The MINUTES of the 1st instant, were read, and there being no corrections or
objections thereto, same were ordered approved as read.
IN THE MATTER OF RESOLUTION RE:
TRANSFER OF TITLE ON TRUCKS:
WHEREAS, ce rtain county trunks have been traded to various Weld County dealers
as a credit on the purchase of certain new equipment.
On motion duly made, seconded and on vote, unanimously carried it was,
RESOLVED, that the Board of County Connissioners of Weld County, Oolorado,
transfer title covering Chevrolet truck,Motor Number T5947954, to the McCrory Motor Company;
and title covering Chevrolet truck,Motor number T6657061, to Vlidmaier Chevrolet Company; and
title covering Ford truck-tractor,Motor number BB-18-3673889, to Farr Implement Company.

TO VACATE AND ABANDON CO RD:
Commissioner SANDEN offered the following resolution and moved its adoption:
WHEREAS, a petition, signed by two-thirds or more df the free holders adjoining
the County road between Sections 4, in Township 7 North, Range 64 West and Section 33, in
Township 8 North, Range 64 West, requesting that the :.aid road be vacated and closed has
been presented to the Board of County Commissioners of Weld County, 0olorado, and,
WHEREAS, it appears that the necessities of the public no longer require a county
road, as above described.
NOW, THEREFORE, BE IT RESOLVED and it is hereby ordered that that portion of the
county ro_ld numbered 703-L lying East of State Highway No. 14 and between Section 4, Town-
ship 7 North, Range 64 West and Section 33, Township 8 North, Range 64 West, be and hereby
is vacated, abandoned and closed.

VACATE AND ABANDON CO ROAD:
Commissioner SANDEN offered the following resolution and moved its adoption:
WHEREAS, a petition, signed by two-thirds or more of the freeholders adjoining
the County road between Sections 29 and 32 in Township 8 North, Range 64 West requesting
that the said road be vacated and closed, has been presented to the Board of County Comm-
issioners of Weld County, Colorado, and,
WHEREAS, it appears that the necessities of the public no longer require a county
road, as above described.
NOW, THEREFORE, BE IT RESOLVED and it is hereby ordered that that portion of the
County Road numbered 703-K, lying between Sections 29 and 32, in Township 8 North, Range 64
West be and hereby is vacated, abandoned and closed.

AUTHORIZING COUNTY TREASURER
TO REDEEM TAX SALE CERTIFICATE
NO. 1356/1930 TOR FEES ONLY:
Commissioner FORD offered hhe following resolution and moved its adoption:
WHEREAS, the County Assessor has recommended that the tax sale certificate listed
herein should be redeemed for fees only account of erroneous assessment, and,
WHEREAS, it appears that said tax sale certificate has been erroneously issued, and
WHEREAS, the County Treasurer has recommended that this tax sale certificate be
redeemed for fees only,
NOW, THEREFORE, BE IT RESOLVED that the County Treasurer be and hereby is authorized
to redeem for fees only Tax Sale Certificate No. 1356 of the 1330 Tax Sale for the 1929-1930-
1931-1932-1933 and 1934 taxes against mineral rights only on S"4; Sec. 19, Twp 11,
Range 60 W.

PROJECT APPLICATION OP NO. 165-1-84-133: State
Application No. 50162; Joint Sponsorship with
Towns of Frederick, Firestone and Dacono:
WHEREAS, on October 1,1940, Wi&d County entered into an agreement with the Town of
Frederick, the Town of Firestone and the Town of Dacono for joint sponsorship of a W. P. A.
project proposal for the improvement of certain streets and roads, as described in the agree-
ment, and,
WHEREAS, .'Federal Works Agency, Work Projects Administration, has submitted a
" Sponsors Request and Certification" to be signed on behalf of Weld County, Colorado, as a
joint sponsor.
NOW, THEREFORE, BE IT RESOLVED that Fred 0. Ford, County Commissioner of District
No. Two, Weld County, Colorado, be and hereby is authorized to sign on behalf of Weld County,
Colorado, the Sponsor's Request & Certification hereto attached and made a part of this reso-
lution; being numbered OP-165-1-84-133, State Application 50162: "Improve streets and drainage
facilities in and near the towns of Frederick, Dacono and Firestone, in Weld County, including
excavating; grading; surfacting; building sidewalks; cutting drainage ditches, laying culvertx
pipe and performing incidental and appurtenant work".
The resolution was, on motion duly made, seconded and, on vote, unanimously adopted
and so ordered:

Commissioner FORD offered the following resolution and moved its adoption:
WHEREAS, the personal taxes assessed against the personal property of Geo. S.
Conklin School District No. 118, for the year of 1933, have been delinquent six or more
years, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, has been
informed that the taxes assessed against said Geo. S. Conklin for the year of 1933 are
uncollectible, and
WHEREAS, the Board of County Commissioners of ,'Weld County, Colorado, finds said
taxes uncollectible:
NOW, THEREFORE, BE IT RESOLVED, that the taxes assessed against the personal property
of said Geo. S. Conklin for the year of 1933 in the amount of $ 11.88 and interest be and
the same are hereby cancelled.

WHEREAS, G. E. Mc Evers, of Weld County, Colorado, has presented to the Board of
County Commissioners of Weld County, Colorado his application for a County Retail license for
sale of 3.2 beer only and the said applicant having paid to the county Treasurer the sum of
Fifty Dollars ($50,00) therefor, and having produced a state retail license for sale of 3.2%
beer only, outside the coroprate limits of any town or city in the County of Weld, at the
location described as follows:
Mick's Inn, Prospect Valley-Keenesburg
And the County Commissioners, having examined the said application and the other
qualifications of the applicant do hereby grant a license to said applicant to sell 3.2% beer
only at retail, at said place, and do hereby authorize and direct the issuance of said license
by the Chairman of the Board, attested by the County Clerk and Recorder of Weld County,Colorado,
good for one year from date of issuance unless revoked, according to law, provided, however,
that said license shall be issued upon the express condition and agreement that the place where
licensee is authorized to sell beer under said license will be conducted in strict conformity to
all laws of the State of Colorado and rules and regulations relating thereto heretofore passed
by the Board of County Commissioners of vWeld County, Colorado and any violation thereof shall
be cause for revocation of the license.

W EREAS, an order, signed by both Judges of the District Court, to increase
to $125.00 per month, the salary of Martha R. Greigg, was on or about October 25, 1939,
presented to the Board of County Commissioners of Weld County, Colorado, and
WHEREAS, The Board of Cou-ty Commissioners of Weld County, Colorado, did, by
resolution on October 26,1939,disapprove of the increase of pay prpposed for Martha R. Greigg,
Dt:puty Clerk of the District Court, and
WHEREAS,on further recommendation by the said Judges and it now appearing that the
services of said Deputy and her her work in said office warrants an increase in her, rate of
compensation, and the members of the Board of County Commissioners are now willing to approve
the increase.
NOW, THEREFORE, BE IT RESOLVED, by The Board of County Commissioners of Weld
County, Colorado, that the increase in pay for Martha R. Greigg, Deputy Clerk in the District
Court, to begin May 1,1941, is hereby approved.

AGREEMENT
THIS AGREEMENT entered into this 20th day of May,1941, by and between the Town of Eaton,
Weld County, .Colorado, a municipal corporation, of the first part, and Weld
County, Colorado, of the second part, WITNESSETH:
That whereas said first party, the Town of Eaton, contemplates the paving of certain
streets in said town with oil mat paving, and is desirous of using a county
maintainer belonging to second party, and an operator for said purpose , and
WHEREAS two of the streets of said town which are to be so paved with oil mat paving,
being the west side of Blocks 2 and 3 of .lest Side addition to Eaton, on Cheyenne
Street, north of G. W. Ry. , are one half located within the limits of said town
of Eaton and the other half located outside of the limits of the town of Eaton and
under the supervision of second party, and it is the desire of said parties to pave
said two blocks jointly,
Now, therefore, it is understood and agreed that second party will furnish to first party
a county maintainer and a man to operate the same, at the rate of $3.50 per hour for
a forty eight week, any overtime to be $3.00 per hour for the maintainer and $1.00
per hour for the man to operate the same at said rates for the time so used, the same
to be paid monthly.
Further that for the paving of the two blocks of joint highway, being on the west side of
Blocks 2 and 3, West Side Addition to Eaton on Cheyenne Street, north of the G. W. Ry. ,
same shall be done by said party of the first part in a manner approved by the second
party, the cost thereof to be shared one half by first party and one half by second
party, to be adjusted and paid at the conclusion thereof.
It is further understood and agreed that the town of Eaton will carry necessary workmen;s
compensation insurance on all its men engaged in said work and during all thereof(
excepting only the operator of the county maintainer furnished by the second party
as aforesaid) so that second party shall in no wise be liable for any damages or
injuries that may result; from said work.
It is further understood said work is to be performed and completed during the summer of 1941.
It is further understood that the first party has been authorized to enter into this agree-
ment by resolution of the Board of Trustees of the Town of Eaton, passed May28th, 1941,
and that second party has been authorized to enter into this agreement by virtue of a
resolution passed by the Board of County Commissioners of Weld County, on May 20, 1941.

Commissioner FORD offered the following re-olution and moved its adoption:
Whereas, it is provided by House Bill No. 19, passed by Second Extraordinary Session
of the Twenty-ninth General Assembly of the State of Colorado, approved ianuary 11,1934, that
the Board of County Commissioners by written resolution, may authorize the County Treasurer to
invest all or a part of funds and moneys coming into his possession by virtue of his office, as
County Treasurer, in certain securities therein designated, and,
Whereas, pursuant to such resolution authorizing the purchase of certain bonds, five
U. S. Treasury 3 1/4% bonds due August 1,1941, of $10,000.00 each, aggregating $50,000.00 and
called for payment August 1,1941, are now held by Harvey E. Witwer, County Treasurer of Weld
County, Colorado, and
Whereas said Harvey E. Witwer, County Treasurer of Weld County, Colorado, has, by
letter dated May 22,1941, requested proper authority to exchange the said five U. S. Treasury
3 1/4% bonds of $10,000 eqch due August 1, 1941 above described as held by him for five 2 1/2%
U. S. Treasury bonds of $10,000 each, due 1958, optinal, 1956;
Now therefore, be it r,_solved that Harvey E. Witwer, County Treasurer of Weld
County, Colorado, and the Colorado National Bank, as custodian, are authorized to exchange
$50,000 par value 3 1/2 U. S. Treasury bonds of $10,000.00 as heroin described for five 2 1/2%
U. S. Treasury bonds of $10,000.00 each due in 1958, optional in 1956, aggregating $50,000.
par value .
Be it further resolved that said Harvey E. Witwer, County Treasurer of Weld County,
Colorado is authorized to register said bonds in the name of Harvey E. Witwer, County Treasurer
of W ld County, Colorado, and to deposit and dafely keep same in the custody of the Colorado
National Bank of Denver, Colorado.
Be it further resolved that such securities shall not be sold or otherwise disposed
of except pursuant to resolutinn of the Board of County Commissioners of Weld County, Colorado
first duly adopted therefor.

WHEREAS, an affidavit signed by W. T. Young has been filed with the Board of County
Commissioners of Weld County, Colorado, setting forth that he is the owner of Tax Sale Certifi-
cate No. 522A/1936 said Certificate having been assigned to said W. T. Young on April 12,1939,
covering the non-payment of taxes against S2 Section 24, Twp. 12 N. , Range 59 W for the years
of 1935 to 1937 inclusive; that he has not assigned said certificate up to the present time, and
that affiant is now the owner and beneficially interested in the Certificate: that the property
covered by said Certificate has not been redeemed: that the Certificate was last in affiants
custody at Kimball, Nebraska on or about May 1,1939 and affiant knows nothing further of the
circumstances of its loss and believes that the same was lost through inadvertance.
WHEREAS, Bond of United States Fidelity and Guarantee Company of Baltimore,Maryland
in the amount of Two Hun,-red dollars ($200.00) to indemnify and keep harmless the County of
Weld and all its officials from all damages, suits and claims, of whatsoever nature, has been
filed with the Board of County, Commissioners of Weld County, Colorado, and
The BOARD havoing examined the record and evidence substantiating and confirming the
matter set out in said affidavit, and being sufficiently advised in the premises, does find that
the matter set out in said affidavit is true and correct.
NOW, THEREFORE, On motion duly made, seconded, and on vote, unanimously adopted, 499

RESOLVED, that a certified copy of such findings be made and that the County Treasurer
be, and is hereby authorized to institute proceedings leading to the issue of a Treasurer's deed

Colorado, of the full sum of Three Hundred Dollars ($300.00) cash in hand, receipt whereof
is hereby confessed and acknowledged, WELD COUNTY, COLORADO, hereby releases any and all
claims, demands, actions, or causes of action against the said Frank Kurzyna, his heirs,
administrators, executors and assigns for damages as a result of destruction be fire of a
County bridge one and one-half miles south of la Salle, Colorado, on or about April 5,1941.
This release is given pursuant to resolution passed and adopted by the Board of
County Commissioners of Weld County, Colorado, on the 24th day of 1ay,1941.
This release shall inure to and be binding upon the heirs, executors, administrators,
successors and assigns of the parties hereto.

RESOLUTION
WHEREAS, Frank Kurzyna, Route 1, Box 5, La Salle, Colorado, is alleged to have
negligently caused the destructiob of a county bridge located on Weld County road one and one-
half miles south of La Salle, Colorado, on or about April 5,1941, and,
WHEREAS, the Board of County Commissioners of Weld County, have made claim upon said
Frank Kurzyna for damages by r,_ason thereof ana said Frank Kurzyna has denied liability and,
WHEREAS, Weld County and the said Frank Kurzyna are desirous of amicably settling and
compromising the said claim for damages,

NOW, THEREFORE, be it resolved by the Board of County Commissioners of Weld Cou-
nty, Colorado that the said Frank Kurzyna, be and he is released of and from all claims,
demands, actions and causes of actions which the County of Weld may have or claim to have
against the said Frank Kurzyna by reason of the destruction of the bridge as aforesaid upon
the payment by the said Frank Kurzyna of the sum of Three Hundred Dollars ($300.00) in cash
to Weld County, Road District No. 3, on or before five days from the date hereof.
The above resolution was introduced, passed and adopted by the Board of County
Commissioners of Weld County, Colorado, on May 24th, 1941.

WHEREAS, Earle L. Russell, appointed Pharr Gist at the Greeley Hospital by Comm-
issioner's Resolution dated March 1,1941, who served temporarily until such time Mr.
Kendeigh is able to resume his duties, and,
WHEREAS, Clarence G. Kendeigh, now being able to resume his duties as Pharmacist
for the Greeley Hospital.
NOW, THEREFORE, BE IT RESOLVED, that Clarence G. Kendeigh be and hereby is appointed
Pharmacist for the Greeley Hospital, opereated and controlled by the Board of County Commissioners
of Weld County, Colorado, at a salary of #135.00 per month and to serve at the pleasure of the
Board of County Commissioners of Weld County, Colorado.
BE IT FURTHER RESOLVED, that, to comply with the requirements of the United States
Department of Internal Revenue, Power of Attorney is hereby granted to the said Clarenc e G.
Kendeigh, as Pharmacist of the said Greeley Hospital, to purchase narcotic drugs and make all
narcotic records necessary for said Greeley Hospital.
BE IT FURTHER RESOLVED, that the said Clarence G. Kendeigh is also authorized and
empowered to have official charge of the dispensing of intoxicating liquors necessary for the
administration of medicine in said Greeley Hospital now in storage in said Greeley Hospital
and to make necessary required reports therefor.

RESuLVED, that the following x-rgy schedule of fees be and hereby is approved until
further action of this Board.
SCHOOL PROGRAM: Films to be furnished by Weld County T. B. I. ealth Association for all
school-age children (6 to 18 years, inclusive) .
X-ray service to be furnished at the Greeley hospital.
School teachers and other school employees (bus drivers, janitors or food handlers) to
pay $2.00 to the Greeley Hospital for x-ray service.
X-ray films of school children and employees, as above , to be read by •Weld County
Health Department.
COUNTY MEDICAL PATIENTS: T. B. Suspect cases of families eligible for County Medical
contract-care and not receiving hospitalization. Films to be furnished by Weld County Welfare
Department and read by Hospital Staff Roentgenologists.
BODERLINE CASES: Whenever a family is found to have a suspected case of tuberculosis
and the family,after thorough investigation by the Weld County Welfare Department, is found to
be unable to pay the usual fee of $7.50 for x-ray service, a special arrangement can be made to
pay a flat fee of $ 2.00 per person receiving x-ray service. This fee will be paid directly to
the Greeley Hospital by the Wled County T.B. & Health Association. Only cases approved by the
Weld County Welfare Department may be accepted under this plan.
Reading of x-ray films of boder-line cases will be made by the Weld County Health
Department.
N. Y. A. GROUPS: To be x-rayed at Greeley Hospital, the film to be furnished by
N. Y. A. and the Greeley Hospit..l to be paid 63 cents per film by the Veld County T. B. &
Health Association for laboratory costs.

ciation. X-ray service to be furnished by the Greeley Hospital, the Weld County Welfare
Department to pay the Greeley Hospital 63 cents per film for laboratory costs.

Commissioner FORD offered the following resolution and moved its adoption:
WHEREAS, on June 30,1940, an automobile accident occured 42 miles North of Windsor,
in Weld County, on public highway then under repair, where personal and property injuries
were suffered by gunice Reed, Vernon Pearson and Wendell Carlson, and said persons have filed
claims with Weld County for alleged negligence of road employees of said county, which claims
have heretofore been refused and denied, and,
WHEREAS, said persons have threatened suit on said claims which will cause some
expense to Weld County in defending against same,
NOW, TI- REFORE, to avoid expense of suit thereon and in settlement of any and all
claims against Weld County and its employee, from said accident, the following payments are
hereby authorized-- To Elmer Reed for the benefit of Eunice Reed,$120.86 from which is to be
paid $85.86 due the Greeley Hospital; to Mr. Vernon Person $98.90 from which is to be Maid
81.00 due the Greeley Hospital; and to Mrs. Albin Carlson for benefit of Wendell Carlson
105.77; and that vouchers to said persons in said amounts are approved and warrants ordered
to be drawn therefor.

OF BUILDING FOR CLASSES OF NATIONAL
DEFENSE WELDING SCHOOL.
Commissioner Sanden offered the following resolution and moved its adoption:
WHEREAS, The Board of County Commissioners of Weld County, Colorado has been
informed that funds will not be available, after August 8, 1941, for rental of the
building for classes of the National Defense Welding School, and,
WHEREAS, it appears that the training facilities offered by the Welding School
are not otherwise available to Weld County citizens and that the opportunities offered
by the school should not be discontinued at the present time.
NOW, THEREFORE, BE IT RESOLVED, that the rental of the classroom building,
$100.00 per month, be assumed by Weld County for the period from August 9, 1941 to
January 9, 1942, or for such time as the services of the school may be offered prior
to January 9, 1942

RESOLUTION RE: LEASE OF UNION PACIFIC
RAILROAD COMPANY RIGHT OF WAY AT FORT
LUPTON:
WHEREAS, UNION PACIFIC RAILROAD COMPANY, has tendered to the County of
Weld, State of Colorado, a lease covering a portion of the Railroad Company's
right of way at Lupton, Colorado, for asphalt plant;
WHEREAS, the Board of County Commissioners of Weld County, State of
Colorado has said proposed agreement before it and has given it careful review and
consideration; and
WHEREAS, it is considered that the best interests of said Weld County,
State of Colorado will be subserved by the acceptance of said agreement.
THEREFORE, BE IT RESOLVED BY TIE BOARD OF COUNTY COMMISSIONERS OF WELD
COUNTY, STATE OF C OL ORADO;
That the terms of the agreement submitted by the Union Pacific Railroad
Company as aforesaid be, and the same are hereby, accepted in behalf of County of
Weld, State of Colorado;

THIS AGREEMENT , made and entered into this 20th day of June, 1941 by
and between Union Pacific Railroad Company, a corporation of the State of Utah
(hereinafter called "Lessor") party of the first part and County of Weld, State of
Colorado (hereinafter called "Lessee") party of the second part, WITNESSETH:
Section 1: The Lessor, for and in consideration of the covenants and payments
hereinafter mentioned, to be performed and made by the Lessee, hereby agrees to
lease and let and does hereby lease and let unto the Lessee for a term beginning
on the twentieth day of June, 1941 and extending to the twentieth day of December,
1941, unless sooner terminated as herein provided the portion of the premises of
the lessor described in Section 17 (a) hereof at Lupton, Weld County, Colorado,
shown on the plat, or described in the description, or both, hereto attached and
made a part hereof; RESERVING, however, to the Lessor the right to place and main-
tain at prominent places on the leased premises signs advertising Union Pacific
Railroad Company.
Section 2: The Lessee agrees to pay to the Lessor for the use of said premises,
rental at the rate of Five and no/100 Dollars ($5.00) for the term hereof, in advance.
II Section 17 (a) : A tract of land 40 feet in an easterly and westerly direction,
by 125 feet in a northerly and southerly direction, containing 5,000 sq. ft. , the
westerly line of which is parallel with and 100 feet distant easterly from the
center line of the Lessor's main track and the southerly line of which is parallel
with and 20 feet distant northerly from the centerline (produced) of First Street,
Lupton, Colorado
Section 18: It is further agreed that by the word "Lessee" is meant the party or
parties of the second part herein and signing this agreement, and his, its, or
their heirs, executors, administrators, successors or assigns, and that all of
the terms and conditions of this agreement shall inure to the benefit of the
Lessor, and its successors and assigns or any railroad company whose line of rail
road the Lessor may be operating under any arrangement of any kind or nature what

Weld County Garage, Greeley, Colorado, said described car having been traded to the
Weld County Garage on a new car for use of the County Sheriff's department.

RESOLUTION RE: VACATION OF
COUNTY EMPLOYEES.
WHEREAS, requests have been made that the customary two-week vacation, with
regular pay, be allowed employees who entered the service of Weld County at the be-
ginning of the term of office in January, 1941, and,
WHEREAS, it appears that, subject to approv_l of the heads of departments and
offices, such employees should be granted the two-week vacation period, with regular
pay, with certain reservations.
On motion, duly made and seconded, it was,

RESOLVED, that , subject to approval of the heads of departments and offices, a two
week vacation, with regular pay, may be granted each regularly employed person for
each twelve-month period of county employment, with the privelege of taking such
vacation prior to the end of the twelve-month service, but in event of termination
of employment prior to the twelve-month service, a deduction in the amount of the
unearned vacation shall be made from the final pay check of such person.

RESOLUTION APPOINTING COMMTSSIONER
TO CONVEY PROPERTY.
Commissioner Ford offered the following resolution and moved its adoption:
WHEREAS, Weld County has acquired, by Treasurer's deeds dated May 3rd, 1938 and
recorded in Bpok 1025 at pages 445 and 446 in the records of the County Clerk & Re.*
corder of Weld County, Colorado, and is the owner of S-SW1: Section 13, Township 10
North, Range 63 West; and N2NJT:: Section 24, Township 10 North, Range 63 West, and,
WHEREAS, said properties have been duly advertised for sale at a public auction
held on March 6, 1939 at the hour of two o'clock, P.M. in the office of the Board of
County Commissioners of Weld County, Colorado,and,
WHEREAS, at said sale, the UNITED STATES OF AMERICA, bid $335.00 as the purchase
price for said properties and, being the highest and best bidder, an option for the
purchase of said properties was granted to the said United States of America.
NOW, TELREFORE, BE IT RESOLVED, and it is hereby ordered that Harvey E. Witwer
County Treasurer of Weld County, Colorado, is hereby constituted, and appointed as
Special Commissioner of Weld County, Colorado, to amke a conveyance, by Special War-
ranty Deed, of said properties, as aforesaid, to said the UNITED STATES OF AMERIC ,
which said property is more particularly described as follows, to-wit:
The South half of the Southwest Quarter (StiSWk) of Section Thirteen (13) and the North
half of the Northwest Quarter (N -NW4) of Section twenty-four ( 24) Township Ten (10)
North, Range Sixty-three (63) West of the Sixth (6th) Principal Meridian.
IT IS FURTHERED ORDERED that to such conveyance, the said Harvey E. Witwer is
authorized to affix the seal of said County and said conveyance, when executed accord-
ing to this order, shall have the effect to transfer to said the UNITED STATES OF AMERi
ICA all right, title and interest which Weld County has in and to the above described
properties.

WHEREAS, the Board of County Commissioners of Weld County, Colorado, has been
informed that the taxes assessed against said Howard H. Hause for the years of 1931,
1930 and 1932 are uncollectible, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds said
taxes uncollectible:
NOW, THEREFORE, BE IT RESOLVED, that the taxes assessed against the personal

mitted his resigiation, effective September 1, 1941, and,
WHEREAS, the appointment, effective September 1, 1941, of Harold F. Johnson, as
Assistant County Agent and County Club Leader, has been presented for the approval
of the Board of County Commissioners of Weld County, Colorado.
NOW, THEREFORE, BE IT RESOLVED, that the appointment of Harold r'. Johnston
effective September 1, 1941, as Assistant County Agent and County Club Leader, in
Weld County, be and hereby is approved.
BE IT FURTHER RESOLVED, that, effective September 1, 1941, the salary allowance
from Weld County Funds for the Assistant County Agent and County Club Leader be and
hereby is ordered discontinued.
BE IT FURTHER RESOLVED, that the Agreement For County Extension Work, dated
March 3, 1941 (File 30/161) be amended to conform to this resolution and that a copy
of this resolution be maile to J. L. Shields, District Extension Agent for the Colo-
rado Agricultural College and the United States Department of Agriculture.

T. C. Wilmoth, County Coroner, in the office of the Board of County Commsssioners
on February 5, 1941, said to be the money and property found on the body of Fred
Bernhardt, deceased, and,
WI- REAS, a request has been filed by the heirs of Fred Bernhardt, deceased,
that said money and property be delivered to Macy's, Incorporated, for disposition
and the proceeds to be applied on the funeral bill fo Fred Bernhardt, deceased.

REDEEM TAX SALE CERTIFICATES FOR FEES ONLY
ON ACCOUNT OF ERRONEOUS ASSESSMENTS.
WHEREAS, the County Assessor has advised this Board that through error in compil-
ation of assessments on improvements on the SE 1/4 of 8-1-65, a duplicate assessment to
the amount of was made theron, for the years 1932 to 1937 inclusive, making a tax
on the county treasurer's books against August P Gumlick therefor, and the same prop-
erty was also assessed for said years and taxes paid by the Hudson Game Association;
that the erroneous assessments were as follow, to-wit:

from the Company, one used eight-foot Adams leaning wheel grader, Serial No. 2271,

WHEREAS, the credit of $100.00 has been allowed on purchase of repairs parts
made by the Weld County Highway Shops during the month of July, 1941, and billed
on the voucher submitted August 2nd, 1941.

RENTAL TAX TITLE PROPERTY.
WHEREAS, Weld County is the owner of the store building on West 8 feet of
Lot 10 and the East 10 feet of Lot 11, Block 9 , Grover, which has been occupied
by W. L. Robbins, as tenant, at a monthly rental of 415.00 per month, and said
tenant has become ten months delinquent in said rental payments, now owing $150,
and is insolvent and unable to pay said rental and to continue to occupy said
property as said rental, now offers to satisfy said delinquent rentals to August
1, 1941 by cash payment of $100.00; and will continue to occupy said building at
a rental of $10.00 per month, payable in advance. And, the Board of County Commi-
ssioners being of the opinion the rental rate on said building was and is too high,
and that the fair rental therefor is $10.00 per month.
NOW, THEREFOR, motion is made and carried that the back rent claim against
W. L. Robbins to August 1, 1941, be satisfied and settled for $100.00 cash, and
that he be permitted to continue occupation of said building month to month at a
rental of $10.00 per month, payable in advance each month.

RESOLUTION FOR INSURING
COUNTY FUNDS.
WHEREAS, Harvey E. Witwer, County Treasurer of Weld County, Colorado re-
ports to this Board that he now has on hand as County Treasurer, temporarily
for the next two months, approximately 4200,000.00 in cash, which sum is in
excess of existing public deposits in authorized banks furnishing him deposi-

tory bonds or collateral security as provided by the laws of Colorado; and
all said banks now have public deposits from him practically to the extent of
their depository bonds and collateral security, and by reason thereof the
County Treasurer has no place to deposit said moneys under the terms required
by law, and it appearing a safe storage of said excess public money must be
provided,
Now, therefore, this Board finding said excess public money of 4200,000.00
is a commodity to be safely stored and protected does hereby authorize said
Harvey E. Witwer to rent a necessary safety deposit box or boxes therefore in
the Colorado National Bank of Denver, Colorado (a depository heretofore ddsig-
nated by this Board for the deposit of public funds of the County Treasurer) ,
and therein store said money and forthwith to insure same against burglary and
robbery in the name of Harvey E. Witwer, County Treasurer, or of Harold Seaman,

Boston, Massachusetts, and to pay necessary rental charges and insurance pre-

On motion duly made and sedonded, it was,
RESOLVED, by the Board of County Commissioners of Weld County, Colorado. ,
that the County Treasurer be and hereby is authorized to establish and create a
fund to be designated "Special Hospital Account" for deposit of gifts, bequests and
donations which, from time to time, may be made to and for the use and benefit of
the hospital.

GREELEY HOSPITAL AND AUTHORIZING
DEPOSIT OF SUM IN "SPECIAL HOSPITAL
ACCOUNT"
Commissioner Noble S. Sanden introduced the following resolution and
moved its adoption;
"WHEREAS, according to the Last Will and Testament of Robert F. Graham,
Deceased, duly admitted to probate and record in the County Court of Weld County,
Colorado, and of which The First National Bank of Greeley, Colorado is Executor,
there is given and bequeathed into "the Board of County Commissioners of the
County of Weld and State of Colorado, for the use or benefit only of the hospital
now located at the corner of Sixteenth Street and Eleventh Avenue, Greeley, Colo-
rado, the sum and amount of $500.00; " and
"WHEREAS, the said Board of County Commissioners desires to accept said
legacy and bequest "for the use or benefit only" of the said hospital, and, by so
doing,wished to express appreciation therefor.
"NOW, T1EREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said Board does accept said legacy and bequest of
$500.00 "for the use or benefit only of the hospital now located at the corner of
Sixteenth Street and Eleventh Avenue, Greeley, Colorado; " that said sum and mount
be deposited in anc credited to the "Special Hospital Account", and that it be not
diverted or used or expended except only "for the use and benefit of said hospital".
Said motion was seconded by Commissioner Fred 0. Ford and, upon being
put, was unanimously carried and adopted and so declared.

WHEREAS, the UNION PACIFIC RAILRAOD COMPANY has tendered to the COUNTY
OF ?WELD, STATE OF COLORADO, an agreement extending to September 30, 1946, the term
of contract dated December 30, 1936, under which the Railroad Company grants to the
County the right to use for highway purposes certain portions of its right of way
described in said agreement, subject to he terms and conditions in said agreement
stated: said agreement being identified as Union Pacific Railroad Company's Con-
tract Department No. 6002-D-1; and
WHEREAS, the Board of County Commissioners of the County of Weld, State
of Colorado, has said proposed agreement before it and has given it careful con-
sideration; and
•1BERgAS, it is considered that the best interests of said County of
Weld, State of Colorado, will be subserved by the acceptance of said agreement:

The said complaint of John Wilken was referred to the County Assessor for

Gentlemen;
In accordance with our discussion, we ask that you commence the study of land owner-
ship and similar subjects in the areas outlined on the map which we discussed with
you at our last meeting.
It is understood that this does not constitute any commitment on the part of the
County as to the Zoning Program, but it is our present intention to proceed with
the zoning as far as seems advisable.
This work is to be conducted by your office without expense to the County excdpt
for the sum of two hundred dollars which will be paid as partial reimbursement for
the cost of your part of the work. It is also understood that the County will pro-
vide some direction of the program through one of the County officials and will aid
the staff in making studies by the contribution of a reasonable amount of fuel.

Pursuant to adjournment of the 4th instant , the Board of County Commissi-
oners of Weld County, Colorado, were in session as the County Board of Equalization
and considered the 1941 assessments of the County Assessor and the protests of the
taxpayers thereto as filed.
The Board adjourned to the following day without habing taken any action
as to any changes.
There being no further latusiness for the day, a recess was ordered taken
to the following day.

RESOLUTION AUTHORIZING COUNTY TREASURER
TO AS_IGN AND REDEEM TAX SALE CERTIFICATE
NO. 871/1940 ACCOUNT OF ERROR IN PAYMENT
AND REBATE OF TAX OF 1939.
Commissioner Sanden offered the following resolution and moved its adoption:
WHEREAS, 1939 taxes assessed against the Southeast Q,uarter of Section 24,
Township 7 North, Range 56 West, were paid in error by the Federal Land Bank and sub-
sequently rebated to The Federal Land Bank, as set forth in the letter of the Treasurer
of Weld County, hereto attached and made a part of this resolution, and,
WHEREAS, the offer of payment of 1939 taxes on the property, submitted by
the owners, Julius and Lizzie Samber, was refused, as stated in the letter, and,
WHEREAS, subsequent to the rebate of the 1939 taxes, the property was sold
for the 1939 tax on December 9, 1940.
NOW, THEREFORE, BE IT RESOLVED, that the County Treasurer be and hereby
is authorized to assign, and redeem, tax sale certificate numbered 871 of the 1940
tax sale for the tax of 1939 and 1940, covering SE*: Sec. 24, Twp. 7N. , Rg 56W. , to
Julius and Lizzie Samber, upon receipt of $46.91, together with his fees for making
assignment and redemption.
The motion was seconded by Commissioner Ford and the Resolution adopted
by the following vote:

WHEREAS, Mary Maxine Harding, of Weld ;County, Colorado, has presented to
the Board of County Commissioners of Weld County her application for a County Retail
license for sale of 3.2% beer only, and the said applicant, having paid to the County
Treasurer of Weld County the sum of Fifty Dollars (%50.00) therefor, and having pro-
duced a state retail _icense for sale of 3.2% beer only, outside the corporate limits
of any town or city in the County of Weld, at the location described as follows,
CROW VALLEY CAFE, STATE HIGHWAY # 14, BRIGGSDALE, COLO.
And the County Commissioners, having examined the said application and the
other qualifications of the applicant do hereby grant a license to said applicant to
sell 3.2% beer only at retail, at said place, and do hereby authorize and direct the
issuance of said license by the Chairman of the Board, attested by the County Clerk
and Recorder of Weld, County, good for one year from the date of issue unless revoked,
according to law, provided, however, that said license shall be issued upon the express
condition and agreement that the place where licensee is authorized to sell beer under
said license will be conducted in strict conformity to all laws of the State of Colo-
rado and rules and regulations relating thereto heretofore passed by the Board of
County Commissioners of Weld County, Colorado and any violation therof shall be cause
for revocation of the license.

County, the Agreement with the State of Colorado for the rental of office space on
the fourth floor of the Weld County Court House for the use of the Colorado State
Department of Revenue, a copy of said agreement is hereto attached and made a part

RESOLUTION APPOINTING ACTING •
HEALTH OFFICER
WILLIAM J. WILSON, M.D.
Commissioner Ford offered the following resolution and moved its adoption:
WHEREAS, DR. JOHN H. FOUNTAIN, County Health Officer, has been granted a
leave of absence, and,
WHEREAS, a vacancy exists in that office, and,
WHEREAS, DR. WILLIAM J. WILSON has made application to this Board fdr the
appointment as Acting Health Officer of Weld County, and,
WHEREAS, the appointment of William J. Wilson, has been approved, subject
to the approval of this Board, by the Colorado State Health Department.
NOW, THEREFORE, BE IT RESOLVED that Dr. William J. Wilson be and hereby is
appointed Acting Health Officer of the health Department in and for the County of Weld,
Colorado, for the period ending December 31, 1941, at a salary of $275.00 per month
and a travel allowance of $75.00 per month.
