HomeMy WebLinkAbout830175.tiff RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR A GAS PROCESSING PLANT - OILCOM CORPORATION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 2nd day of November, 1983, at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Oilcom Corporation, 1600 West First Street, Loveland, Colorado 80537 , for a Use by Special Review for a gas processing plant on the following described real estate, to-wit: Part of the SEa , Section 11, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado. WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Plan- ning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons : 1. The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 .2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. No overlay districts affect the subject site . d. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for a gas processing plant on the here- inabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Operations Standards being adopted for this operation. 2 . The adopted Operation Standards shall be placed on the Use by Special Review Permit Plat. The Use by Special Review Permit Plat shall be delivered to the Depart- ment of Planning Services and recorded at the Clerk and Recorder' s Office prior to the issuance of build- ing permits. The uses permitted shall be a natural gas processing facility as described in the application materials on file with the Department of Planning Services. 2. The natural gas processing facility shall comply with all applicable Colorado Oil and Gas Commission requirements as listed by the Commission in a letter dated September 26, 1983 on file with the Department of Planning Services. 3. A six (6) foot chain link fence, topped with barb wire, shall enclose the Use by Special Review Area. 4. An air emissions permit for the facility must be obtained from the Air Pollution Control Division, Colorado Department of Health, 4210 E. 11th Avenue, Denver, Colorado 80220. 5. Noise emissions must not exceed those standards which are found in Colorado Revised Statute 25-12-103. 6. Prior to the issuance of a building permit for the mobile home, the applicant shall submit evidence that the proposed water tap is supplying water in such a manner as to be adequate in quality, quantity and dependability. Also, a septic permit shall be obtained and the site shall meet perk test requirements prior to the issuance of said building permit. The mobile home shall be used only for the duration of the natural gas processing facility as a security residence; a building right for a permanent residence is not associated with the 10. 124 acre tract. 7. A closed-system (vented) septic tank shall be utilized on the site instead of the proposed flare-pit. 8. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 9. The applicant shall comply with the design standards for Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 10. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 11. The Use by Special Review shall be limited to the plans shown hereon and governed by the Operation Standards stated above, and all applicable Weld County regulations. Any material deviations from the plans and/or Operation Standards as shown or stated above shall require the approval of an amendment of the Use by Special Review Permit by the Weld County Planning Commission and the Board of County Commissioners before such change from the plans and/or Operation Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 12. The proper owner and/or operator of this operation shall be responsible for complying with all of the above stated Operation Standards. Noncompliance with any of the above stated Operation Standards may be reason for revocation of the Use by Special Review Permit by the Board of County Commissioners. Russ Anson, Assistant County Attorney, read this request into the record. He also read the favorable recom- mendations from the Planning Commission into the record because Mr. Allison had been detained for a short while. Mr. Allison, Planning Department representative, read the recommended conditions and Development Standards into the record. Joe Borla, representing the applicant, came forward to explain this request • and to answer questions of the Board. Mr. Borla said they have no problem with the recuitmended conditions and Standards. After a short discussion, Commissioner Brantner moved to approve this request for a Use by Special Review with the conditions and Standards as recommended. Commissioner N. Carlson seconded the motion and it carried unanimously. Type of use: Natural gas processing plant. 2. Proximity of plant to residential structures is approx 3/8 mile. 3. There will be one employee on the site 24 hours a day. 4. The maximum number of users, patrons , members, buyers , or employees will be four, 5 . There will be no animals at the site. 6. The proposed structures to be errected are: two storage tanks , building to house the compressors , a field office, and a mobile home to house the 24 hour employee. 7. There will be a dirt road used as access to the site. The type of vehicles that will use the road will be one propane transport truck every other day and one oil transport truck once a month . 8 . The only domestic sewage facilities will be for the mobile home site and office site combined. 9 . There will be no stockpile, storage or waste area utilized. except for domestic trash barrel . 10 .
