HomeMy WebLinkAbout20260717 Resolution Approve Cancellation and Full Release of Warranty Collateral for Use by Special Review Permit, USR14-0080 — Waste Management of Colorado, Inc. Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, on August 24, 2016, the Board approved the application of Waste Management of Colorado, Inc., 5500 South Quebec Street, Suite 250, Greenwood Village, Colorado 80111, for Use by Special Review Permit, USR14-0080, for a Solid Waste Disposal Site and Facility (solids treatment and beneficial reuse of commercial exploration and production waste and other appropriate non-hazardous waste streams, including cements and other non-hazardous solid waste with free water or liquids, oil water slurries, high oil content slurries, produced water/flowback from exploration and production wells, and drilling fluids (muds), along with an Oil and Gas Support Facility (Class II Oilfield Waste Disposal Facility — Saltwater Injection Facility) and obtain a Certificate of Designation in the A (Agricultural) Zone District on the following described real estate, to wit: A portion of Sections 26 and 35, Township 3 North, and a portion of Sections 2 and 11 , Township 2 North, all in Range 64 West of the 6th P.M., Weld County, Colorado Whereas, on July 10, 2019, the Board of County Commissioners of Weld County, Colorado, approved an Improvements and Road Maintenance Agreement According to Policy Regarding Collateral for Improvements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Waste Management of Colorado, Inc., with further terms and conditions being as stated in said agreement, and accepted project collateral, in the form of Performance Bond #82440823, drawn on the Federal Insurance Company, 202B Hall's Mill Road, Whitehouse Station, New Jersey 08889, in the amount of $1 ,342,850.00, and Whereas, on July 8, 2024, the Board approved the request of Waste Management of Colorado, Inc., to release 85% of the project collateral for USR14-0080, in the amount of $1,141,422.00, and retain warranty collateral in the amount of $201 ,428.00, for the duration of the warranty period, and Whereas, on January 15, 2026, the Department of Planning Services received a request from Waste Management of Colorado, Inc., to release the warranty collateral for the two (2) year warranty period as the obligation has been met and the improvements have been annexed by the Town of Keenesburg, whose personnel have inspected the improvements and recommended approval of the request, and Whereas, staff from the Weld County Departments of Public Works and Planning Services have conducted a visual inspection and recommend release of said collateral. 2026-0717 PL2428 Cancellation and Full Release of Warranty Collateral for Use by Special Review Permit, USR14-0080 — Waste Management of Colorado, Inc. Page 2 Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the currently held warranty collateral, procured in the form of Performance Bond #82440823, drawn on the Federal Insurance Company, in the amount of $201,428.00, be, and hereby is, cancelled and released. Be it further resolved by the Board that the Clerk to the Board be, and hereby is, directed to return said collateral to the appropriate issuing party. No further collateral is required to be held since the two-year warranty period has been concluded.These improvements have been annexed by the Town of Keenesburg since the completion of the work, Keenesburg personnel has inspected the improvements and recommends approval of this request. Weld County Planning Services and Public Works Departments performed a site inspection, at the above-mentioned site, and observed the following: • All items on Exhibit C, of the Improvements Agreement According to Policy Regarding Collateral for Improvements Document CTB Record #2019-2620, have been completed and are found to be acceptable. The constructed improvements were reviewed for general conformance with the approved plans, applicable Town standards, project specifications, and local requirements. Based on this inspection, the improvements appear to be in acceptable condition and are approved as constructed. The roadway, associated drainage features, and related infrastructure appear to meet the criteria necessary to support safe and reliable public use. Based on the completed inspection and satisfactory condition of the improvements, the Town of Keenesburg has no objection to the release of the warranty collateral associated with this project.
