RE : APPROVAL OF RECORDED EXEMPTION NO. 514 - KENNETH J. AND
DOROTHY E. WINICK
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 16th day of September , 1981 in the Chambers of
the Board that the division into two parcels of land, as shown
on the plat known as Recorded Exemption No. 514 , being the
property of Kenneth J. and Dorothy E. Winick described as
part of the Northeast Quarter of Section 7 , Township 7 North,
Range 67 West of the 6th P.M. , Weld County, Colorado, being
more particularly described as follows:
That part of the NEa Sec. 7 , Twp. 7 No. , Range 67 W.
of the 6th P.M. in Weld Co. , Colorado, lying North
and East of the Centerline of the right of way of
the ditch of Water Supply and Storage Company as
described in book #741 , Reception No. 1663350.
LOT 'A' - LEGAL DESCRIPTION
Part of the Northeast Quarter (NEa) of Section 7 ,
Township 7 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado being more particularly
described as follows :
Beginning at the North Quarter Corner (NQ Cor) of
said Section 7 , and considering the North Line of
the NEa of said Section 7 as bearing North 90°00 ' 00"
East, with all other bearings contained herein being
relative thereto;
Thence North 90°00 ' 00" East, 592. 15 to a point 20 feet
East of the Cneter Line of the Irrigation Canal, said
point being the True Point of Beginning;
Thence continuing North 90°00 ' 00" East, along said
North Line, 500 . 00 feet;
Thence South 00°00 ' 00" West, 185. 00 feet;
Thence South 90°00 ' 00" West, 528. 55 feet;
Thence North 08°44 ' 25" East, 187 . 07 feet to the True
Point of Beginning.
Said described parcel of land contains 2 . 184 acres,
more or less , including a strip of ground 30 feet in
width along the North Line of said described parcel
of ground, reserved for County Road ROW purposes and
is subject to any rights-of-way or other easements as
recorded by instruments of record or as now existing
on said described parcel of land.

"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and

WHEREAS, the Board of County Commissioners finds that this
particular division of land is not within the purposes of the
Weld County Subdivision Regulations and the Board desires to
exempt this particular division of land from the definitions
of "subdivision" and "subdivided land" pursuant to its
authority under Colorado statutes and Section 2-1A(3) of the
Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the hereinabove described parcel of land
owned by Kenneth J. and Dorothy E. Winick be, and hereby is,
exempt from the definition of the terms "subdivision" and
"subdivided land" .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 16th
day of September, A.D. , 1981.

Re: Recorded Exemption #514
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Kenneth Winick for a recorded exemption. The parcel of land
on which this request has been made is described as part of the NE4,
Section 7, T7N, R67W of the 6th P.M. , Weld County, Colorado. The property
is located ten (10) miles west of Ault. The property contains approximately
80 acres of Class II irrigated soils. The request is to split the property
into parcels of 2.184 acres and 77.8 acres.
Based upon information reviewed and Weld County requirements the Department
of Planning Service's staff recommends the request be granted for the
following reasons:
1. The proposal is in compliance with submittal requirements
of Section 9-4 A. of the Subdivision Regulations; and
2. It is the staff's opinion that the request will comply with
the Weld County Comprehensive Plan and the intent of both
the Agricultural District and Exemption reuglations. The
Winicks wish to retain their improvements on which to live
after retirement from farming. The balance of the farm
(while eligible for one additional set of improvements if
the exemption is granted) is to be purchased and farmed by
an adjacent landowner/farmer. The staff finds that the
farming of the property will be the predominant use and the
exemption is the only means of the Winicks to remain in
their home upon retirement and be able to divest their
ownership interest in the farm 1 .
