Approve Filing of Proceedings in Eminent Domain, Pursuant to C.R.S. §38-1-101,
Against Little Thompson Ranch, LLC
Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
Whereas, Weld County is in need of acquiring property for the replacement of
Bridge 19/46.5A, in a portion of Section 10, Township 4 North, Range 67 West of
the 6th P.M., Weld County, Colorado, as more fully described and depicted in the
attached Exhibits, and
• Exhibit Al , Legal Description of parcel RW-04 REV
• Exhibit A2, Legal Description of parcel RW-05 REV
• Exhibit A3, Legal Description of temporary easement TE-05 REV
• Exhibit A4, Legal Description of temporary easement TE-05A REV
Whereas, in an appraisal prepared by Jason Davis and Jon Vaughan, Certified
Appraisers, the value of parcel RW-04 REV is $20,646.00, the value of RW-05 REV is
$15,947.00, the value of TE-05 REV is $3,334.00, the value of TE-05A REV is $611.00,
and trees valued at $9,540.00 for a total value of $50,100.00 (rounded).
Whereas, said Property is owned by Little Thompson Ranch, LLC, and
Whereas, negotiations with the Property Owner included multiple phone calls, emails and
letters from Mitch Hauff and Anissa Warner, Acquisitions Agent for Western States Land
Services (on behalf of Weld County), to Little Thompson Ranch, LLC, and counsel
Josh Mangiagli, and
Whereas, Weld County has made multiple offers to purchase the property, with a final
offer made on January 26, 2026, for $36,593.00 for RW-04 REV and RW-05 REV,
$3,945.00 for TE-05 REV and TE-05A REV, $12,161.40 incentive (30% of land value),
$9,540.00 for improvements and damages, and $25,838.60 authorized compensation, for
a total compensation of $88,100.00 (rounded), and
Whereas, the County and the Property Owner have attempted to negotiate
compensation, but to date, the parties have been unable to reach an agreement for the
purchase of said Property, and
Whereas, the purpose of the project is to replace the existing Bridge 19/46.5A that was
constructed in 1960 and impacted by flooding in 2013. The replacement project will satisfy
the emergency repair finding that directed the County to complete a bridge replacement
or extensive repairs by December 31 , 2027, and

Whereas, the replacement bridge is for the use of the travelling public that currently
averages traffic of approximately 3,000 vehicles per day, and
Whereas, the Bridge 19/46.5A Project has been on the Capital Improvement Project
(CIP) list since 2015, and
Whereas, the Board finds that the Bridge 19/46.5A Project is needed to further a
necessary public use and that this property is an integral part of that project which cannot
be completed without the acquisition of the necessary right-of-way and easements, and
Whereas, counsel for Little Thompson Ranch, LLC, was notified via email in a letter dated
February 23, 2026, of the place and time at which the Board considered this Resolution.
Now, therefore, be it resolved by the Board of County Commissioners of Weld County,
Colorado, that the Weld County Attorney be, and hereby is, authorized to file a proceeding
in eminent domain, pursuant to C.R.S. §38-1-101 et. seq., against Little Thompson
Ranch, LLC, in the Weld District Court to acquire the Property described and depicted in
the attached Exhibits.
Be it further resolved by the Board that the acquisition of such Property is deemed
necessary for the health, safety and welfare of the citizens of Weld County, Colorado.
Be it further resolved by the Board that the Controller shall cause to be paid $88,100.00
into the Registry of the Court, being the amount that Weld County estimates is the
appropriate value of the property, including all damages, for the purpose of acquiring the
aforementioned Property upon the filing of a motion for possession of the Property, or if
in conjunction with a joint and stipulated motion for immediate possession or a stipulated
Rule and Order, payment may be made to Respondent as an alternative to depositing
such sums into the Registry of the Court.

Brief description of the problem/issue: Public Works is in the Right of Way(ROW) acquisition phase of
the 19/46.5A Bridge Replacement Project. We have received an appraisal for property owned by Little
Thompson Ranch, LLC in which the purchase of ROW and temporary easement is required, and we are
preparing to send out an initial offer.
This purchase includes right-of-way, temporary easements and damage to trees on the property adjacent to
the bridge. Appraisal values and the 30% incentive are shown in the table below.

What options exist for the Board?
1. Approve the initial offer for ROW and temporary easements on the Little Thompson Ranch property
2. Do not approve initial offer for ROW and temporary easements on the Little Thompson Ranch property
3. Discuss alternate options for this project in a work session
Consequences: Denial of this initial offer will delay the ROW acquisition process.
Impacts: Any delay in ROW acquisition will delay the entire project.
Costs (Current Fiscal Year I Ongoing or Subsequent Fiscal Years): $62,261.40 in 2025.
Recommendation: Public Works staff recommends Weld County extend an initial offer to Little Thompson
Ranch, LLC in the amount of$62,261.40 for the purchase of right-of-way and temporary easements related to
the Bridge 19/46.5A Replacement Project and they be allowed to negotiate for up to $88,100, if needed. If the
negotiated offer exceeds this amount, staff will return to the BOCC for further direction.
