RESOLUTION
RE: APPROVAL OF WITHDRAWAL OF SHOW CAUSE PROCEEDINGS CONCERNING
WELD COUNTY DISPOSAL, INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was conducted before the Board
of County Commissioners on the 7th day of September, 1983, at
the hour of 2 : 00 p.m. o' clock in the Chambers of the Board for
the purpose of considering the revocation of Special Use Permit
#454 , Weld County Disposal, Inc. , P .O. Box 304 , Fort Lupton,
Colorado 80621, on the following described parcel of land,
to-wit:
Part of the NWq NW, of Section 12 , Township
1 North, Range 66 West of the 6th P.M. , Weld
County, Colorado
WHEREAS, on the 7th day of September, 1983, the Weld County
Health Department and the Department of Planning Services recom-
mended to the Board of County Commissioners that the proceedings
concerning the Show Cause Hearing for Weld County Disposal, Inc.
be withdrawn, and
WHEREAS, the Board, after review, found it appropriate to
withdraw said proceedings for revocation of Special Use Permit
#454 .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the proceedings for
revocation of Special Use Permit #454, Weld County Disposal, Inc.
be, and hereby are, withdrawn.

PERMIT #454, WELD COUNTY DISPOSAL, INC. •
A public hearing was conducted on September 7 , 1983 at 2:0D P. M. , with
the following present:

The following business was transacted:
This matter was read into the record by Lee D. Morrison Assistant County Attorney.
I hereby certify that pursuant to -a notice dated April 18, 1953, _nc duly
published April 21, 1983, in theta Salle Leader, a public hearing was held
to show cause for revocation of Special Use-Permit #454, Weld County Disposal,
Inc. This matter was first heard on May 71, 1983, and continued to June 1,
1983, because only four Commissioners were present and the representative
for Weld County Disposal, Inc. requested a continuance. -The June 1st hearing
was continued to September 7, 1983, when a letter was received from James W.
Smith, Attorney for Weld County Disposal, Inc. , requesting a continuance.
Mr. Smith advised the Board that Weld -County Disposal. Inc. would cease
• operations on June 1, 1983, for a period of ninety days. . On September 7,
1983, when this hearing came before the Board, Thomas Quamnen, Deputy Dis-
trict Attorney representing Weld County, came forward and recommended that
this action be withdrawn. Wes Potter, representing the Health Department,
-stated the reasons for recommendation of withdrawal. Mr. Andy Hullum, repre-
senting Weld County Disposal, Inc. , was present andcame forward to answer
questions of the Board. After discussion, Commissioner Johnson nerved to
withdraw Show Cause proceeding for the revocation of Special Use Permit #454,
based upon the reconnendations of the Planning and -Health Departments. Com-
missioner Brantner seconded the notion and it carried unanineusly.
