RE: APPROVAL OF SICK LEAVE BANK BY-LAW AMENDMENTS
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Sick Leave Bank Committee voted on September 16,
1981, to make certain changes in the by-laws described as follows :
CHANGES TO SICK LEAVE BANK BY-LAWS
1. Making the fifth member of the Board a permanent
member.
Making the permanent member the Payroll Supervisor.
Making the Payroll Supervisor the Board Treasurer,
and setting forth duties.
Amends Article III, Section 1 - 3, Adds Article
IV, Section 4, Adds Article V, Section 4.
2. Changing meetings to monthly instead of bi-monthly
Amends Article VI, Section 2 .
3. Setting forth the restriction of Sick Lease Bank
Members not being able to vote on their own
requests.
Adds Article VI , Section 5 (B) .
WHEREAS, said changes were presented to the Board of County
Commissioners of Weld County, Colorado, and
WHEREAS, after discussion, the Board of County Commissioners
has determined to approve the changes as above described and
exhibited in the attached, hereby incorporated herein.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the changes
and amendments to the Sick Leave Bank By-Laws as reflected
in the above are hereby incorporated by reference and approved.
The above and foregoing Resolution, was on motion duly made
and seconded, adopted by the following vote on the 7th day of
October, A.D. , 1981.

Amends Article III , Section I - 3, Adds Article IV, Section 4, Adds
Article V, Section 4.
Explanation: With Ruth Kelly retiring, we will not have anyone in
Payroll to keep track of the deductions, who has been granted time,
how much time is available to be granted, etc. It was mainly
coincidence that Ruth was elected to the original governing board.
We would like to make sure that there is always someone from Payroll
on the Board as Treasurer, who' s responsibility it is to keep track
of all deductions and time granted.
2. Changing meetings to monthly instead of bi-monthly.
Amends Article VI , Section 2.
Explanation: We needed to have meetings more often while in the
first year since more questions were being brought up. Now that
we have been using the Bank for a year, most of the initial problems
have been solved, and we are cancelling more meetings then we are
holding.
3. Setting forth the restriction of Sick Leave Bank Members not being
able to vote on their own requests.
Adds Article VI , Section 5(B) .
Explanation: This was overlooked when the By-Laws were established.
We do not feel that a Board member should be penalized by not being
able to use the Bank if the need arises. This clarifies the feeling
of the Board members that although we should not be penalized,'
neither should we be allowed to vote on our own requests.

BY-LAWS
ARTICLE I
NAME
The name of this Weld County Employee Advisory Board shall be the "Weld
County Sick Leave Bank Governing Board" .
ARTICLE II
PURPOSE
The Weld County Sick Leave Bank Governing Board, organized September 3,
1980, pursuant to the Weld County Personnel Policy, shall administer the
Weld County Employees ' Sick Leave Bank in accordance with these By-Laws and
policy and the policy of Weld County.
ARTICLE III
GOVERNING BOARD MEMBERSHIP
Section 1
The Board shall consist of four members elected by the participants in the
Bank. The Payroll Supervisor shall be the fifth Board member.
Section 2
Membership on the Governing Board shall be for a term of three (3) years,
except for the original Governing Board, whose terms are set forth as
follows:
Carol Harding 1 year
Ruth Kelly 2 years
Rita Kummer 2 years
Henry Estreich 3 years
Carrol Long 3 years
No person shall serve more than two (2) consecutive terms on the Governing
Board with the exception of the Payroll Supervisor.
Section 3
The Sick Leave Bank Treasurer shall conduct an election not later than
August 15th each year, for the Bank participants , to fill expired terms on
the Governing Board. Terms shall begin September 1st of each year.

Section 4
In the event of a vacancy or the failure of a member to attend three (3)
consecutive regular meetings of the Governing Board, without an excused
absence, the Governing Board shall make a request to the Personnel Depart-
ment to conduct an election to fill the vacancy.
Section 5
Each Governing Board member shall be entitled to one (1 ) vote.
Section 6
The Governing Board may appoint a Medical Advisor to serve the Board on a
volunteer basis.
ARTICLE IV
THE GOVERNING BOARD
Section 1
The Governing Board shall elect from its members a Chairperson, Vice-
Chairperson, and Secretary. The elected officers shall serve one (1 ) year
terms beginning in September. No officer shall serve more than two (2)
consecutive terms in the same position.
Section 2
All decisions made by the Governing Board shall be final ; there is no
appeal process for decisions made by the Governing Board.
Section 3
No member has a right to sick leave days based solely on their contribu-
tion. Days shall be granted by the Governing Board based on need, on a
case-by-case basis after considering all aspects of the request.
Section 4
The Payroll Supervisor shall be e Permanent member of the Governing Board
and shall be the Treasurer of the Board.
ARTICLE V -
DUTIES OF THE OFFICERS
Section 1
The Chairperson shall preside at all meetings of the Governing Board and
may call meetings when needed. Members will be given 24 hours notice of
special meetings.

Section 2
The Vice-Chairperson shall preside and perform the duties of the Chair-
person in the Chairperson's absence and shall perform all other duties that
may be assigned by the Chairperson.
Section 3
The Secretary shall be responsible for recording and preparing minutes of
any actions taken during Governing Board Meetings. During the absence of
the Secretary, the Chairperson may appoint another member to temporarily
fulfill the Secretary's function. The Secretary shall keep the records of
the Governing Board.
Section 4
The Treasurer shall be responsible for keeping an accurate count of Sick
Leave Bank members, hours accumulated in the Bank, hours granted by the
pard and taking the initial and annual cnntribution from Bank members.
The Treasurer shall prepare quarterly and annual reports and shall conduct
elections to fill any vacancy that may occur.
ARTICLE VI
MEETINGS
Section 1
The time and place of the Governing Board meetings shall be determined by
the Weld County Sick Leave Bank Governing Board.
Section 2
The Governing Board shall meet monthly unless there is no business to
transact. However, upon the receipt of a request to draw on the Sick Leave
Bank, the Governing Board shall meet and act upon the request within three
(3) working days of the filing of the request with the Personnel Depart-
ment.
Section 3
A quorum shall be deemed formed when there are present three (3) members of
the Governing Board.
Section 4
Any action or resolution adopted, amended, or repealed by the Governing
Board shall require concurrence of three (3) of the members of the Board in
office at the time.

Section 5
A. Any Sick Leave Bank participant shall be entitled to be present or
represented at the meeting during which his/her request is considered
by the Bank Governing Board.

Section 6
Regular meetings of the Governing Board shall be open to the public; how-
ever, requests for sick leave days from the Bank shall be considered ONLY
in Executive Session and all discussions therein shall remain confidential .
Release of information to unauthorized persons by any member of the Board
shall constitute immediate dismissal from the Board.
Section 7
Robert's Rules of Order, as revised, shall govern the conduct of the
Governing Board meetings, unless otherwise specified by the By-Laws .
ARTICLE VII
AMENDMENT OF BY-LAWS
Section 1
These By-Laws may be amended at any regular meeting of the Weld County Sick
Leave Bank Governing Board with subsequent approval of the Weld County
Board of Commissioners.
Section 2
Governing.Board members shall have at least twenty-five (25) days to review
any proposed amendments of these By-Laws. The Board, upon a unanimous
vote, may dispense with the 25 day review period.
ARTICLE VIII
REVIEW OF POLICY
The policy of the Sick Leave Bank shall be reviewed annually by the Go-
verning Board. A participant of the Bank may propose amendments to the
Board for consideration.
