 Subdivision Exemptions, and the Mobil Home Permanent
Dwelling is to provide housing for the owners/operators
and employees of the Marrs Milky Way Dairy. When the
farm was originally purchased, only one old farmhouse was
on the premises. With the building of the new dairy
facilities and farming operations, there is a need for
additional permanent housing for the owners/operators and
one mobil home for the employees. In order to acquire
financing for these homes and to alleviate possible estate
problems that might arise, it is necessary that these
parcels of land be separated from the main tract.
This proposal is consistent with Weld County ' s Compre-
hensive Plan and the District in that dividing these
parcels of land will allow better supervision of the dairy
farm operations. All proposed homes will be located on
unuseable agricultural ground resulting in no loss of
agricultural production.
No conflicts will arise with the existing surrounding
land uses . Adjacent areas are either in production or
are unfit for farming. Also, being in an agricultural
district, we are not within any municipality ' s adopted
master plan.
The proposed land divisions comply with Weld County ' s
-Zoning Ordinance, Section 50, Overlay District Regulations,
in that we are not in an overlay district area.
