WHEREAS , the Board of County Commissioners of Weld County,
4 Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
v Colorado has reviewed the request of Piedmont Exploration for
an exemption from the definitions of "subdivision" and "sub-

divided land" in Section 30-28-101 (10) , CRS 1973 , as amended,
and Section 2-1 of the Weld County Subdivision Regulations , and
WHEREAS, the Board of County Commissioners finds that

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that the abovedescribed

parcel be, and hereby is, declared to be exempt from the
definitions of "subdivision" and "subdivided land" as set
forth in Section 30-28-101 (10) , CRS 1973 , as amended, and
Section 2-1 of the Weld County Subdivision Regulations,
BE IT FURTHER RESOLVED by the Board that the resulting
parcel of land as described above be, and hereby is , considered
to be a single lot.
The above and foregoing Resolution was, on motion duly

Piedmont Exploration Company , a Greeley Colorado based company,
has recently drilled several oil wells in the New Raymer area
and plans to drill more .
In order to sell the gas produced [with the oil] from these and
future wells Piedmont must "treat" the produced gas to remove
certain liquids . Treatment of the gas requires addition of
facilities . These additional facilities will be located on the
property being leased from Mr . Kugler in Section 11-7N-58W.

LEASE AGREEMENT
AGREEMENT made this 17th day of December , 1981 ,
between PIEDMONT EXPLORATION, INC. , a Colorado corporation, Lessee
and PAUL KUGLER, Lessor.
Lessor has this day leased to Lessee, the following described premises
in the County of Weld and State of Colorado, to wit:
Three (3) acres more or less in the
SW** of SWi of Section 11 , Township 7
North, Ra nge 58 West of the 6th. P.M.
for the term of five (5) years commencing on the 17th day of December
1981, and ending on the 17th day of December , 1986, upon the terms
and conditions as follows:
1 . RENT : The rent for the term of this lease shall be $ 2,500.00
payable in equal annual installments of $ 500.00 on the anniversary date
of this lease, commencing December 17 , 1981 .
2. OPTION TO RENEW: Lessor grants and Lessee reserves the
right to renew this lease agreement for two (2) consecutive five (5) year
terms under the same terms, conditions and provisions herein.
3. USE OF LEASEHOLD : Lessee will use the leasehold herein for
the purpose of constructing and operating a gas processing plant.
4. WAIVER OF LIABILITY FOR SURFACE DAMAGE : Lessee shall
have the right to construct and operate the gas processing plant free
and clear of any liability to Lessor for surface subsidence or other
damages to the surface of the land as the result of the construction and
operation.
5. INCIDENTAL RIGHTS LEASED: As appurtenant to the leasehold
and the rights hereby let, Lessor does hereby grant to Lessee the right
to use water from the leased premises for the construction and operation of

the gas processing plant and the operation of machinery and equipment on
the leased premises and rights of ingress and egress, together with all
such easements and rights-of-way upon and over the leased premises as
may be necessary, useful or convenient for the transportation of product or
equipment from the leased premises, and the right to remove at any time
and from time to time all pipelines, stations, plants, tanks, structures,
machinery, equipment and appurtenances placed by it on the leased premises
where in Lessee's judgment such property is no longer needed or useful
for the operation of the leased premises for the purpose described herein.
Lessee shall have the right to remove any and all machinery, fixtures,
buildings, and personal property placed on the leased premises by Lessee
or by those acting under Lessee.
6. CONTINUATION OF LEASE : Any sale, transfer,conveyance or
alienation by Lessor of the land and rights of. Lessee described in this
leasehold shall be specifically subject to this lease agreement including
all options to renew and renewal periods.
