WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, on the 25th day of August, 1980, the Preliminary Plan for Col-Cal Properties, Ltd. , et al . , was submitted to the Board of County Commissioners of Weld County, Colorado for approval in accordance with the Subdivision Regulations of Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all of the testimony and the statements of those present, and WHEREAS, the Board of County Commissioners had evidence presented in support of the approval of said Preliminary Plan for the following described real estate, to-wit: Part of the Northwest Quarter of Section 23 , Township 5 North, Range 66 West of the 6th P .M. , Weld County, Colorado. WHEREAS, a representative of the petitioner was present, and WHEREAS, the Board of County Commissioners has studied the request as submitted, and having been fully informed , is satis- fied that the submitted Preliminary Plan conforms in all respects with the requirements of Section 5 of the Weld County Subdivision Regulations, and finds that said Preliminary Plan should be approved conditional upon the following items being included in the application for final plat: 1 . The elimination of the median at the access to 47th Avenue and the non-vehicular access path along the South side of 30th Street. 2. Inclu- sion of the costs for encasement within the Subdivision Improvements Agreement. 8. The identification of the "Proposed Greenbelt" , "Future Business Area" and "Area Reserved for Future Acquisition by the Highway Department" as "outlots" on the Final Plat. 9 . A proposal for the dedication and maintenance of all outlots not included within the platted subdivision. Gateway Estates, Subdivision Preliminary Plan • I have reviewed the submittal and have the following comments: 1. Section 8-2C(1) requires a 200 feet centerline radius. Thirtieth (30th) Street and Forty-first (41st) Avenue should comply. 2. I have several disagreements with the preliminary drainage information submitted. Rather than go into lengthy written comments I think it would be best to discuss the matter with the Engineer. Although the developer indicated he will provide for detention, there is no facilities shown in this submittal. 3. The soils report indicates ground water will pose problems. The Commis- sion recommended no objection subject to the following stipulations : 1. The developer will stub 29th Street Road and 41st Avenue up to the property line to provide access to the Elks Club property to the east . 2 . The north-south collector between Gateway Estates and the Elks Club shown on the Comprehensive Plan map need not be developed . 3. The developer will comply with the City of Greeley Drainage Plan and regulations . 4 . A 40 foot setback noise buffer will be provided for lots backed up to the U. S. 34 Bypass . 5 . Access design and easement for the temporary access to U. S. 34 Bypass will be submitted with the final plat . 6. Box 86 Greeley, CO. 80632 I reviewed the Col-Cal Properties, Ltd and Comprehensive Multivesting --- Services, Inc. , Preliminary Plan for Gateway Estates Subdivision, to be located in part of the NW' of Section 23, TWP. 5N, Range 66W. Soils: The soils report accompanying the preliminary plan is very complete - -- and accurate concerning site conditions, and does indicate the problem areas associated with subdivision development on this site. Soil report recommenda- _ tions should be followed very closely for development of this area. Flooding: The site is not subject to any major flooding and is not located in a floodplain. The surface drainage system presented in the preliminary plan indicates pathways storm runoff will be routed but does not provide any specific details of the system being planned. They system will have to be designed to City of Greeley criteria regarding historical runoff. An evalua- tion of the surface drainage system will have to be done when the final plan is presented. Engineering and Erosion Control: The soils report has very specific recommenda- tions regarding the construction of streets and foundations for existing soil conditions. There is no recommendation for erosion control shown in the plan. The entire area covered under this plan is presently in irrigated cropland production. During development, surface soil protection is strongly recommended as the soils in the area are susceptible to wind erosion and areas with steeper slopes will be very prone to wind and water erosion. The use of temporary ground cover or cover crops could be utilized to maintain surface soil protection. Lots 12 through 31, Block 5, as shown on the preliminary plan map, exist on 7% to 11% slopes. There was no final contour map to show planned contours, but these lots should be maintained in permanent vegetative cover to retard erosion potential during the development phase. These lots will also require special and careful planning to insure erosion potential is kept to a minimum. An erosion control plan should be submitted as part of the final plan, and should address placement of storm runoff structures to retard erosion and vegetative plans for minimizing ----- soil erosion. Page 2 - Col-Cal Properties, Gateway Estates Subdivision The subdivision area described by the preliminary plan submitted is bounded on the south by Greeley-Loveland Irrigation Canal. The plan hints that the canal is to be replaced with underground pipe, but does not specifically state this course of action. The final plan should contain information regarding the use of underground pipe and how it ---- is to be installed and maintained so as to protect downstream water --- users. Irrigation Company adopt as a policy for approval of all subdivisions and developments along or near the Greeley and Loveland main canal at all points east of the Grapevine Lateral headgate, that said canal be encased or covered in order to eliminate problems concerned with the health and safety of the public and any persons who may live near, work near, or have occasion to be near said canal, and to protect The Greeley and Loveland Irrigation Company and its possible or potential liabilities for operating an open ditch in urban areas. In addition, we would like to recommend a minimum 40-foot building setback from the existing north property line for those lots adjacent to U.S. Highway 34 Bypass. It would also be desirable to provide some type of noise wall since this would provide additional protection from highway noise. This wall should be wrapped around the end lots in order to be effective in helping to reduce highway noise. We will not object to the temporary 20-foot emergency access onto U.S. 34, provided that it is necessary to serve this subdivision. However, it must be avail- able to emergency vehicles only and an effective barrier will have to be provided. This barrier should be submitted to us for review prior to its installation. In our review of the two previous zone change applications by Col-Cal Properties, we expressed support for the consideration which is being given to planning for a future interchange at 47th Avenue and U.S. Highway 34 Bypass. This Sketch Plan also shows the appropriate interchange boundaries. Our usual request in ratters concerning additional highway right of way is for the reservation or dedication of that area necessary for the future highway improve- ments. Although the area required for the southeast portion of this interchange from this developer is quite substantial , we ask that consideration be given to the dedica- tion of the area in question. In addition, we would like to call your attention to the potential for adverse highway noise impacts for lots along the north property boundary. We have particular concern with regard to any houses which might be built between the ends of the cul- de-sacs and the highway right of way. It is very likely that some type of noise wall would be necessary to reduce roadway noise to the residential design noise level if houses were built on the ends of the cul-de-sacs. After reviewing information filed with the County, the Elks Club has two primary concerns : 1 . The Greeley Comprehensive Plan, Phase 1 , as approved May 4 , 1971 , shows a collector street along the West side of the Elks property. We feel that the collector street is a necessity to adequately serve the Elks Club property for future development. When the enterchange is constructed at 35th Avenue, the North entrance to the Elks property will be eliminated, making the collector •street on the West even more important . 2 . The preliminary drainage plan for Gateway Estates does not show any detention of storm water flowing Northeast . Drainage from the area West of the Elks Club property is a problem now because of the limited carrying capacity of the conduit under Highway 34 By-pass North of the Elks Golf Course . When the lakes are full of irrigation water for the golf course , storm water runoff from the Gateway Estates area back up in the lakes and flood Number 8 Fairway.
