LIGHT. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of September, 1981 at the hour of 2: 00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Shirley J. Light, Aristocrat Ranchettes, Colorado, for a Use By Special Review for a dog breeding facility, on the following described property: Lots 2 and 7 Block 16 Aristocrat Ranchettes. WHEREAS, evidence was presented in support of the granting of the request for a dog breeding facility, on the abovedescribed real estate, and WHEREAS, Section 24 of the Weld County Zoning Ordinance author- izes such a use in an Agricultural District upon approval by the Board of County Commissioners, and WHEREAS, the Board heard all of the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a dog breeding facility, conforms to the purposes of Section 24 of the Weld County Zoning Ordinance. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners that the application of the petitioner for a Use By Special Review for a dog breeding facility, on the hereinabove described tract of land be, and hereby is granted subject to the following: 1) The development standards contained in the Use By Special Review. (see exhibit "A") 2) No building or electrical permits shall be issued for the Use By Special Review area until the Development Standards for the Use By Special Review plat and said plat has been delivered to hte Depart- ment of Planning Services office. It is the opinion of the Department of Planning Services staff that this request is in agreement with the Weld County Comprehensive Plan in that the proposed use would not appear to have any adverse impacts on the agricultural interests of the County or the environment. 2. It is the opinion of the Department of Planning Service's staff that this proposed operation is in compliance with the provisions of Section 24.3.1.1 et. seq. of the Weld County Zoning Ordinance. The proposed use will be compatible with the surrounding area, consistent with the intent of the Agricultural District, does not utilize productive agricultural land, and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon the following: A. It is the opinion of the Department of Planning Service's staff that the operation and management of the breeding kennel, as outlined and controlled in the Development Standards will minimize any adverse impacts on the surrounding land uses to the greatest extent possible and provide adequate protection of the health, safety and welfare of the inhabitants of the area and the county. B. It is the opinion of the Department of Planning Service's staff that the boarding kennel is in harmony with the character of Aristocrat Ranchettes Subdivision in that the lots are of a large size (approximately one (1) acre) and essentially rural in nature and use. C. The following referral entities have reviewed this request and have set forth no objections to it: 1. Weld County Health Department; 2. Weld County Engineering Department. The Department of Planning Service's staff recommendation for approval is conditional upon the following; 1. TEH:rjg A-11 COMMENTS Shirley Light SUP-473:81:19 Our office has received letters from three (3) adjacent landowners (as of August 17, 1981) which are in the file packets. The letters address concerns which, in the opinion of the staff, are not substantial due to the type and size of dogs involved. Additionally, the development standards provide use to only be permitted for the toy size dogs. TEH:rjg DEVELOPMENT STANDARDS Shirley Light SUP-473:81:19 1. -The permitted uses on the hereon described parcel shall be limited to an AKA registered toy dog breeding kennel and all other uses permitted by - right under section 31. of the Weld County Zoning Ordinance. The location and size of the permitted structures shall be as shown hereon. The - maximum numbers of animals permitted shall be thirty (30) adult dogs. 2. A perimeter fence around the entire property shall be constructed. Chain link or privacy fencing shall be constructed around each kennel facility. 3. All dogs shall be kept inside the kennel building from 9:00 p.m. until 6:30 a.m. Dogs maybe permitted outside between the hours of 6:30 a.m. and 9:00 p.m. • 4. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 5. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 6. The boarding kennel facility shall be subject to inspections by the Weld County Health Department and constructed, operated and maintained pursuant to Colorado Regulations on Breeding Kennels. 7. Access to the Special Use Permit area shall be as shown hereon. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above, any change in the use of the kennel from breeding AKA registered toy dogs shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 9. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non- compliance with any of the above stated Development Standards shall be reason for revocation of the Special Use Permit by the Board of County Commissioners. Lots 2 and 7 appear to be clean and well kept. There appear to be existing facilities which house dogs. The facility on Lot 2 is behind a wood fence and cannot be seen from the road. Several dogs barked while I made the field check. They are very small dogs with a high-pitched-bark. However, the bark did not seem loud from my position at the road. The facility will have the eventual capacity for 100 adult AKA registered toy dogs of two breeds . The portion of the facility in Lot 7 will house miniature Pinschers, who at maturity stand about 12i inches at the withers . The other part of the facilities, on Lot 2, wi l l house Pomeranians, who stand about 10 inches at the withers at maturity . The entire fac'i I i ty will be enclosed by a fence along the perimeter which encloses both lots . The Pinscher facility plan consists of an 18 ' by 18 ' building with a sink and floor drain , heated by butane, with interior runs . Additional concrete runs will be constructed outside the building , fenced with chain link and screened by a Russian Olive hedge . The Pomeranian facility also features a building to house the dogs, heated by a quartz electric heater and surrounded by a privacy fence which encloses a large exercise area . Initial capacity of the facility is 30 adult dogs . Both parts of the facility are adjacent to the residential structures on the lots . No outside employees are currently hired , nor are such employees contemplated . The facilities are operated by Shirley J . Light , the applicant , in conjunction with her daughter-in-law, who is also named Shirley J . Light . Both women and their husbands reside at the site . Most of the dogs sold by the applicant are shipped by air to the buyers . The maximum number of visitors who might come to the facility is 3-5 passenger cars per month , although the current rate is one per month . Both lots have direct access to public streets . Parking is located next to the residences, close to the roads . Domestic sewage is processed by individual septic systems at the existing residences . The runs and exercise yard are cleaned of droppings at least once daily , and the concrete runs hosed down . Every other day the runs are washed down with disinfectant . All droppings are buried weekly in a trench 3 feet deep on the property . Local ground water levels are at approximately 10-20 feet , and are of such poor quality as to be unsuitable for domestic use . In addition to the waste management system outlined , each 3 weeks the operators purchase and release 50, 000 tiny non-stinging wasps that subsist on fly larvae . This method of fly control was recommended by the applicant ' s veterinarian . The wasps are purchased from Welco Spray Service in LaSalle . V .) The initial structures are already in existence. The expansion will likely occur in approximately five years . The facility is supplied with water by the Aristocrat Ranchettes Water Project , Inc . The dogs are housed indoors from 6 p .m. to 9 a .m. each night , which should eliminate noise problems . The breeds which are to be raised generally do not bark unless approached by strangers . The proposal is consistent with the provisions of the Weld County Comprehensive Plan as it does not involve the removal of agricultural land from production . The proposed use is to be located in a subdivision antedating current Weld County regulations, and , although zoned "A" Agricultural , is rural residential in character. The land in question has not been productive agricultural land for at least twenty years . Prior to that time it may have been used as pasture . No water rights will be transfered from irrigation use . In the special case of pre-existing residential subdivisions in the "A" zone, the A zone is retained to preserve the rural character of the areas, and to allow uses in those areas which might not be appropriate in urban areas , such as the proposed breeding faci l i ty . The proposed kennel facilities are compatible with the rural character of the surrounding land uses . Aristocrat Ranchettes con- tains a variety of uses , including the keeping of farm animals, which are consistent with the existing zoning and the proposed use . The proposed use is also compatible with the future development of the area . Over the years since its platting , Aristocrat Ranch- ettes has developed a character distinctly rural and informal , with a diversity of uses of individual lots . It is not a wealthy bedroom subdivision , nor will it become one . It is the ideal location for a breeder . Its existence was an accomplished fact well before the adoption of the County Comprehensive Plan . The creation of well planned professional facilities such as the Light Kennel can only improve the area . The location of the proposed use was largely determined by the location of the existing improvements and a desire to buffer the animals from the distractions of the roadway and neighbors . The land was never productive agriculturally . The dogs will all be located in enclosed runs or buildings . They wi l l never be allowed to run free, so can present no hazard to the health or safety of the neighbors . Waster disposal and insect control methods are discussed above .
