HomeMy WebLinkAbout800543.tiff RESOLUTION RE: SUBMITTING TO THE QUALIFIED ELECTORS OF THE COUNTY OF WELD, STATE OF COLORADO, AN AMENDMENT TO SECTION 4-3A OF ARTICLE IV OF THE HOME RULE CHARTER FOR WELD COUNTY, COLORADO CON- CERNING POWERS OF THE BOARD OF HEALTH. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of Health of Weld County has requested the Board of County Commissioners to place a proposed amendment to the Weld County Home Rule Charter on the November 4 , 1980 general election ballot, and WHEREAS, the Clerk and Recorder of Weld County, Mary Ann Feuerstein, has presented to the Board of County Commissioners a petition bearing the signatures of qualified electors of Weld County which number more than 5% of the total votes cast at the last general election, and WHEREAS, Section 30-11-506 , C.R.S . 1973 , and Section 17-3 of Article XVII of the Home Rule Charter require that a resolution be adopted by the Board submitting the proposed amendment to the qualified electors. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado: Section 1. At the next general election to be held on November 4 , 1980, there shall be submitted to the qualified electors of the County of Weld, State of Colorado, for their approval or rejection, the following amendment to the Home Rule Charter for Weld County, Colorado, to-wit : Section 4-3A of Article IV of the Weld County Home Rule Charter is hereby amended by the addition of a new paragraph (5) to read as set forth in Exhibit "A" , a copy of which is attached hereto and incorporated herein by reference. Section 2 . Each elector voting at said election and desirous of voting for or against said amendment shall cast his vote as 80054 S CRO0D provided by law either "Yes" or "No" on the proposition: "Shall Section 4-3A of Article IV of the Home Rule Charter for Weld County, Colorado be amended by the addition of a new paragraph (5) to provide that the Board of Health shall have the powers and duties set forth in state statute specifically subject, however, to the power of the Board of County Commissioners to approve the budget of the Health Department?" Section 3 . The votes cast for the adoption or rejection of said amendment shall be canvassed and the result determined in the manner provided by law, and if a majority of the electors voting on the question shall have voted "Yes" , the said amend- ment shall become a part of the Weld County Home Rule Charter. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 1st day of Octboer, A.D. , 1980.
