SUMMARY OF THE WELD COUNTY PLANNING COMMISSION MEETING October 6, 1981 A regular meeting of the Weld County Planning Commission was held on October 6, 1981, at 1:30 p.m. in the Commissioners' Hearing Room, 915 10th Street, Centennial Building, Greeley, Colorado. The meeting was called to order by the vice—chairman, Jerry Kiefer. CASE NUMBER - 472:81: 19 - Continued from September 15, 1981. APPLICANT - Erie Water and Sanitation District SUBJECT — Wastewater Treatment Plant LEGAL DESCRIPTION — Part of the NW14, Section 6, T1N, R68W of the 6th P.M. , Weld County, Colorado LOCATION — 11 miles north of Erie APPEARANCE: Richard Lyons, Attorney for the District reiterated the presenta— tion made at the last regular Planning Commission Meeting held on September 15, 1981. Tom Honn read the engineer's report submitted by Drew Scheltinga, Engineering Manager for Weld County. Attached as a permanent part of the summary of the meeting. Steve Sears, Chairman of the Weld County Health Board reported there is still no word from Sam Cooper of the State Health Department. However, the Health Board was concerned there may be groundwater contamination. The present lagoon system is not in conformance with the state standards. The Chairman called for discussion from the audience. Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 2 Benny Bruntz, Westview Estates resident told the Committee the residents of this subdivision were contesting the application at the level of county government because they did not know what input, if any, they would have at the state level. The residents of the area feel their homes would decrease in value with a sewer so close to the subdivision. Also, the median income of the residents of the town of Erie is approximately $12,000.00 per year, and it is his feeling it is unreasonable to expect families with income levels this low to be assessed for a new sewer. Sam Little, Westview Estates — It was his feeling the growth of the Erie District in the last ten years has been negligible. It was also his feeling the sewer could be moved about one—half mile north of the proposed site as easily as it could be installed were planned and would be offensive to no one. He also asked if written documentation of tests were done to proved this is the best area for the sewer. Patty Bruntz, Westview Estates asked the members of the Planning Commission to consider this application carefully. The applicants have a right to present the plans for a new sewer; and they have the right to oppose it. This is an important issue to the people who live in the Westview Estates Subdivision. She stated whe was appealing to the Planning Commission as a human being to a human being. Tape 72 - Side 1 Lee Morrison, Assistant County Attorney told the Planning Commission we are still functioning under the old zoning resolution, which has a provision in it which talks about alternatives. Jerry Keifer stated testimoney was given to this Board by the engineers, we accept that testimony, we weight that testimony, this is our job. We then evaluate that testimoney and make a decision. Zelma Dugger, Westview Estates related the problems they had with the town of Erie when she was working on the Parkland Estates Planning Committee regarding use of the town's water supply. Erie does not serve the Westview Subdivision in any way. They are under the jurisdiction of Weld County. If the sewer is approved for this site, the subdivision would probably not be able to hook—on of it, therefore, if there were problems with odor or maintenance it would complicate enforcement and correction of these problems due to dual governmental agencies. Mr. Bell, Engineer for the project reported the town of Erie upped their sewer rates a few years ago from five dollars per quarter to five dollars per month in anticipation of either upgrading or installing a new sewer system. No further rate increases are anticipated for financing the new sewer. Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 3 MOTION Don Billings stated he would like to make a motion; however, he would like to make a comment first. He felt much of the testimony on this application, due to the intense intrest from both sides, tends to get a little beyond what the Planning Commission would normally consider in making a decision, so basing his motion on three items listed in the Special Use Permit Standards he moved this request be denied for the following reasons: 1. It is not compatible with the surrounding area; , 2. Its effect on the immediate area is not good; and 3. Its effect on the future development of this area would be poor. Motion seconded by Bob Ehrlich. The Chairman asked for discussion from the Planning Commission members. There was none. The Chairman asked the secretary to poll the members for their decisions. Wilbur Wafel — yes; Bette Kountz — yes; Don Billings — yes; Bob Ehrlich — yes; Bill Diehl — abstain; Jack Holman — abstain; Jerry Kiefer — No. Motion carried with four voting for, one against and two abstaining. (Comments by Planning Commission members concerning their decision are recorded on Tape 72 — Side 1.) Richard Lyons, attorney for the project, reported the site application received a no comment pending a decision by the Planning Commission. Now that the vote is negative will a letter be written and attached to the site application informing the state of the decision of the Planning Commission? Lee Morrison answered yes, there would be a letter written. He also pointed out the Erie Water and Sanitation District is a separate governmental agency. It is not dependent on Weld County for any funds and, therefore, it is impowered to override any decision by this Board. Jerry Kiefer reported the Board was aware of this, but each application is taken on its own merits and weighed individually by the Board. They (the Planning Commission) does not see this as a waste of their time, although it may be seen by many to be so. CASE NUMBER - USR-478:81:24 APPLICANT - Richard Chana SUBJECT - Greyhound Kennel LEGAL DESCRIPTION — Part of the NEk, Section 35, T1N, R68W of the 6th P.M. Weld County, Colorado. LOCATION — One mile east of 1-25 and 3/4 mile north of Weld County Road 2 APPEARANCE: Richard Chana appeared in his own behalf. He gave background information on the company to the Planning Commission. He stated he had met with all of the neighbors, they had signed a petition; and there is no opposition to this request. He outlined their plans for this permit and the number of employees they anticipated. Jerry Keifer, Chairman, asked if he was aware of the recommendation and development standards proposed by the Department of Planning Service's staff. He stated he had been given a copy just before the meeting, but had not had time to review them. Tom Honn read these documents. Tape 72 — Side 2 The Chairman asked Mr. Chana if he felt they would have any problems living within these perimeters. He stated he would not. MOTION Wilbur Wafel moved USR-478:81:24 be approved and that the recommendations and development standards be forewarded to the Board of County Commissioners along with the Planning Commissions recommendation for approval. CASE NUMBER - USR-477:81:24 APPLICANT - Continental Pipeline Company SUBJECT - Amend CUP-66:80:23 - Truck Unloading Terminal Addition LEGAL DESCRIPTION — The NW4, Section 20, T2N, R66W of the 6th P.M. , Weld County, Colorado. LOCATION - 2 miles north of Fort Lupton on Weld County Road 181/2. APPEARANCE: Lori Tipton represented Continental Pipeline Company. She reviewed the improvements planned for this area. A fourth company will be hauling into this area. Additional impacts on the area will be minimal with an increase of only about four trucks per day. The Chairman called for discussion from the audience. Danny Mentel who resides on Weld County Road 18i stated if the trucks are coming from the south, which is highway 85, they have a side lane to pull off from, if you are coming up Weld Coutny Road 181/2, facing west, pulling off of Highway 85, you cannot see around the trucks to pull onto the highway. You have to pull off onto the highway before you can see the traffic coming from the south. This is a dangerous situation. If the corner cannot be purchased by Continental Pipeline from the estate, Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 5 is there a safer alternative? Discussion between the Planning Commission Members and the Planning Service's staff ensued. MOTION Don Billings moved the Planning Commission recommend to the Board of County Commissioners that USR-478:81:23 be approved and that the Planning Commis- sion request the Board have our county legal staff write a letter to Continental Pipeline outlining what aid might be possible on the radius problem from a condemnation standpoint and perhaps suggesting a trade to justify this sixty foot right-of-way on Weld County Road 18z being paved to the site, and to ask the county engineer to make recommendations about the conditions of Weld County Road 181/2, among them the possibility of paving. Motion seconded by Bill Diehl. The chairman asked for discussion for the Planning Commission members. There was none. The Chairman asked the secretary to poll the members of the Planning Commis— sion for their decisions. CASE NUMBER — SUP-470:81: 16 APPLICANT — Power Resources Corporation SUBJECT — Uranium (In—Situ) Mine LEGAL DESCRIPTION - Part of Sections 25, 27, 34,35 and 36, T9N, R6OW and part of Section 30, T9N, R59W of the 6th P.M. , Weld County, Colorado LOCATION - Adjacent to the town of Keota. Tom Honn, Zoning Administrator, stated this application was setup by the Department of Planning Service's staff to be heard in two parts. They felt at this meeting the applicants could present their studies; there could then be questions from the Planning Commission members and the audience. All referrals have not been received. The staff has addressed some of the concerns regarding this project in the recommendations of the Department of Planning Service's staff. Another hearing is setup at the regular meeting of the Planning Commission on November 3, 1981. APPEARANCE: Milton Childers, Energy Mineral Corporation, outlined the background of this company. Eric Tiepel of Power Resources Corporation, explained the plans for the area, and the various licenses and permits which would need to be applied for in the future, and permits which have been applied for and approved or awaiting approval. He also described the process which would be used Summary of the Weld County Planning Commission Meeting October 6, 1981 Page 6 to remove the uranium using oxygen, water and carbon dioxide. The slurry will not be dried at this site, so there will be very little chance for contamination. He also discussed this project' s impact on the environment, and the community, surface impact and water quality control. He explained their plans for construction, amount of employees anticipated and the approximate amount of revenue which would benefit the area and the county. Tape 73 — Side 1 Ken Kuckar, Energy Mineral Corporation, showed slides on the geological and hydrological findings of this area. The Chairman asked for discussion and comments. Bill Diehl, Planning Commission member inquired about the amount of water that would be used and the quality of the water that would be restored to the wells. Tape 73 — Side 2 Ned Snader, area resident who owns property adjacent to the project outlined his concerns. He stated there are wells in the area that are drawing water from the White River Sands and stated that these wells are dropping. Norman Brown, Weld Ag Council, discussed the Grover Project, investigation of the plugged holes left from this project and the importance of the wells to this area. It was the feeling of the Ag Council, if this project is approved, adequate bonding of the company should be required to compensate the farmers and ranchers adequately if there is a loss of water due to the project. Reference was also made to the Powder River Basin project and the problems that have been encountered by the residents there. Albion Carlson, attorney, representing his son John Carlson, discussed a State Statute regarding use of nontribuatory water, which is how the underground water in this area is classified. Tom Honn stated every effort will be made to address these concerns at the next hearing of the application. Ken Weaver, State Health Department, reported they have several people working on this application and he is not sure they will be able to have a complete report available by November 3, 1981. Tom Honn stated the Department of Planning Services will not holdup their recommendation because of the State Health Department's permits. The partnership was formed on July 1, 1980 , all three partners are knowledgeable in the grey- hound industry, Mr. White is currently serving as vice-president of the Colorado Greyhound Breeder' s Association, and Ms. Stirling has been a successful trainer during the past seven years for several prominent Colorado greyhound kennels. In addition to the general partners, Western Greyhounds currently employs five other people, three on a full-time basis and two on a part-time basis. If approved for the special use permit, three full-time employees would reside on the subject property, and with the assistance of two or three part-time employees, they would handle the daily, on-going operations of the business under / the close supervision of Ms. Stirling. The proposed facilities planned for the subject property would be capable of accomodating 200-300 greyhounds, most of which would be young puppies under the age of 15 months. Training of the greyhounds occurs between the ages of 10-15 months, during which time the proposed sprint field and training track would be used extensively. Once trained, the greyhounds, according to ability, would either be sent to out-of-state tracks or kept on the farm to race on the Colorado circuit. In terms of a working schedule, a typical day on a greyhound farm begins at 7am with the first "turn-out" and ends at 9pm with the last "turn-out" . With respect to pollution, the greyhounds ' waste will be collected from the turn-out pens after each turn-out, of which there are four daily. The waste will be stored in commercial dumpsters and collected on a regular basis by commercial means. Air and water pollution are virtually non-existent and although greyhounds, like any canines, will bark from time-to-time, the company' s past experiences show that greyhounds sleep during the night on the same schedule as most people. This proposal is for zoning to allow a grey- hound training facility. We have not received a water supply plan, but have received a water use estimate. We find this estimate to be quite low and we cannot support these figures. Our own analysis indicates water use would be several times higher. Assuming the well was used to water 300 dogs at one gallon per day, 300 gallons per day would be needed to clean kennels , water would be supplied to the mobile home and the tri-level house, and there would be 5000 square feet of landscape irrigation; we would estimate water use to be 1 . 6 acre-feet/ year. All of these uses may not be intended, but a low estimate is not useful in determining supply. Our analysis of ground water in this area indicates the Laramie-Fox Hills aquifer would be capable of supplying this amount of water. A depth of approximately 800 feet is required to fully penetrate the aquifer. Since greyhounds are short-haired, self-cleaning dogs, it is not necessary to give them baths. As a result, the amount of water necessary for the proposed kennel operation (100-125 gallons daily) would be far less than that needed for the domestic purposes of a family of three or four people. Additionally, only one person will be living in the farmhouse (which would be served by the proposed new well) so a limited amount of water will be needed for domestic purposes.
