The proposal has been reviewed by Development Review on behalf of the Weld County Department of
Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the
application process may not be all-inclusive, as other issues may arise during the remaining application
process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: AMENDMENT TO THE PEAKS @ MTN VIEW PUD (S-511) TO EXPAND THE
BUILDING ENVELOPE ON LOT 3.
This project is north of County Road (CR) 12 and is east of County Road 13.
Parcel numbers: 146705405003.
Access is from Fir Avenue
ACCESS
Development Review has reviewed the application materials related to access. The PUD currently has an
existing access onto Fir Avenue, approximately 2,330 feet west of CR 5.
No new accesses are proposed with this amendment.
ROADS AND RIGHTS-OF-WAY
Fir Avenue is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2024-01) as a local road, which requires 60 feet of right-of-way. Pursuant to the definition of
setback in the Weld County Code, Section 23-1- 90, the required setback is measured from the right-of-
way line. Be aware that the road may not be centered in the right-of-way. This road is maintained by Weld
County.
TRAFFIC
No traffic data is available for this portion of Fir Avenue.
DRAINAGE REQUIREMENTS
There are no drainage requirements with this amendment.
CONDITIONS OF APPROVAL
The plat shall be amended to delineate the following:
1. Fir Avenue is a paved road and is designated on the Weld County Functional Classification Map as a
local road which requires 60 feet of right-of-way. Delineate and label the existing right-of-way (along
with its creating document), the existing access, and the physical location of the road. All setbacks
shall be measured from the edge of right-of-way. This road is maintained by Weld County.

DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off-site tracking. (Development Review)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. The historical flow patterns and runoff amounts will be maintained on the site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to runoff rate and velocity increases, diversions, concentration and/or unplanned
ponding of stormwater runoff. (Development Review)

Dear Mr. VanEyll,
This referral for Lot 3 of the Peaks At Mountain View, case no. PUDF25-0001, on 5.3
acres in Sec. 5, T1 N, R68W, 6th P.M., does not appear to qualify as a "subdivision"
as defined in section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State
Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning
directors, this office only performed a cursory review of the referral information.
Upon review, it appears that the proposed water supply source for the property is
service provided by the LLeft Hand Water District. There are no permitted wells on
the subject property. Therefore our office has no comments on this referral.
