A public hearing was conducted on March 18, 2026, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a Notice dated February 10, 2026, and duly published
February 13, 2026, in the Greeley Tribune, a public hearing was conducted to consider
the request of Scott and Marianne Purcell, for Use by Special Review Permit,
USR25-0022, for a Kennel (boarding up to 60 dogs) outside of subdivisions and historic
townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney,
made this a matter of record.
Angela Snyder, Department of Planning Services, presented a brief summary of the
proposal, stated the kennel had been operating since 2016, and relayed the current
owners bought the home and business in 2025, unaware the kennel was unpermitted.
She noted the facility is licensed through the Colorado Department of Agriculture, Pet
Animal Care and Facilities Act (PACFA) program. She provided details of operation,
including the site acreage, hours of operation, number of employees, and how waste is
handled. She reviewed the water and sewer provisions, which include the use of an
On-site Wastewater Treatment System (OWTS) for wastewater and a domestic well,
which is required to be repermitted for commercial use by the Colorado Division of Water
Resources. She also mentioned the Building Permit for the main structure will need to be
changed from personal use to a commercial kennel. Ms. Snyder stated Notice was sent
to seven (7) surrounding property owners (SPOs), and one (1) was received prior to the

Planning Commission, but stated no specific concerns. She entered the favorable
recommendation of the Planning Commission into the record, as written, and displayed
images of the site and surrounding views.
Mike McRoberts, Department of Planning Services, Development Review, stated access
is off of County Road 59. He provided the traffic counts in the area, the anticipated traffic
associated with the site, relayed the applicant submitted a Drainage Narrative for an
exception to stormwater detention, and noted a Road Maintenance Agreement is
required.
Scott and Marianne Purcell, applicants, in response to Chair James, indicated they had
not had contact with any of the Commissioners regarding this case and had nothing
additional to add. In response to Commissioner Maxey, they reiterated they bought the
home and business in 2025, they are trying to rectify the situation of the kennel not being
permitted, and they were waiting for approval from the Board before working through the
well permit conversion with the Division of Water Resources.
No public testimony was offered concerning this matter.
The Board discussed the Conditions of Approval and Development Standards (DS), and
Commissioner Maxey requested they remove "chemical and scientific" from DS #8
(suitable controls shall be provided for rodent and insect control). The Board agreed to
the change.
In response to Chair James, Mr. and Mrs. Purcell indicated they had reviewed, and
agreed to abide by, the Conditions of Approval and Development Standards, as
amended.
No public testimony was offered regarding the change made to DS #8.
Commissioner Buck moved to approve the request of Scott and Marianne Purcell for Use
by Special Review Permit, USR25-0022, for a Kennel (boarding up to 60 dogs) outside
of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards, as amended. The motion was seconded by
Commissioner Maxey, it carried unanimously, and the hearing was adjourned. (Clerk's

The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 1st day of April, A.D., 2026:
