RESOLUTION RE: APPROVAL OF SPECIAL USE PERMIT FOR A STORAGE YARD FOR A HOUSE MOVING OPERATION - CHARLES RYBERG, 17893 WELD COUNTY ROAD 6, BRIGHTON, COLORADO 80601 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 19th day of March, 1980 at the hour of 2 :-00 o'clock p.m. in the Chambers of the Board of County Commissioners for the purpose of hearing the application of Charles Ryberg, 17893 Weld County Road 6 , Brighton, Colorado, for a Special Use Permit for a storage yard for a house moving operation on the following described real estate, to-wit: A parcel of land in the Southeast one-quarter of Section 24 , Township 1 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, described as : Beginning at the Southeast corner said South- east one-quarter, thence North 89°37 ' 15" West on an assumed bearing along the South line said Southeast one-quarter, a distance of 956 . 62 feet to the True Point of Beginning; Thence North 00°28 ' 30" East, parallel with the East line said Southeast one-quarter, a distance of 578 . 92 feet; Thence North 89°37 ' 15" West, parallel with the South line said Southeast one-quarter a dis- tance of 225 . 73 feet; Thence South 00°28 ' 30" West a distance of 578 . 92 feet to a point on the South line said Southeast one-quarter; Thence South 89°37 ' 15" East along said South line a distance of 225 . 73 feet to the True Point of Beginning. WHEREAS, evidence was presented in support of the granting of the Special Use Permit for a storage yard for a house moving opera- tion on the above described real estate, and WHEREAS, Section 3 . 3 (E) (2) of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon appro- val by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those present, 8OOO32 has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Special Use Permit for a storage yard for a house moving operation on the hereinabove described real estate, conforms to the purposes of Section 3 . 3 (E) (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the application of Charles Ryberg for a Special Use Permit for a storage yard for a house moving operation on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1. The development standards contained in the Special Use Permit. 2. No building or electrical permits for the operation shall be issued on the Special Use Permit area until the development standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the office of the Depart- ment of Planning Services. 3. This Special Use Permit shall not run with the land and shall be personal to Charles E. Ryberg and no other person; it shall expire if Mr. Ryberg' s interest in the property is transferred (by deed, lease or any other method) or if Mr. Ryberg no longer operates or owns the house- moving business. This condition of the Special Use Permit shall be placed on the Special Use Permit plat and said plat recorded with the real property records of the Weld County Clerk and Recorder. The attached Development Standards being recommended and approved for the Special Use Permit. 2. DEVELOPMENT STANDARDS 1. The uses permitted on the hereon described parcel shall be a storage yard for equipment and related items accessory to a house- moving operation and all uses permitted by right under Section 3. 3B of the Weld County Zoning Resolution except such permitted uses shall not include temporary storage of structures in transit. 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems . The applicant shall be responsible for adhering to the provisions of the Colorado Air Pollution Control Commission Regulation. 4. There shall be one access allowed to the SUP area. All accesses shall have the approval of the Weld County Engineering Department. All access shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5. The Special Use Permit area shall be screened with a six foot privacy fence which may be a chain link fence with aluminum slats. 6. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 7. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non-compliance with any of the above stated Development Standards shall be reason for revocation of the Special Use Permit by the Board of County Commissioners. Roll Call was as follows : Chuck Carlson Present Bob Ehrlich Present Fred Otis Present Jerry Kiefer Present Bette Kountz Present Irma White Present Don Billings Absent Frank Suckla Absent Also present were : Tom Honn, Zoning Administrator Russ Anson, Assistant County Attorney As a quorum was present, the meeting was called to order by Chairman Carlson. He asked if there were any corrections or additions to the minutes of February 15 . Hearing none he called for a motion to accept the minutes as presented. Jerry Kiefer made a motion to accept the minutes. His motion was seconded by Bette Kountz. All present cast a unanimous vote to approve the minutes as presented. SE%, Section 24, T1N, R66W LOCATION: 1 mile north of the Town of Lochbuie APPEARANCE: Charles Ryberg and John Dent DISCUSSION: Tom Honn first brought the Planning Commission up-to-date as to what has been occurring on this property up to the present time. Mr. Dent then stated that the property involves approximately 3 acres on which Mr. Ryberg will store his housemoving equipment only. No houses will be stored on the property. He feels that since the operation has been in existence 7 years there will be very little impact to the neighborhood and there would be no noise or pollution involved. Mr. Ryberg also plans to screen the area with a privacy fence, perhaps a chain link fence. Discussion followed regarding screening the area- and also placing a condition in the recommendation that the use is for Mr. Ryberg only and that transfer of the property would not carry the use with it. MOTION: Be it therefore resolved to recommend approval based on the Planning Staff ' s recommendation with amended Development Standards to include the standard that no houses will be stored on the property and that the area will be screened. Also that a condition be in the recommendation that the use be personal only to Mr. Ryberg and transfer of the property would not carry the use with it based on the Planning Staff ' s recommendation. His motion was seconded by Jerry Kiefer. A vote of "aye" was cast by Bob Ehrlich, Fred Otis , Jerry Kiefer, Irma White, Bette Kountz, and Chuck Carlson. Motion carried. SW4, Section 6, T4N, R65W LOCATION: Adjacent to the south side of the Town of LaSalle west of U.S. Highway 85 APPEARANCE: Tom Houtchens DISCUSSION: Mr. Houtchens stated that this request is to amend Development Standard #6 which would change the shape of the internal subdivision roads which comes into the property and changes the point of access . The access was previously proposed through the Town of LaSalle and on to a road that was to extend south from LaSalle to the Highway where the access was. Since then the access has been changed to on and off County Road 48. The Highway Department has approved it as an access point. The Planning Staff ' s recommendation for approval and the Development Standards were incorporated into the meeting minutes as presented. Discussion followed regarding paving U.S. Highway 85 from the frontage road to extend from the existing pavement between the intersection of Co. Rd. 48 and U.S. 85 to the internal subdivision road. MOTION: Be it therefore resolved to recommend approval based on the Planning Staff ' s recommendation with an additional statement which states that subdivision lots which are contiguous to the road shall have one access per lot off of and onto said road, as well as to and from the internal subdivision road along with the Development Standards. Motion by- Jerry Kiefer, seconded by Irma White. A vote of "aye" was cast by Bob Ehrlich, Fred Otis, Jerry Kiefer, Irma White, Bette Kountz and Chuck Carlson. Motion carried. The applicant shall be responsible for adhering to the provisions of the Colorado Air Pollution Control Commission Regulation. 4. There shall be one access allowed to the SUP area. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department. 5. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . 6. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Non-compliance with any of the above stated Development Standards shall be reason for revocation of the Special Use Permit by the Board of County Commissioners. - COMMENTS: To date our office has received 4 letters from surrounding property owners within 500 feet of the property in question. Copies of these letters are attached. In the application materials, the applicant states that it is his intention to fence the perimeter of the site. The Department of Planning Services feels that the Planning Commission should consider a method for screening or buffering of the Special Use Permit area to protect surrounding property owners . It formed in alluvial deposits. Included in this unit are some leveled areas. Also included were some soils with loamy substratums. Typically the surface layer is a grayish brown sandy loam about 10 inches thick. The subsoil is a brown fine sandy loam about 20 inches thick. The substratum, to a depth of 60 inches, is a sandy loam or loamy sand. Permeability is moderately rapid. Available water capacity is moderate. Effective rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. This soil is used almost entirely for irrigation and is suited to all crops adapted to this area, including corn, sugar beets, beans, alfalfa, small grains, potatoes and onions. An example of a suitable cropping system is alfalfa 3 to 4 years followed by corn, corn for silage, sugar beets, small grain, beans and back to alfalfa. The rapid permeable substratum may have a slight restriction for some crops. (- : 1, All methods of irrigation are suitable with furrow irrigation the A-- most common type used. Proper irrigation water management is essential. Barnyard manure and commercial fertilizers are needed for top yields along with maintaining good organic matter content. Windbreaks and environmental plantings are generally suited to this soil. Soil blowing is the principal hazard to establishing tree and shrubs. This hazard can be overcome by cultivating only in the tree row and by leaving a strip of vegetative cover between the rows. Supplemental irrigation may be necessary at the time of planting and during the dry periods. Trees that are best suited and have good survival are Rocky Mtn. juniper, eastern redcedar, ponderosa pine, Siberian elm, Russian-olive, and hackberry. Shrubs best suited are Cskunkbush sumac, lilac and Siberian peashrub. Wildlife is an important secondary use, with these soils best suited for openland wildlife. The subsoil is a brown to light yellowish brown fine sandy loam about 22 inches thick. The substratum, to a depth of 60 inches, is a sandy loam or loamy sand. C Permeability is moderately rapid. Available water capacity is moderate. Effective rooting depth is 60 inches or more. Surface runoff is slow and erosion hazard is low. Where irrigated this soil is suited to the commonly grown crops in the area. However, perennial grasses and alfalfa or close grown crops should be grown at least 50 percent of the time. Close grown crops and pasture can be irrigated with contour ditches and corrugations. Furrows, contour furrows and cross slope furrows will work on row crops. Sprin- kler irrigation is also recommended. Minimum tillage and crop residue utilization will help control erosion. Fertility maintenance is important. Crops grown on these soils respond ( to fertilizer applications of phosphorus and nitrogen. - . ' p r In nonirrigated areas this soil is suited to winter wheat, barley and sorghum. Most of the area is devoted to winter wheat which is alter- nated with summer fallow to allow moisture accumulation. Normally, precipitation is too low to make beneficial use of fertilizers. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and, water erosion. Terr- acing may also be needed to control water erosion. The potential native vegetation on this site is dominated by sand bluestem, sand reedgrass and blue grama. Needle and thread, switch- grass, sideoats grama and western wheatgrass are also prominent. Po- tential production ranges from 2200 pounds per acre in favorable years to 1800 pounds per acre in unfavorable years. When range condition deteriorates, sand bluestem, sand reedgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase. Annual weeds and grasses invade the site as range condition becomes poorer. Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass, switch- grass, sideoats grama, blue grama, pubescent wheatgrass and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. For successful seeding, a clean, firm, sorghum stubble-prepared seedbed and grass drill should be used. Early spring seeding has proven most successful. \} Windbreaks and environmental plantings are fairly well suited to this soil. Blowing sand and low available water capacity is the principal hazards to establishing tree and shrubs. (Ernie) Ryberg d/b/a R & R House Movers. By the nature of the business all of the "working end" of the business is conducted off site from the proposed special use permit area, that is at the various locations from which and to which houses are being moved by Mr. Ryberg. Depending upon the fluctuating level of activity in the moving business Mr. Ryberg may employ for short periods of time as many as five (5) employees. However, those employees would be working at locations other than the described special use permit area. Mr. Ryberg is ordinarily the only person regularly using the special use permit area. Mr. Ryberg uses the designated area for storage of dollies (large steel frames with attached axels and wheels on which houses are placed for transporting) , spare tires, varying size, large steel "I" beams, pulleys, railroad ties and assorted other blocks, large jacks, steel hoist frames, and miscellaneous spare parts. Mr. Ryberg also presently has four (4) non-operating truck cabs used for scavenger parts and when not in use parks his two (2) MAC diesel tractor cabs and two ton GMC flat bed tool truck on the special use permit area. A water well drilling rig is also presently parked on the designated area. Mr. Ryberg, in addition to storage, also performs routine maintenance work on the vehicles and equipment at the designated location which maintenance may involve, at very irregular intervals, welding operations. There are no improvements on the designated site. There are two (2) 500 gallon fuel tanks, (one diesel, one regular) on the site. Other than the starting of the trucks and the attendant air pollution and odor, there should be no air, water, odor, or noise imparted. The designated site has direct access to Weld County Road 6, a gravel surfaced road and is within one-half mile of Weld County Road 37, a hard surfaced road. Traffic would consist of no more than a maximum of three (3) trucks in and out once per day and possibly four (4) or five (5) passenger cars in and out per day if employees part there rather than parking at the work site. If this application for a Special Use Permit is approved it is the applicants intention to fence the perimeter of the site to control access.
