As part of this effort I prepared a Deed from you and Janina Chart to Weld County deeding the East 30 feet of your property to the County for use as part of Road 29 . Mr. Gil Olson, of the Weld County Engineering Department, informs me that your wife, Janina Chart, passed away in approximately September of 1979 and therefore, the Deed which I prepared was signed only by you. My research of your property indicates that the property was held in common with your wife and therefore, her one-half inter- est in the property passed to her estate. The Probate Division of the Weld County District Court, has informed me that your wife' s estate has not been probated in Weld County. If in fact, your property in Weld County was held in common with your wife and her estate has not been probated, you would be unable to transfer the interest in this land which is now part of her estate. As you can see, this matter is rather complicated and I think it deserves your further attention. If you would like to discuss this matter with me, so that any title questions which you have can be cleared up and Weld County may acquire the right-of-way for Road 29, please contact me at the above number, Ext. 385.
