RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A MOBILE HOME STORAGE SITE - DALE C. BARR WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 7th day of December, 1983 , at the hour of 2 :00 o' clock p.m. in the Chambers of the Board for the purpose of hear- ing the application of Dale C. Barr, 9607 West Colfax, Lakewood, Colorado 80215 , for a Use by Special Review for a mobile home storage site on the following described real estate, to-wit: Part of the SW4, Section 25, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado WHEREAS , Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24. 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24. 4. 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Weld County Comprehensive Plan. b. The proposal is consistent with the intent of the Agricultural Zone District in which the use is located. c. The uses which would be permitted will be com- patible with existing surrounding land uses and with future development of the surrounding area. d. No overlay distridts affect the site. e. BARR U.S.R. - 588:83:51 1. The permitted use shall be a storage site for repossessed mobile homes as described and located in the submittal application materials and plat on file with the Department of Planning Services. There shall be no more than 200 mobile hares on the site at any one time. 2. Each individual mobile have shall be blocked -and tied down as required by the Weld County building Code. 3. An authentication form available from the Weld County Treasurer's Office will need to be obtained for the movement of any mobile hares off the site or fran any location within Weld County. 4. An oversized or overweight load permit will need to be obtained from the State -Highway Department for each and every mobile hare prior to travel on or across State Highways. 5. To prevent soil erosion, permanent -grass shall be planted -to cover the Use by Special Review area. Perennial grass approved by the Soil Conservation Service shall be planted prior to May 15, 1984. 6. To ensure adequate fire protection the following measures shall be adopted: A. Mobile homes shall be spaced a minimum of six (6) feet apart. B. Mobile hares shall be grouped in multiples of six (6) or less. Each group DI -mobile homes shall be separated by a minimum of fifteen (15) feet. C. An address shall be visible fran Weld County Road 11 fronting the access easement. Said numbers shall be a minimum of 5 inches in height and 3[4 inches in stroke. D. Four fire extinguishers shall be located on the site. All fire extinguishers shall have a minimum rating of 4A-20BC, mounted three (3) -to five (5) feet from the ground and properly marked for easy visibility. E. No smoking signs shall be strategically located throughout the area. F. All weeds, grass, or other growth shall not exceed three (3) inches at any one time or place in the Use by Special -Review storage areas. 7. Only wholesale sales of the mobile hones shall be conducted on or from the property. 8. No individual mobile have shall be stored on the Use by Special Review Area fora period in excess of nine (9) months. 9. Upon termination of the use as a mobile have storage site, all mobile homes, parts of mobile hares and -debris from mobile homes and all associated _equipment shall be removed from the site within a period o₹ ninety (90) days by the owner. 10. Upon request, the applicant shall provide records to the Department of Planning Services staff -confirming the slate the mobile have was moved onto the property. 11. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. Dale C. The applicant shall comply with the Operation St-andards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 13. Representatives or members of the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 14. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards _as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of _County Commissioners before such changes from the plans -and/or Standards are permitted. Any other changes shall be _filed in the office of the Department of Planning Services. 15. The property owner and/or operator of this operation -shall be responsible for _complying with all of the above stated standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. HEARING CERTIFICATION -DOCKET #83-79 ' RE: USE BY SPECIAL REVIEW, MOBILE HOME STORAGE SITE, DALE C. BARR A public hearing was conducted on December 7 , 1983 at 2:00 P. Russell Anson Planning Department Representative, James Mayerl The following business was transacted: I hereby certify that pursuant to a notice dated November 21, 1983, and duly published November 23, 1983, in the La Salle Leader, a public hearing was held to consider the request of Dale C. Barr for a Use by Special Review for a mobile home storage site. Russell Anson, Assistant County Attorney, read this pro- posal into the record. Planning Department representative, James Mayerl, read the favorable recommendation from the Planning Commission into the record. He also read the Operation Standards recommended by the Planning Commission into the record. Mr. Dale Barr came forward to explain his request to the Board. Commissioner Martin said he felt that since the possibility exists of this matter being controversial, it should be explained to Mr. Barr that because only 4 Commissioners are present, this hearing can be continued until all 5 Commissioners -are present. Mr. Barr chose to be heard before the 4 Commissioners present. Mr. Barr then explained his request. He said this property has been used as a hog farm and a dog kennel operation has also • been there. Mr. Barr said if this USR is approved, the mobile homes would be placed in groups of 6 and would be 6 feet apart and the next group would be placed 15 feet away. He said there would he no utilities connected:. to the mobile homes because no one will be living in these mobile homes. He said each mobile home would be blocked and staked according to County regula- tions. He said none of the mobile homes would be kept on the property over nine months. Mr. Barr requested that Standard #1 Standard #6-F be amended. He said he would like to have the word, "repossessed" deleted from Standard #1 and in Standard #6-F he' is concerned about the requirement that the grass be no more than 2 inches in height; he would like to have this amended to read that it should not exceed 9 inches in height. Mr. Mayerl said he had contacted Doug Kraft, Fire Prevention Chief of Brighton, and Mr. Kraft was adamant about the 3 inch height for the grass because of the potential for fire spreading much faster with a higher grass height. Mr. Mayerl then questioned the request to remove the word, "repossessed" from Standard #1. Mr. Barr explained and said there would he no retail sales from this property. After a short discussion, Mr. Barr introduced Mel Knutson. Mr. Knutson will be renting the property from Mr. Barr and operating the business. Mr. Knutson answered questions of the Board. Neighbors who were in opposition to this request and came forward to explain why they are opposed included: Howard Shannon, Stan Hayes, Randall Lorens and Lois Roberts. Stan Hayes also submitted a petition which contained 18 signatures of neighbors opposed to this proposal and pictures. After discussion, Mr. Barr summarized his presentation and answered questions of the Board. Rebuttal statements were made by Mr. Barr and certain neighbors opposing this request. (Tape Change No. 83-145) Commissioner N. Carlson explained that the advantage of presenting this as a Use by Special Review, rather than a Change of Zone, is that if the operator does not make this a successful business venture, then a new operator cannot use this Use by Special Review; whereas a Change of Zone would be permanent. Russell Anson agreed, saying that the Use by Special Review only applies to the use of the land. Commissioner Martin said he had received two calls in opposition. Page 2 RE: USR - BARR After further discussion, Commissioner N. Carlson moved to approve this Use by Special Review for Dale C. Barr for a mobile home storage site with the Operation Standards. Commissioner Martin seconded the nation. A short dis- cussion followed the second and the nation carried by the following vote: Commissioners N. Carlson, Brantner and Martin voted aye. Chairman C. That is the zoning request which will have a final h-earing this Wednesday, -Den-ember the seventh at 2:00pm in Greeley at 91x 10th Street. These mobile homes are -BANK -REPOSSESSIONS. This -can be interpreted to mean units that are heavily :damaged reflecting -virtually no pride of ownershir: The obvious result of our allowing this intrusion can only be the -creation of -a junk/salvage oneration right in our back yard. If we allow this zoning variance to pass it will have a negative effect on all of us. Following are several reasons setting out this fact. 1 . There vrill be a vast increase in rodents (rate and mice) . These uninhabited trailers will 'Provide ideal shelter and breeding grounds. ?remember these are not new mobile homes but repossessed ones with food and -clothing left behind. -This rodent population will do great damage to our alfalfa growing neighbors as well ae creating a constant tattle for each of us in our homes. 2. The increased traffic will nose a threat to all of us, our nets and children. There will to hazardously wide loads on an inadequate dirt road. 3. the consistant flow of mobile homes and buyers in and but of this property will greatly increase our existing dust problem. 4. With our rural neighborhood -being located straight east of Boulder, we are all familiar with the ea to 100 mile per hour winds that are common in the spring and fall of each year. These severe winds can only result in damage to these units. The flying debris will pose a tremendous threat to property, livestock and, most importantly, the people of the area. 5. These repossessed mobile homes, when stored so closely together and unattended, will greatly increase the possibility of a tremendous fire in our area. These mobile homes are going to have canines (attsc'.k dogs) guarding them. The neonle leasing the land for this storage site have already posted intimidating signs to this effect. The mere presence of these vicious animals in our area poses a threat to all of us- especially the children. Livestock, poultry and game birds will also be unwary prey. 7. The decrease of property values will affect us all. We live here because it is an agricultural settinT without industrial eyesores. In recent years we have had several nice homes built in this area. These home sites were chosen for the quality of the rural neighborhood. The creation of a storage/salvage yard can only result it degeneration cf our area. We must rally together now to preserve our quality of life. The people who wish to rut this trailer yard up are NOT landowners/taxpayers but only lease the land. They do not care about land values, increased property taxes, or quality of our rural life. In conclusion the defeat of this zoning variance and preservation of our beautiful area may well hinge on your support ! The only way we can stop this mobile home graveyard is through maximum effort. The permitted use shall be a storage site for repossessed mobile home-s as described and located in the submittal application materials and plat on file with the Department of Planning Services. There shall he no more than 200 mobile homes on the site at any one time. 2. Each individual mobile home shall be blocked and tied down as required by the Weld County Building Code. 3. An authentication form available from the Weld County Treasurer's Office will need to be obtained for the movement of any mobile homes off the site or from any location within Weld County. 4. An oversized or overweight load permit will need to be obtained-from the State Highway Department for each and every mobile tome prior to travel on or across State Highways. 5. _To prevent soil erosion, permanent grass shall be planted to cover the Use by Special Review area. Perennial grass approved by the Soil Conservation Service shall be planted -prior to May 15, 1984. 6. To ensure adequate fire protection the following measures shall be adopted: A. Mobile homes shall be spaced a minimum of six (6) feet apart. B. Mobile homes shall be grouped in multiples of six (6) or less. Each group of mobile homes shall be separated by a minimum of 15 feet. C. An address shall be visible from Weld County Road II fronting the access easement. Said numoers shall be a minimum of 5 inches in height and 3/4 inches in stroke. D. Four fire extinguishers shall be located on the site. All fire extinguishers shall have a minimum rating of 4A-20BC, mounted 3 to 5 feet from the ground and properly marked for easy visibility. E. No smoking signs shall be strategically located throughout the area. F. All weeds, grass, or other growth shall not exceed 3 inches at any one time or place in the Uae by Special Review storage areas. 6. No retail, wholesale or commercial sales of the -mobile homes shall be conducted on or from the property. 7. Upon termination of the use as a mobile home storage site, all mobile homes, parts of mobile homes and debris from mobile homes and all associated equipment shall be removed from the sitewithin a period of 90 days by the owner. 8. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 9. Barr for a temporary mobile home storage site has been reviewed. The Area is currently being dryland farmed and the applicant states, in the future, there will be continuous weed mowing. Natural weed growth will not provide adequate cover to prevent erosion, the area will be a source of weed seed that will be detri- mental to farming and continuous weed mowing will be expensive. A treatment for the area which will save money for the owner over the long term and be better for soil conservation is to plant permanent grass.
