RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 66 : 80: 14 FOR INCREASED
CAPACITY FOR UNLOADING CRUDE OIL - CONTINENTAL PIPELINE COMPANY
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public meeting on the 14th day of January, 1981
at the hour of 9 : 00 o' clock a.m. for the purpose of hearing the
application of Continental Pipeline Company for a Conditional
Use Permit for increased capacity for unloading crude oil on the
following described real estate, to-wit:
Part of the Northwest Quarter , Section 20,
Township 2 North, Range 66 West of the 6th
P.M. , Weld County, Colorado
WHEREAS, a representative of the petitioner was present, and
WHEREAS, evidence was presented in support of the approval
of the Conditional Use Permit for increased capacity for unloading
crude oil , and
WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolution
authorizes such a use in an Agricultural District upon approval
of a Conditional Use Permit by the Board of County Commissioners,
and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, has studied the request of the petitioner and the recom-
mendations of the Weld County Planning Commission and all of the
exhibits and evidence presented in this matter, and having been
fully informed, is satisfied that the request for a Conditional
Use Permit for increased capacity for unloading crude oil on the
hereinabove described real estate, complies with all of the condi-
tions as set out in Section 3. 3. D. (2) of the Weld County Zoning
Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of

Continental Pipeline Company for a Conditional Use Permit for
increased capacity for unloading crude oil on the hereinabove
described tract of land be, and hereby is , granted subject to
the following:
1. The Development Standards contained in the
Conditional Use Permit.
2. No building or electrical permits shall be
issued on the Conditional Use Permit area
until the Development Standards for the
Conditional Use Permit have been placed
on the Conditional Use Permit plat and said
plat has been delivered to the office of the
Department of Planning Services.
3. It shall be the responsibility of the appli-
cant to insure that the proposed road modi-
fication improvements are completed within
six months of the Board of County Commis-
sioners' approval. The proposed road modifi-
cation improvements shall be constructed
in accordance with the recommendations
and/or requirements of the Colorado Division
of Highways.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the reasons for approval contained
in the Weld County Planning Commission recommendations dated
January 6, 1981 be, and hereby are, adopted as the findings of
fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 14th day of

Be it Resolved by the Weld County Planning Commission that the
application for increased capacity for unloading crude oil
covering the following described property in Weld County,
Colorado, to-wit:
part of the NWq, Section 20, T2N, R66W of the 6th. P.M.
be recommended (favorably) (xaft0000DbXl(lv) to the Board of County
Commissioners for the following reasons:
1 . It is the opinion of the Planning Commission that this request is in agreement
with the Weld County Comprehensive Plan in that the proposed use would not appear
to have any adverse impacts on the agricultural interest of the county or the
environment.
2. It is the opinion of the Planning Commission that with the design and controls
proposed in the operation, and the attached development standards, there is
little chance for adverse impacts on the surrounding environment.

compliance with the provisions of Section 3.3.D. (2) of the Weld County Zoning
Resolution. This determination is based in part upon a review of the information
submitted by the applicant, other relevant information regarding the request
and the responses of the referral entities which have reviewed this request.
The Planning Commission recommendation for approval is conditional upon the
following:
1. The attached Development Standards being recommended and adopted for the
conditional Use Permit.
2. No building or electrical permits shall be issued on the Conditional Use
Permit area until the attached Development Standards for the Conditional Use
Permit have been placed on the Conditional Use Permit plat and said plat has
been delivered to the office of the Department of Planning Services .
3. It shall be the responsibility of the applicant to insure that the proposed
road modification improvements are completed within six months of the Board
of County Commissioners approval . The proposed road modification improvements
shall be constructed in accordance with the recommendations and/or requirements
of the Colorado Division of Highways.

DEVELOPMENT STANDARDS
I . The permitted use of the hereon described parcel of land shall be a
Crude Oil Truck Unloading Facility. Facilities shall be limited to
those shown hereon.
2. Items to be stored in the Material Storage Area may include the fol-
lowing:
A. 2-inch, 3-inch, 4-inch, 6-inch, 8-inch and 10-inch line pipe in
the following maximum quantities: (a) 2-inch: 300 feet (b)
3-inch: 1 ,500 feet (c) 4-inch: 1 ,500 feet (d) 6-inch: 500 feet
(e) 8-inch: 300 feet (f) 10-inch: 300 feet.
B. 2-inch through 10-inch steel valves with a maximum number of valves
of all sizes to be 15.
C. 2-inch through 10-inch flanges, elbows, tees and other steel
fittings, with the maximum number of fittings to be 20.
D. Pumps, engines and electric motors with a maximum of 15 items.
3. There shall be only three automatic custody transfer (A.C.T. ) units
at the site. Each A.C.T. unit shall consist of a strainer, a meter
and an automatic sampler together with necessary valves, piping and
related appurtenances.
4. A paved apron complete with catch basins shall be placed in both areas
of unloading activity so as to gather and contain any oil which is lost
during unloading operations.
5. The Conditional Use Permit area shall be surrounded by a 3-strand barbed
wire fence as shown on the plans. The above ground piping, equipment,
tanks and material storage area shall be enclosed by a six foot chain
link fence topped with three strands of barbed wire. No fences shall
be constructed across the Platteville Ditch. Any fence parallel to
the ditch shall be placed no 'oloser=than -ttfteen feet from the toe of
the existing dike.
6. The Conditional Use Permit area shall be maintained in such a manner
as to prevent soil erosion, fugitive dust and the growth of noxious
weeds. The appearance of the facility shall be maintained in a neat
and orderly condition through periodic painting and maintenance.
7. All phases of the operation shall comply with all County and State
Health Standards and Regulations pertaining to air quality, water
quality, noise emission, and sanitary disposal systems. No underground
disposal of any waste shall be permitted without a proper permit from
the Colorado Department of Health. This excludes disposal in sealed
units that are designed to recover wastes.

8. Parking for up to five oil transport trucks (in addition to four at
the unloading points) will be provided on the property. There shall
be no parking of oil transport trucks on County Road 18₹ and/or U.S.
Highway 85 either before or after unloading.
9. Access shall be limited to the two proposed points shown hereon.
The traffic pattern at the facility shall be one way only. All
internal roads shall be graveled. All accesses shall have the
approval of the Weld County Engineering Department. All accesses
shall be constructed in accordance with the recommendations
and/or requirements of the Weld County Engineering Department.
10. Upon cessation of operations of the crude oil truck transfer facility
all structures shall be removed to thirty inches below grade and the
Conditional Use Permit area shall be reclaimed to a farmable state.
II . Continental Pipeline Company shall provide personnel and appropriate
fire fighting equipment to stand by during the burn-off of weeds
along the ditch adjacent to their facilities in order to confine the
burned area.
12. Representatives or members of the Weld County Health Department
and Weld County Department of Planning Services shall be granted
access onto the site at any reasonable time in order to insure the
operations carried out on the site comply with the Development Stan-
dards stated hereon and all applicable Weld County Regulations.
13. The Conditional Use Permit shall be limited to the plans shown hereon
and governed by the Development Standards stated above and all applic-
able Weld County Regulations. Any material deviations from the plans
and/or Development Standards as shown or stated above shall require
approval of an amendment to the Conditional Use Permit by the Planning
Commission and the Board of County Commissioners before such changes
from the' plans and/or Development Standards shall be permitted. Any
other changes from the plans and/or Development Standards shall be
filed in the office of the Department of Planning Services.
14. The property owner and/or operator of this operation shall be responsible
for complying with all of the above stated Development Standards. Non-
compliance with any of the above stated Development Standards may be
reason for revocation of the Conditional Use Permit by the Board of
County Commissioners.

Comments:
Our office has received a petition containing 13 signatures which raises
concerns regarding the problems of visibility at the intersection of
County Road 18f and U. S. Highway 85 and truck traffic using County Road
18f.
It is felt by the Department of Planning Services staff that condition
#3 for approval addresses one of the issues raised by the petitioners.
The other issue of truck traffic should be addressed by the applicant
to the satisfaction of the Planning Commission and Board of County Com-
missioners during the public hearing process.

south of County Road 181 and east of U. S. Highway 85 has been acquired
for the proposed road modification improvements.
It shall be the responsibility of the applicant to insure that the proposed
road modification improvements are completed within the specified time
which shall be established by the Board of County Commissioners.

Attention:
Weld County Department of Planning
The taxpayers and tennants living on and using W.C.R.
181 are very concerned with Amend. CUP 46 : 79; 6 , concern-
ing the increase of capacity for unloading crude oil at
intersection W.C.R. 181 and Colo. Highway 85 . There are
two reasons for our concern and anyone using RD . 181.
1 . Visibilty to the South for any vichicle pull-
ing on Highway 85 from the East is completly
blocked if an oil tanker is stopped and wait-
ing to turn East on 182. The reason they are
stopped, is that they need both sides of road
181 to make the turn with their length. It is
impossible to see through the truck and to see
around the truck means pulling onto the highway,
which is extremely dangerous . If more land was
purchased S . E . of the intersection, a complete
turn off could be made by the tanker and this
problem could be solved. We sincerely hope
someone doesn 't have to die to accomplish this
task; (See Example)
2 . Tankers are using Rd . 181, which is not a thru
East, West road, instead of continuing down RD .
20, to avoid going back to Port of Entry.
Some are traveling 55 to 60 mph which in our
estimation is too fast for a loaded tanker to
travel on a gravel road where children or
animals could wonder unintentionally . We feel
these problems should be remedied before any
consideration is given to expanding any exist-
ing Continental pipe line facilities at this
location.

A tract of land in the NW quarter of Section 20,
Township 2 North, Range 66 West, of the 6th P.M.
in Weld County, Colorado, said tract being more
particularly described as follows:
Beginning at a point on the south line of said
NW quarter of Section 20 from whence the west
quarter corner of said Section 20 bears North
89°55' 51" West, 45 . 00 feet; thence North 00°10'
00" East, 390 . 35 feet along the East right-of-
wag boundary of U.S . Highway 85; thence South
89 55 ' 51" East, 333 . 70 feet to a point on the
West right-of-way boundary of the Union Pacific

CONDITIONAL USE PERMIT / AMENDMENT
Description of Proposed Operation
The modifications proposed for the existing truck unloading
facility at Spindle B Station are required by Continental Pipe
Line Company in order to increase the capacity of the facility
to receive additional truck transports currently unable to
use the facility. The facility will continue to be automated.
Continental Pipe Line Company employees, stationed at the Fort
Lupton Pump Station, will maintain and supervise the operations
at the unloading facility. There are not now, nor will there be ,
any personnel physically assigned to the Spindle B Station,
thereby eliminating the need for a water supply or a sewage
disposal system.
Under current operations , the facility provides for three crude
oil transports to unload their contents simultaneously, while
providing parking for up to five additional transports on the
facility grounds. Individual transport operators make the
necessary connections to the facility to unload and pump their
contents directly into designated breakout tankage . At a
predetermined level , a pump will automatically begin transferring
volumes from that tank, through an Automatic Custody Transfer (ACT)
unit for measurement, and subsequent delivery via underground
pipeline, to Contenintal Pipe Line Company' s mainline injection
station at Fort Lupton. _ The facility has one (1) 1000 barrel
tank and one (1) 500 barrel tank enclosed by an earthen dike,
two ACT units, a 6 foot high chain link fence around the tank
and ACT area, and three truck unloading pumps. The paved aprons
where the trucks unload are equipped with catch basins which
gather and contain any oil which is lost during unloading
operations, thus eliminating the hazard of ground water pollution.
The proposed modifications will be designed and constructed so
that an additional crude oil transport can unload at the facility. _
An additional curbed and paved apron will be installed equipped
with a catch basin to gather and contain any oil which is lost _
during the unloading operation. A pump will be installed
adjacent to the apron, approxamately 100 feet north of the existing
tankage. The earthen dike surrounding the existing tankage
will be enlarged to facilitate the addition of two (2) 400
barrel tanks. One additional ACT unit will be installed
immediately adjacent to the two existing ACT units. The operation
and maintenance of this expanded facility will be identical
to the existing facility. The facility will provide parking for
five additional transports on the property while they wait use of
the facility. The 6 foot high chain link fence around the tank
and ACT area will be maintained.

Traffic volume at the Spindle B Station will average approxi-
mately thirty trucks per day. Truck traffic will be the highest
during daylight hours, with approximately one-sixth of the . . .
unloading occurring between 6 PM and 6 AM daily.
Acceleration and deceleration lanes have been installed on the
U.S. Highway 85 to County Road 181 exit, thus eliminating any
traffic hazard.
The facility will be maintai •;ed in a neat and professional
manner. Noxious weeds or any unsightly debris will be disposed
of promptly and in accordance with any applicable regulations.
Facility will comply with noise levels as stated in 25-12-103,
CRS 1974 . Environmental and safety precautions at the facility
will also be provided for.
In addition, the facility will continue to comply with all the__ ___
previously agreed upon CUP Development Standards to which this
Amendment does not address- and/or change.
