RE: APPROVAL OF RECORDED EXEMPTION NO. 474 - SARGENT FARMS , INC.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held on
the 14th day of January, 1981 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 474 , being the property of Sargent Farms, Inc . ,
described as the Northeast Quarter of Section 25, Township 2 North,
Range 63 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows :

Weld County, Colorado,
Lot "A"
A parcel of land located in the Northeast
Quarter of Section 25, Township 2 North,
Range 63 West of the 6th P.M. , Weld County,
Colorado , being more particularly described
as follows :
Beginning at the Northeast Corner of said
Section 25 and considering the East line
of said section as bearing South 00°00' 00"
West, with all other bearings contained
herein relative thereto;
Thence South 00°00' 00" West, along said East
line, 1304 . 56 feet;
Thence South 86°34 ' 50" West, 285. 04 feet;
Thence North 89°48 ' 55" West, 636. 09 feet;

"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-20--101 (10) (d) , CRS 1973 ,
as amended, and Section 2-lA (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Sargent Farms, Inc. be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 14th day of
January, A.D. , 1981.

Re: Recorded Exemption #RE-474
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Sargent Farms, Inc. for a recorded exemption. The parcel of
land on which this request has been made is described as the NE1, Section
25, T2N, R63W of the 6th P.M. , Weld County, Colorado. This property is
located 3 miles south of Roggen. The property contains approximately 160
acres of Class II irrigated soils. The request is to split the property
into parcels of 28 acres and 132 acres. For financing purposes, Sargent
Farms, Inc. would like to separate the farm ground from the feedlot opera-
tion in order to make the farm more saleable.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be approved
for the following reasons:
1. The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations (intent clause of the recorded exemp-
tion procedure) , Section 3-3 A. of the Weld County Zoning Resolu-
tion (intent clause of the Agricultural Zoned District) and the
Weld County Comprehensive Plan in that the use will be compatible
with surrounding agricultural uses. The request will allow agri-
cultural and related uses to be the predominant land use. There
will be no reduction in the amount of land currently being used
for agricultural production. The request will allow for a more
efficient farming operation by separating the farm ground from
the feedlot operation.
2. The request complies with the provisions of Section 9-4 A. of the
Weld County Subdivision Regulations.

To whom it may concern:
Sargent Farms, Inc. request a recorded exemption seperating the
cattle feeding facilities from the farm land to allow the sale of their
property.
The cattle feeding facilities are constructed in such a manner that
the cattle corrals and well are located in the NEZ of the NEk of Section 25,
Township 2 North, Range 63 West of the 6th PM.
Domestic and livestock water for the livestock facilities is provided
by a high production Fox Hill well which is piped under ground to serve
both parcels on which the facilities are located. This well is located in
the NEB of the NEB of Section 25, Township 2 North, Range 63 West of the
6th PM.
Domestic water is available to all parcels involved in this recorded
exemption reqested by drilling to a depth of approximately 80 feet.
The farming and cattle feeding operation known as Sargent Farms,
Inc. is the result of many years effort by the members of the Sargent
family.
This operation was started by Irwin J. Sargent in 1929 and has since
become I. J. Sargent & Sons, Sargent Farms, Inc. , a sub chapter S
Corporation and finally Sargent Farms, Inc. , a Colorado Corporation.
During this process the farming acreage and cattle feeding facilities
have been continually expanded to accommodate the increasing number of
family members.
while under the management of I. J. Sargent the operation was
financially successful. Since the retirement of Mr. Sargent in 1973 the
burden of management has been handled poorly resulting in finanncial
losses and severe personal problems for the remaining family members.

We have made every effort to sell our property as a unit with in the
time frame allowed by our lenders. Being unable to sell our property as
a unit we have accepted an agreement to purchase this property excluding
the parcels requiring the recorded exemption being requested.
It is the opinion of our lenders that this sale will be necessary
to prevent legal action from being brought against Sargent Farms, Inc.
