Re: Recognition of 1033 Exchange
Gentlemen:
On February 26, 2026, the Board of County Commissioners of Weld County ("Board") and
Hungenberg KHL Farms, LLLP ("Hungenberg") closed on the transfer of ownership of
property located adjacent to and north of Weld County Road ("WCR") 66. The property is
shown in the enclosed plat labeled "Exhibit A" ("the Property").
Purchase of the Property by the Board is necessary for its construction of improvements for
WCR 66 to enhance public safety. The Board has the authority to condemn property for
the purpose of constructing roadways, pursuant to C.R.S. §43-2-112. The transfer of the
Property by Hungenberg was done in-lieu of condemnation in exchange for payment of
the sum of$700,000 by the Board to Hungenberg.
The Board hereby recognizes the transfer as a "1033 Exchange"as described and allowed
under Section 1033 of the Internal Revenue Code. The deed for the Property is recorded at
Reception Number 5086276 in the Office of the Weld County Clerk and Recorder.

Dear Mr. Shovlin:
On February 26, 2026, the Board of County Commissioners of Weld County ("Board") and
High Plains Medical LLC ("High Plains") closed on the transfer of ownership of property
whose address is 914 1 1th Avenue, Greeley, CO 80631 ("the Property").
Purchase of the Property by the Board is necessary for its construction of a new judicial
center on Block 66 City of Greeley to house courts of the 19th Judicial District of the State of
Colorado. The Board has the authority to condemn property for the purpose of providing
courts, pursuant to C.R.S. §30-11-104(2). The transfer of the Property by High Plains was
done in-lieu of condemnation in exchange for payment of the sum of $835,000 by the
Board to High Plains.
The Board hereby recognizes the transfer as a "1033 Exchange"as described and allowed
under Section 1033 of the Internal Revenue Code. The deed for the Property is recorded at
Reception Number 5085898 in the Office of the Weld County Clerk and Recorder.
