RESOLUTION
RE : GRANT CHANGE OF ZONE FROM C-2 TO C-3 FOR TWO PARCELS
OF LAND LOCATED IN SECTION 9, TOWNSHIP 5 NORTH, RANGE 65
WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has been
presented with a request for a change of zone from C-2 to
C-3, and
WHEREAS, said request is necessary in order for the
property owners to build and make changes and improvements
consistent with their growth, and
WHEREAS, the Board feels it is in the best interests of
Weld County to amend the official Weld County Zoning from
C-2 to C-3 on the following described property:
LEGAL DESCRIPTION
Parcel I
The North Half of Lot 3, except the East 100 feet
thereof, all in the Southwest Quarter of the
Southwest Quarter of Section 9 , Township 5 North,
Range 65 West, Weld County, Colorado.
The owners of Parcel I are James Listen, Carroll
Sorelle, Lake Farms Co. , Rothe Bros . , Inc. and
Scott Realty Co. , with Ernest B. Scott as managing
partner. The proposed purchaser is Jerry Copeland
of Copeland Fastener Co.
Parcel II
The East 100 feet of the North Half of Lot 3 of
the Southwest Quarter of the Southwest Quarter of
Section 9 , Township 5 North, Range 65 West, Weld
County, Colorado.
The owners of Parcel 2 are James 0. Arnold, Darleen
Arnold, Donald Lee Bishop and Barbara Jean Bishop.
WHEREAS , the Board of County Commissioners, pursuant to its
authority under Section 8. 2. 4 of the Weld County Zoning Ordinance,
determines the C-2 zoning to be faulty.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the Change of Zone for the above described
parcels, be and hereby is, approved.

Dear Mr. Honn;
On behalf of a prospective purchaser, and two present owners of property
located in the 100 block of East 18th Street, we would like to request that
the properties described herein have a redistricting change from C2 to C3.
It is my understanding that the properties in question were at one time zoned
under the County's B District and then were rezoned Commercial. Last summer,
the properties were rezoned C2 under the County's new redistricting plan.
I further understand that considerable planning had previously been accomplished
by the owners and your staff to adapt the site for warehousing and at that time
a C3 district had been recommended.
Presently, Parcel 2 below is being used for trailer repair and has been for some
time, a use that requires C3 districting. Parcel 1 is presently vacant (the former
site of the Chuckwagon Dinner Playhouse) but is scheduled to become a retail-
wholesale-warehouse facility for Copeland Fastener Co. Therefore a C3 district
would be appropriate to the use and needs of the property. Copeland Fastener Co.
is currently located immediately across the street from their new site. The use
then is consistent with the existing neighborhood. Their other uses across the
street are also C3 uses.
It is our contention that the properties in question should have been given a
C3 designation at the time redistricting took place. We ask that the County
Commissioners grant this redistricting under provision 8.2.4 of the Weld County
Zoning Ordinances.
