RESOLUTION
RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 62 : 80 :10 FOR A HORSE
BOARDING FACILITY - RALPH CLARKSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of. Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public meeting on the 24th day of September,
1980 at the hour of 9 : 00 o'clock a.m. for the purpose of hearing
the application of Ralph Clarkson for a Conditional Use Permit
for a horse boarding facility on the following described real
estate, to-wit:
A' tract of land located in the South Half
of the Southwest Quarter of Section 14,
Township 6 North, Range 66 West of the 6th
P.M. , Weld County, Colorado and being more
particularly described as follows :
Beginning at, a point on the North Right of
Way line of Colorado Highway No. 39,2, from
which the Southwest Corner of said Section
10 , Township 6 North, Range 66 West of the
6th P.M. , bears South 00°16 ' 50" East, 35. 04
feet and South 89°43 '10" West along the
South line of said Southwest Quarter of
said Section 14-6-66, 1521. 53 feet; thence
North 00°45 ' 56" West, 598. 98 feet to a
point on the South Bank of the Greeley No.
2lCanal; thence traversing along said South
Bank of Greeley No. 2 Canal; South 68°16 ' 24"
East, 36 . 80 feet and South 75°02 '15" East,
189 . 78 feet and South 71°34 ' 23" East, 31. 00
feet to the centerline of said Irrigation
Ditch; thence South 00°45 ' 56" East, along
the centerline of said Irrigation Ditch,
525. 50 feet to a point on the North Right
of Way line of Colorado Highway No. 392;
thence South 89°46 '10" West along said North
Right of Way line of Colorado Highway No.
392, 245. 96 feet to the point of BEGINNING.
EXCEPT the Right of Way as contained in Deed
recorded April 3 , 1972 in Book 665, under
Reception No. 1586806 of the Weld County,
Colorado records, described as the South 65
feet of the within described land.
The above described parcel contains a gross
acreage of 3 .17 acres more or less.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the approval
of the Conditional Use Permit for a horse boarding facility, and

WHEREAS, Section 3 . 3.D. of the Weld County Zoning Resolution
authorizes such a use in an Agricultural District upon approval
of a Conditional Use Permit by the Board/ of County Commissioners,
and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those pre-
sent, haslstudied the request of the petitioner and the recom-
mendations of the Weld County Planning Commission and all of the
exhibits and evidence presented in this matter, and having been
fully infor med, is satisfied that the request for a Conditional
Use Permit for a horse boarding facility on the hereinabove

described real estate complies with all of the conditions as set

forth in Section 3. 3.D. (2) of the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-

missionerslof Weld County, Colorado that the application of

Ralph Clarkson for a Conditional Use Permit for a horse boarding
facility on the hereinabove described tract of land ,be, and
hereby is ,, granted subject to the following:
1. The Conditional Use Permit plat being amended
to show an additional ten feet of right-of-way

reservation along the North side of Colorado
Highway 392.
2. The Development Standards contained in the
Conditional Use Permit.
3. The Development Standards for the Conditional

Use Permit and the property owner' s signature
shall be placed on the Conditional Use Permit

plat and the plat shall be delivered to the
office of the Department of Planning Services.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado that the reasons for approval contained
in the Weld County Planning Commission recommendations dated
August 16, 1980 be, and hereby are, adopted as the findings
of fact of the Board of County Commissioners in this matter.

DEVELOPMENT STANDARDS
1. The permitted uses on the hereon described parcel shall be a horse boarding
facility and 11 other uses permitted by right in the Agricultural District
of the Weld County Zoning Resolution. Major facilities shall be limited
to those shown hereon. The maximum number of horses boarded shall not exceed ten
(10) at any one time.
2. The Conditional Use Permit area shall be maintained in such a manner so as to
prevent soil erosion, fugitive dust, and the growth of noxious weeds.
3. All phases of the operation shall comply with all County and State Health Stan-
dards and Regulations pertaining to air quality, water quality, noise emission,
and sanitary disposal systems.
4. All accesses shall have the approval of the Colorado Division of Highways.
All accesses shall be constructed in accordance with the recommendations
and/or requirements of the Colorado Division of Highways.
5. The Conditional Use Permit shall be limited to the plans shown hereon and
governed by the Development Standards stated above and all applicable Weld
County Regulations. Any material deviations from the plans and/or Develop-
ment Standards as shown or stated above shall require the approval of an
amendment to the Condtional Use Permit by the Planning Commission and the
Board of County Commissioners before such changes from the plans and/or
Development Standards shall be permitted. Any other changes from the plans
and/or Development Standards shall be filed in the office of the Department
of Planning Services
6. The property owner and/or operator of this operation shall be responsible for
complying with all of the above stated Development Standards. Noncompliance
with any of the above stated Development Standards may be reason for revocation

There is a seperate shed and corral for stallion.
There are 4 large corrals for exercise and holding animals.
North Weld Water is piped to the barn and corrals.
Manure is compgsted and spread on approximately 2 acres of pasture on west side of

Projected traffic volumes on S.H. 392 indicate the need for a total

as local zoning laws and regulations permit:

amount of such indebtedness, and all moneys advanced by the beneficiary or legal holder of the indebted-
ness for insurance,repairs,taxes and assessments,and for any other purpose elsewhere herein authorized,
with interest thereon at the rate provided for in the principal indebtedness, and next reimburse the Vet-
erans Administration for the sum, if any paid by it on account of the guaranty or insurance of the indebt-
edness secured hereby, rendering the overplus, if any, unto grantor. The sale or sales and said deed or
deeds so made shall be a perpetual bar, both in law and equity, against the grantor and all other persons
claiming the premises aforesaid, or any part thereof by, from, through or under the grantor. The legal
holder of the indebtedness may purchase said property or any part thereof;and it shall not be obligatory
upon the purchaser or purchasers at any such sale to see to the application of the purchase money. If
a release deed is required, the grantor hereby agrees to pay all the expenses thereof.
Grantor covenants and agrees to and with the trustee, that at the time of the ensealing and delivery -
of these'presents he is vfell seized of the said premises in fee simple, or such other estate, if any, as is
stated herein, and has good right, full power and lawful authority to grant, bargain, sell and convey the
same in manner and form aforesaid; hereby fully and absolutely waiving and releasing all rights and
claims he may have in or to said premises as a homestead exemption, under and by virtue of any act of
the General Assembly of the State of Colorado now existing or which'may hereafter be passed in rela-
tion thereto; that the same are free and clear of all liens and encumbrances whatever, except as herein
recited; and for the quiet and peaceable possession of the trustee, against all and every person or persons
lawfully claiming or to claim the whole or any part thereof, the grantor shall and will Warrant and For-
ever Defend. -
Grantor hereby further covenants and agrees:
1. He will promptly; pay the principal of and interest on the indebtedness evidenced by said note, at
the times and in the manner therein provided. Privilege is reserved to prepay at any time, without
premium or fee, the entire indebtedness or any part thereof not less than the amount of one installment,
or one hundred dollars ($100.00), whichever is less.
2. Together with and in addition to the monthly payments of principal and interest payable under
the terms of the note secured hereby,he will pay to the beneficiary, as trustee, (under the terms of this
trust as hereinafter staffed) on the first day of each month until said note is fully paid': '
(a) A sum equal to the ground rents, if any,next due, plus the premiums that will next become due
and payable on policies of fire and other hazard insurance on the premises covered hereby,
plus taxes and assessments next due on these premises (all as estimated by the beneficiary,
and of which grantor is notified), less all sums already paid therefor, divided by the number
of months to elapse before one month prior to the date when such ground rents, premiums,
taxes, and assessments will become delinquent,such sums to be held by the beneficiary in-trust
to pay said ground rents, premiums,taxes,and assessments.
(b) The aggregate of the amounts payable pursuant to subparagraph (a) and those payable on the
note secured hereby, shall be paid in a single payment each month,to be applied to the follow-
ing items in the order stated:

3. If the total of the payments made by the grantor under (a) paragraph 2 preceding shall ascot t
amount of.payments actually made by the beneficiary, as trustee, for taxes or assessments or insurarot -
premiums,as the case may be,such excess shall be credited on subsequent payments to be made by the gra^ rr
for such items or, at beneficiary's option, as trustee, shall be refunded to the grantor. - If, however, such
monthly payments shall not be sufficient to pay such items when the same shall become due and payable
then the grantor shall pay to the beneficiary, as trustee, any amount necessary to makeup the deficient,,
within thirty (30) days after written notice from the beneficiary stating the amount of the deficercy,
which notice may be given by mail. If at any time the grantor shall tender to the beneficiary, in act 4. •
ance with the provisions of the note secured hereby, full payment of the entire indebtedness represented
thereby, the beneficiary, as trustee, shall, in computing the amount of such indebtedness, credit to the
account of the grantor any balance remaining to credit of grantor under the provisions of (a) of paragraph
2 hereof. If there shall be a default under any of the provisions of this Deed of Trust resulting in a public
sale by the trustee or,trustees of the premises covered hereby, or if the beneficiary acquires the property
otherwise after default, the beneficiary shall, as trustee, apply, at the time of the commencement of such
proceedings, or at the time the property is otherwise acquired, the amount then remaining to credit of
grantor under (a) of paragraph 2 preceding, as a credit'on the interest accrued and unpaid and the .
balance to the principal then remaining unpaid on said note.
4. He will pay all ground rents,taxes, assessments,water rates, and other governmental or municipal
charges, fines, or impositions, levied upon said premises except when payment for all such items has there-
tofore been made under (a) of paragraph 2 hereof,and he will promptly deliver the official receipts there- _
for to the beneficiary. - _•
5. He will continuously maintain hazard insurance, of such type or types and amounts as beneficiary
may from time to time require, on the improvements now or hereafter on said premises,and except when
payment for all such premiums has theretofore been made under (a) of paragraph 2 hereof, he will pay
promptly when due any premiums therefor. All insurance shall be carried in companies approved by the
beneficiary and the policies and renewals thereof shall be held by the beneficiary and have attached thereto _
loss payable clauses in favor of and in form acceptable to the beneficiary. In event of loss the grantor will
give immediate notice',by mail to the beneficiary, who may make proof of loss if not made promptly by the "
grantor. Each insurance company concerned is hereby authorized and directed to make payment for such
loss directly to the beneficiary instead of to the grantor and the beneficiary jointly. The insurance pro- .
ceeds, or any part thereof, may be applied by the beneficiary at its option either to the reduction of the
indebtedness hereby secured or to the restoration or repair of the property damaged. In event of fore-
closure of this Deed of Trust, or other transfer of title to the said premises in extinguishment of the indebt-
edness secured hereby', all right, title, and interest of the grantor in and to any insurance policies then in
force shall pass"to the purchaser or grantee..
6. He shall not commit or permit waste;and shall maintain the property in as good condition as at
present, reasonable wear and tear excepted. Upon any failure so to maintain, beneficiary, at its option,
may cause reasonable maintenance work to be performed at the cost of grantor.
7. Beneficiary may perform any defaulted covenant or agreement of grantor to such extent as bene-
ficiary shall determine, and any moneys advanced by beneficiary for such purposes shall bear interest at
the rate provided for;in the principal indebtedness shall thereupon become a part of the indebtedness
secured by this instrument, ratably and on a parity with all other indebtedness secured hereby, and shall
be payable thirty (30) days after demand.
8. Upon the request of the beneficiary, the grantor shall execute and deliver a supplemental note or
notes for the sum or sums advanced by the beneficiary for the alteration, modernization or improvement
made at the grantor's request; or for maintenance of said premises or taxes or assessments against the
same and for any other purpose elsewhere authorized hereunder. Said note or notes shall be secured
hereby on a parity with and as fully as if the advance evidenced thereby were included in the note first
described above. Said supplemental note or notes shall bear interest at the rate provided for in the prin-
cipal indebtedness and shall be payable in approximately equal monthly payments for such period as may
be agreed upon by the creditor and debtor. Failing to agree on the maturity, the whole of the sum or
sums so advanced shall be due and payable thirty (30) days after demand by the creditor. In no event
shall the maturity extend beyond the ultimate maturity of the note first described above. Notwithstand-
ing the foregoing provisions for the making and securing of advances, the Public Trustee may, upon the
production of the original note secured hereby, duly cancelled,fully release this Deed of Trust for all pur-
poses without inquiry as to additional advances made hereunder,if any,and without liability for so doing.
9. In the event of default in the payment of the indebtedness or any part thereof, or of a breach or
violation of any of the covenants or agreements herein,then,and in that event,the whole of the indebted-
ness and the interest thereon to the time of sale, may at once, at the option of the beneficiary or the legal
holder of the indebtedness, be declared due and payable, and the said premises be sold in the manner and
with the same effect as if the indebtedness had matured. If foreclosure is made by the Trustee, an attor-
ney's fee for such reasonable amount as may be approved by the Public Trustee for services in the
supervision of such foreclosure proceedings shall be allowed and added by the Public Trustee as a part
of the cost of foreclosure. If foreclosure be by action in court, a reasonable attorney's fee shall be taxed
by the court as a part of the cost of such foreclosure proceedings. All attorney's fees shall be and become'+',
a part of the indebtedness secured hereby ratably and on a parity With other indebtedness secured hereby. pp

10: The lien of this instrument shall remain in full force and effect during any postponement or
extension of the time of payment of the indebtedness or any part thereof secured hereby.
11. In case of default, whereby the right of foreclosure occurs hereunder, the beneficiary, or the
holder of the indebtedness or certificate of sale, shall at once become entitled to the possession, use and
enjoyment of the property aforesaid, and to the rents, issues and profits thereof, from the accruing of
such right and during the pendency of foreclosure proceedings and the period of redemption,if any there
be. Such possession,use,enjoyment, rents,issues and profits shall at once be delivered to the beneficiary
or the holder of the indebtedness or certificate of sale on request. On refusal, the delivery of such posses-
sion may be enforced by the party entitled thereto by any appropriate civil suit or proceedings, and such
party shall be entitled to a Receiver for said property, and of the rents, issues and profits thereof, after
any such default, including the time covered by foreclosure proceedings and the period of redemption, if
any there be. Such entitlement shall exist as a matter of right without regard to the solvency or insol-
vency of the grantor or' of the then owner of said property and without regard to the value of the property.
Such Receiver may be appointed by any court of competent jurisdiction upon ex parte application, notice
thereof being hereby expressly waived, and the appointment of any such Receiver,on any such application
with or without notice,'is hereby consented to. All rents, issues and profits, income and revenue of said
property shall be applied by such Receiver according to law and the orders and directions of the court.
• • 12. Grantor waives notice of the exercise of any option granted herein,or in the note secured hereby.
If the indebtedness secured hereby be guaranteed or insured under Title 38, United States Code, such
Title and Regulations issued thereunder and in effect on the date hereof shall govern the rights, duties
and liabilities of the parties hereto, and any provisions of this or other instruments executed in connection
with said indebtedness which are inconsistent with said Title or Regulations are hereby amended to
conform thereto. -
The covenants herein contained shall bind, and the benefits and advantages shall inure to,the respec-
tive heirs, executors, administrators, successors and assigns of the parties hereto. Whenever used, the
singular number shall include the plural, the plural the singular, and the use of any gender shall be
applicable to all genders, and the term "beneficiary" shall include any payee of the indebtedness hereby
secured or any transferee thereof whether by operation of law or otherwise.

Horse Boarding Facility
To Whom It May Concern:
I have two objections to Mr Clarkson starting a horse boarding
facility.
My main objection to the above mentioned stable is that if other
people"s horses are boarded there, that usually means that they wiLl
have to be out there to ride the horses, not only on the rode but also
in Mr. Clarksons pasture. Most people would be riding after a normal
work day and also, on weekends. This is the only times that I am home,
and since Mr Clarkson's pasture is adjacent to my driveway, I feel that
I will be deprived of all my privacy. I moved to the country for some
privacy, not to have people riding horses approxiamately 75 feet from
my front yard. •
My second objection is that when the corrals are cleaned out, I
think it should be disposed of in a more proper manner than put in
heaping mounds in the middle of the pasture.

The potential native vegetation on this soil is dominated by blue grama. •

Several nidgrasses such as western wheatgrass andpneedle and thread are
also present. Potential production ranges from 1600 pounds per acre in
favorabl years to 1000 pounds per acre in unfavorable years. When range
condition deteriorates, the midgrasses decrease, blue grama, buffalograss ,
"I;:':•: snakeweed, yucca and fringed sage increase and production drops. Undesir-

'cliiikfi able weeds and annuals invade the site as range condition becomes poorer.
Management of vegetation on this soil should be based on taking half
and leaving half of the total annual production. Seeding is advisable if
range is in poor condition. Sideoats grama, little bluestem, western
wheatgrass , blue grama, pubescent wheatgrass and crested wheatgrass are
suitable for seeding. The grass selected should meet the seasonal
• requirements of livestock. For successful seeding,, a clean, firm, sorg- ,
hum stubble -- prepared the growing season prior to seeding -- or a
firm, prepared seedbed and grass drill should be used. Early spring
seeding h, s proven most successful. •
Windbreaks and environmental plantings are generally well suited on
this soil. Generally all trees and shrubs adapted to this area will
- grow. • Codtinued cultivation to control competing vegetation should be

practiced for as many years as possible following planting. Trees that

are best uited and have good survival are Rocky Mt. juniper, eastern
redcedar,rponderesa pine , Siberian elm, Russian olive and hackberry.
Shrubs best suited are skunkbush sumac , i lac , Siberian pcashrub and

American klum.
Wildlife i.s an important secondary use, with these soils best suited
for openland and rangeland wildlife. In cropland areas , habitat favorable
for ring-necked pheasants , mourning doves , and many non-game species
can be developed by establishing wildlife areas for nesting and escape
cover. For pheasants , the inclusion of undisturbed nesting cover is

vital andshould be included in plans for habitat development : this is
aespecially true in areas of intensive agriculture. Rangeland wildlife ,
',Z1.1� exemplified by the pronghorn antelope, can be assisted and encouraged

by development of livestock watering facilities , proper livestock

grazing management, and range reseeding where needed.

This Kim soil has a good potential for urban and recreational develop-
ment. Increased population growth in the area (county) has resulted

. in increased home site construction. The primary limiting soil feature
for urban: development and road construction is the soils limited ability
to support a load. Septic tank absorption fields will function properly,
however , (community sewage systems should be provided if the population
density i5 increased. The permeability of the substratum may require
sewage laLoons to be sealed. Lawns , shrubs and trees for beautification
will do well. •

This haza&d. can be overcome by cultivating only in the tree row and by
leaving a strip of vegetation between the rows . Supplemental irrigation
may be ne.:essary at the time of planting and during dry periods . Trees
that are best suited and have good survival arc Rocky 1.1t. juniper, eastern
redcedar,Iponderosa pine, Siberian elm, Russian olive and hackberry .
Shrubs bet•t suited are skunkbush sumac , lilac and Siberian peashrub.
Wildlife is an important secondary use , with these soils best suited for
openland and rangeland wildlife . In cropland areas , habitat favorable
for ring-necked pheasants , mourning doves , and many non-game species
can be developed by establishing wildlife areas for nesting and escape

cover. For pheasant , the inclusion of undisturbed' nesting cover is
vital andjshould be included in plans for habitat development: this is
especially', true in area of intensive agriculture. Rangeland wildlife ,
exemplifield by the pronghorn antelope , can be assisted and encouraged by
development of livestock watering facilities , proper livestock grazing
managements, and r.•ange reseeding where needed.
• Rapid expansion of the Greeley and surrounding area has resulted in
urbanization .of much of this Olney soil. It has a good potential for
urban and recreational development . Its only limiting feature is the
moderately rapid permeability in the substratum and the hazard of con-
tamination of ground water from sewage lagoons. Lawns , shrubs and trees
for beauti:ication will do well.

The following information is in answer to your request for soil information
for a portion of lithe SZSW' of Section 14, Twp. 6N, Range 66W, Weld County,
for a horse boarding stable.
There are two soil types found in the area. They are Kim loam, 1 to 3
percent slope (X53-B), and Olney fine sandy loam, 1 to 3 percent slope
(55-B).
Both soil types are suited to the proposed land use. However, both soils
are susceptible to wind erosion when the soil surface is exposed. Maintain-
ing an adequate surface soil protection is necessary tt retard wind erosion.
Grazing should bel limited so that good vegetative cover can be maintained on
as much of the area as possible.
I have enclosed copies of soil descriptions and a copy of the soil map to
provide you with more information.
