HomeMy WebLinkAbout20260512 Record of Proceedings Minutes Board of County Commissioners Weld County, Colorado Wednesday, March 11, 2026 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado 80631, on March 11 , 2026, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Jason S. Maxey, Pro-Tem Commissioner Perry L. Buck Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Buck seconded the motion and it carried unanimously. 1 . Minutes from February 25, 2026 Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner Peppler seconded the motion and it carried unanimously. Warrants: 1 . General Warrants: Commissioner Peppler moved to approve the General Warrants, as printed. Consider Contract ID #10431 Notice of Funding Allocation (NFA) Work Plan for Wagner Peyser Foreign Labor Certification (FLC) Grant Program, and Authorize Chair, Department of Human Services, and Workforce Development Board to Sign: Jamie Ulrich, Director of the Department of Human Services, stated the notice of funding allocation (NFA) updates the work plan to extend dates, and allows for the processing and oversight of the foreign labor applications to ensure employers in the agricultural industry meet federal requirements when hiring foreign workers. Commissioner Ross moved to approve said NFA work plan and authorize the Chair, the Department of Human Services, and the Workforce Development Board to sign. The motion was seconded by Commissioner Buck and it carried unanimously. 2. Consider Contract ID #10442 Grant Application for 2026 `Choose When' Program Funding to Reduce Financial Barriers to Long-Acting Reversible Contraceptives and Authorize Department of Public Health and Environment to Submit — Caring for Colorado Foundation: Jason Chessher, Director of the Department of Public Health and Environment, stated said application is for one- time grant funding up to $50,000.00 from the Caring for Colorado Foundation, and staff recommends approval. Commissioner Maxey moved to approve said application and authorize the Department of Public Health and Environment to submit. The motion was seconded by Commissioner Peppier and it carried unanimously. 3. Consider Contract ID #10419 Rental Agreement for Use of One (1) 40-Ton 2026 Caterpillar 740 Articulated Haul Truck and Authorize Chair to Sign — Wagner Equipment Company: Nate Gibson, Department of Public Works, stated the rental agreement allows for the County to use the stated vehicle for stockpile pit runs for surface gravel processing and reclamation of various mining pits. He confirmed the lowest quote received was from Wagner Equipment Company, for $14,119.28, per month, which is budgeted for the remainder of 2026, and staff recommends approval. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. 4. Consider Rescheduled Temporary Closure of County Road 14 Between County Roads 31 and 37: Amy Mutchie, Department of Public Works, stated the City of Fort Lupton requested changes to the design for the installation of a 20-inch water main, which delayed their contractor, EZ Excavation, from proceeding as originally planned. Therefore, she is now requesting to reschedule said closure to begin March 17, 2026, and go through April 3, 2026, from the original dates of March 2, 2026, through March 16, 2026, approved on February 25, 2026. Commissioner Buck moved to approve said rescheduled temporary closure. Consider Contract ID #10434 Professional Services Agreement for Local Multimodal Transportation and Mitigation Options Fund (MMOF) for On-Demand Transit of Aging Adults and Individuals with Disabilities within Upper Front Range Transportation Planning Region (UFRTPR) and North Front Range Metropolitan Planning Organization (NFRMPO) Boundaries, and Authorize Chair to Sign — Via Mobility: Evan Pinkham, Department of Public Works, stated the agreement allows for continued on-demand para-transit of older adult and individuals with disabilities who reside within the identified regional transportation boundaries in Weld County through December 31 , 2026, and staff recommends approval. Commissioner Ross thanked Mr. Pinkham for bringing the agreement to the Board, commented the program provides a great service that is highly utilized throughout Northern Colorado, and acknowledged concerns with the state cutting MMOF funding in the future at the detriment of the elderly and disabled individuals. Commissioner Ross moved to approve said agreement, which was seconded by Commissioner Maxey. Chair James echoed Commissioner Ross' frustrations and encouraged the Colorado Department of Transportation (CDOT) to remember their role is to provide safe transportation for all citizens. There being no further discussion, the motion carried unanimously. 6. Consider Contract ID #10447 License Agreement for Private Lateral Ditch Crossing for High Plains Boulevard (aka County Road 9.5) Improvements Project, Between County Roads 32 and 34, and Authorize Chair to Sign — Mark and Linda Getman, and Allan Carlson: Cameron Parrott, Department of Public Works, stated the ditch is co-owned by Allan Carlson and Mark and Linda Getman for irrigation purposes, and as part of the High Plains Boulevard project, between County Roads 32 and 34, he explained the ditch crosses into the Getman property, which the County has already acquired right-of-way for construction purposes. Mr. Parrott indicated in order to proceed with the project, Mr. Carlson and Mr. Getman agreed to allow the County access to cross the ditch, for an amount of $15,000.00, which is accounted for in the 2026 budget. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. New Business — Ordinances: 1 . Final Reading of Code Ordinance #2026-03, In the Matter of Repealing and Reenacting, with Amendments, Chapter 2 Administration of the Weld County Code (Article XVI — Emergency Management): Commissioner Maxey moved to read Code Ordinance #2026-03 by title only. The motion was seconded by Commissioner Peppler and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Roy Rudisill, Director of the Office of Emergency Management, provided an overview of an additional proposed change to remove Section 2-16-120 for the Adoption of Colorado Wildfire Resiliency Code, as it will be added to Chapter 7 within the Weld County Code, pursuant to the recent introduction of Code Ordinance #2026-04, on March 2, 2026. There being no public testimony concerning the matter, Commissioner Maxey moved to approve Code Ordinance #2026-03 on Final Reading, as amended. The motion was seconded by Commissioner Ross and it carried unanimously. New Business — Planning: 1 . Consider Partial Vacation, VAC26-0001, of Use by Special Review Permit, USR-1654— Front Range Feedlots, LLC: Lindsey Oliver, Department of Planning Services, displayed an aerial map for visual clarity and stated on January 26, 2026, staff received the request from the applicant to partially vacate Use by Special Review Permit, USR-1654, which was recorded on September 25, 2008, for beet storage. She clarified that the partial vacation is being processed in conjunction with Family Farm Division, FFD25-0093, to be able to separate the existing residence from the beet storage operations. Ms. Oliver noted that the final plat for FFD25-0093 must be recorded prior to the final approval of the partial vacation, and staff recommends conditional approval. Hannah Dutrow, AGPROfessionals, introduced herself as representing Front Range Feedlots, LLC, and displayed images while reiterating the purpose of the request. In response to Commissioner Ross, Ms. Dutrow presumed the house is currently occupied but noted she has not been to the site to confirm, and explained it has not been used in conjunction with the beet storage. Ms. Oliver confirmed the lot size will remain at 71 acres. Commissioner Maxey moved to approve said partial vacation. The motion was seconded by Commissioner Buck, which carried four (4) to one (1) with Commissioner Ross being a dissenting vote. Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
