RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 134 - HORSES UNLIMITED

WHEREAS, the Board of County Commissioners of Weld County,

Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter , is vested with the authority of administering the

affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
r Colorado has reviewed the request of Horses Unlimited for an
exemption from the definitions of "subdivision" and "subdivided
land" in Section 30-28-101 (10) , CRS 1973 , as amended, and
Section 2-1 of the Weld County Subdivision Regulations , and
WHEREAS, the Board of County Commissioners finds that
Horses Unlimited is the owner of a certain parcel of land located
in part of the West Half of the Southwest Quarter of Section 11 ,
Township 2 North, Range 68 West of the 6th P.M. , Weld County,
Colorado. This request is for a property boundary adjustment
and the legal descriptions of the resulting tracts of land are
as follows:

of the 6th P. M. in Weld County, Colorado,

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the aforementioned
tracts of land owned by Horses Unlimited be, and hereby are,
declared to be exempt from the definition of "subdivision" and
"subdivided land" as set forth in Section 30-28-101 (10) , CRS 1973 ,

Regulations, and further finds that said tracts shall be considered
to be single lots.
The above and foregoing Resolution was , on motion duly made

the interest of Horses Unlimited , the fee owner ,
and James E . Starbuck , the Contract purchaser ,
of the property to be exempted .
4 . Plot plan of the properties as prepared by Scott ,
Cox & Associates , Inc . , Consulting Engineers .
The history of this property is as follows : In March of
1977 , a recorded exmption was granted to Horses Unlimited , the
owner of the property at that time . That exemption, No. 1313-
11-3-RE-248 , was recorded March 17 , 1977 , as Reception No.
1713981. For your convenience , I have enclosed a copy of the
documents that were recorded.
The present application requests permission to convey a
parcel of approximately 1 1/2 acres to Flatiron Paving Co .
Flatiron proposes to combine the 1 1/2-acre tract with the prop-
erty already owned by Flatiron which lies immediately South and
East of the 1 1/2-acre tract . In fact , the parcel to be exempted
is contiguous with the Flatiron tract on the South and East
boundaries of the parcel to be exempted .
The effect of the exemption would be to decrease in

size Tract "B" as created by the exemption in March of 1977
and to increase in size the Flatiron Paving parcel . No new
parcel is being created as a result of the proposed exemption .
It is my understanding from my conversations with you that
it is also necessary to amend the prior recorded exemption in
order to make the boundary consistent with the reduced Tract "B" .
Also enclosed with this letter is the combined application
fee of $105 to cover the recorded exemption and subdivision
exemption application . At present , we are not certain what
the recording costs will be but I would be happy to forward a
check immediately for those costs upon request by the Department.
As I told you by phone , Transamerica will deliver the Certi-
ficate of Conveyances directly to you in the next day or so .
Also , the original mylar with signatures will be delivered as
soon as we have obtained all signatures .
As I also mentioned , it is imperative we process these
applications as soon as possible as the Flatiron Contract calls
for completion of the process no later than May 22 , 1981 . Thus ,
anything you can do to move things along would be greatly appre-
ciated.
If you require additional information or documentation ,
please contact me by phone and I will see that it is provided

submitted is south of the intersection of I-25 and Highway 119 at Del Camino
This application is submitted to your office for review and recommenda-
