I wish to advise you that I am the owner of all of Section Five (5) ,
Township Seven (7) North, Range Fifty-nine (59) West of the 6th Principal
Meridian, Weld County, Colorado.
Pursuant to the provisions of Title 35, Article 72 of Colorado Revised
Statutes 1973, I hereby advise you that soil is blowing upon my above-
described land from the land of DELBERT D. CASTOR, 13891 Highway 144,
Ft. Morgan, Colorado 80701 , which land is described as the East Half (EZ)
of Section Six (6), Township Seven (7), Range Fifty-nine (59) West of
the 6th Principal Meridian, Weld County, Colorado.
Friday, February 20, 1981 , I observed the soil from EZ-6-7-59 was blowing
onto my land in such quantities that it was burying my crested wheat
grass, and alfalfa, planted on my land. I orally reported this on
Friday, February 20, 1981 , to Mr. Olson in your office. Commissioner
Norman Carlson called my home that afternoon. However, I was not available
when he called.
This situation (soil blowing from: EZ-6-7-59 onto my land: 5-7-59)
has been a problem for several years; and, I have previously orally
reported the problem to you. Your investigation determined that it was
not a soil blowing situation.
I repeat my report of this damage; and, request that you investigate,
determine the action necessary, and proceed under the provisions of
Title 35, Article 72 of Colorado Revised Statutes 1973.
I have reported this in the past to Delbert D. Castor; and, he has
acknowledged the damage to me, and has promised in years past to so
manage his land as to not damage my land. However, he has never taken
the proper action needed to prevent damage to my land.
I appreciate that the soil may not be blowing at the time your investigator
is physically present at my land. However, it is a situation which
continues to occur; and, I request that you have the proper person from

damage that is being done.
