Resolution Approve Memorandum of Agreement to Purchase Property Interest for Acquisition of Public Road Right-of-Way, Temporary Construction Easement, and Permanent Slope Easement for Intersection of County Roads 74 and 31 Roundabout Project, Accept Property Conveyance of Same, and Authorize Chair to Sign All Necessary Documents — Michael and Patricia Maxwell Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Memorandum of Agreement to Purchase Property Interest for the Acquisition of Public Road Right-of-Way, Temporary Construction Easement, and Permanent Slope Easement, for the Intersection of County Roads 74 and 31 Roundabout Project, and the acceptance of property conveyance of same, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Michael and Patricia Maxwell, with further terms and conditions being as stated in said agreement, and Whereas, after review, the Board deems it advisable to approve said agreement and accept said property conveyance, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Agreement to Purchase Property Interest for the Acquisition of Public Road Right-of-Way, Temporary Construction Easement, and Permanent Slope Easement, for the Intersection of County Roads 74 and 31 Roundabout Project, and the acceptance of property conveyance of same, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Michael and Patricia Maxwell, be, and hereby is, approved and accepted. A waiver valuation has been prepared for this property by Western States Land Services. The waiver valuation provides an initial, fair market value, compensation value at which negotiations with the landowner begin. Right-of-way and easement areas, land valuation amounts and incentive values for this acquisition are given in the table below.
