HomeMy WebLinkAbout20260433 Record of Proceedings Minutes Board of County Commissioners Weld County, Colorado Monday, March 2, 2026 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado 80631, on March 2, 2026, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Jason S. Maxey, Pro-Tern Commissioner Perry L. Buck Commissioner Lynette Peppier Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Read Ordinances by Audio: Commissioner Buck moved to read the below listed Code Ordinance by audio. The motion was seconded by Commissioner Ross and it carried unanimously. 1. Code Ordinance #2026-06 Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner Ross seconded the motion and it carried unanimously. Presentations and Proclamations: 1 . Windsor Wizards Day, Class 4A All-Girl Cheer State Championship— March 2, 2026: Chair James read the certificate for the record. Caeli Wright, Jayden Warnock, Meridith Geizen, Team Co-Captains, thanked the Board for the recognition, expressed their feelings of privilege and honor to have the opportunity to work so hard alongside their teammates, and further highlighted moments from their winning season. At the request of Chair James, each teammate introduced themselves for the record, including Head Coach, Samantha Murray, and Assistant Coaches Raven Tanner, Hailey Griffin, and Liz Campshetter. In turn, each 2026-0433 BC0016 3/1 / /1_(0 Page 2 Monday, March 2, 2026 www.weld.gov Commissioner extended their congratulations to the team for their victorious season, encourage them to remember the feelings of accomplishment the team earned through their countless hours of dedicated hard work and their commitment to each other, and extended a reminder that the support of their parents and community played a role in the team's success. Upon request of Commissioner Buck, the team performed a short cheer. (Clerk's Note: The group gathered for a photo opportunity.) Warrants: 1. General Warrants: Commissioner Ross moved to approve the General Warrants, as printed. Commissioner Maxey seconded the motion, and upon a roll call vote of four (4) to zero (0), the motion carried with Commissioner Peppler abstained. Bids: 1. Approve Bid #B2500157, Weld County Justice Center Design Services — Facilities Department: Toby Taylor, Purchasing Department, reviewed the selection process and stated staff recommends selecting the lowest bidder who met specifications, Populous, Inc., dba Fentress Studios, for a total amount of $378,000.00 for conceptual programming, drawings, and validation. He further noted all other fees identified in the proposal may be negotiated after the initial awarded scope of work at the complete and sole discretion of the Board. Commissioner Buck moved to approve said bid. The motion was seconded by Commissioner Ross, who further extended his congratulations to the awarded firm, as the nature of the project is complex but he is looking forward to what the team renders, which was echoed by Commissioner Peppler. There being no further discussion, the motion carried unanimously. 2. Approve Bid #B2600003, Hot and Warm Mix Asphalt Supply — Department of Public Works: Mr. Taylor stated staff recommends selecting the lowest bidder who met specifications, Martin Marietta Materials, Inc., for a total amount not to exceed of $7,422,983.00, for both north and south Weld County. Commissioner Maxey moved to approve said bid. The motion was seconded by Commissioner Peppler and it carried unanimously. 3. Approve Bid #B2600004, 2026 Crack Seal Supply — Department of Public Works: Mr. Taylor introduced Maxwell Products, Inc., as the low bidder selected by staff and confirmed they met all specifications at the price of$1 ,160.00, per ton, and a total amount not to exceed $74,240.00. Commissioner Buck moved to approve said bid. The motion was seconded by Commissioner Maxey and it carried unanimously. 2026-0433 BC0016 Page 3 Monday, March 2, 2026 www.weld.gov New Business — General: 1 . Consider Impact Assistance Grant Application for 2025 Payment in Lieu of Taxes (PILT) for State Parks and Wildlife Areas, and Authorize Chair to Sign: Jennifer Oftelie, Budget Manager, explained when the State purchases land for Parks and Recreation through the Conservation Trust Fund, they are obligated to provide annual payment in lieu of taxes (PILT) to counties and schools. She indicated the numbers are provided by the Assessor's Office, and stated for tax year 2025, Weld County can apply to receive monies, in the amount of $7,781 .78, and staff recommends approval. Commissioner Ross moved to approve said application and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. 2. Consider Declaration of Certain Equipment as Surplus Property, Authorize Sale of Same at Auction with Roller and Associates, and Authorize Controller to Sign Any Necessary Documents: Chris D'Ovidio, Controller, stated the equipment identified on Exhibit A are at end-of-life and will be sent to auction being held on March 11, 2026. He indicated replacements are in production and staff recommends approval. Commissioner Maxey moved to approve said declaration of surplus equipment, authorize sale of same at auction, and authorize the Controller to sign any necessary documents. The motion was seconded by Commissioner Peppier and it carried unanimously. 3. Consider License Agreement for Private Lateral Ditch Crossing for High Plains Boulevard (aka County Road 9.5) Improvements Project, Between County Roads 32 and 34, and Authorize Chair to Sign — Allan Carlson: Cameron Parrott, Department of Public Works, stated the ditch is owned by Allan Carlson and is used to fill the Holt Reservoir for irrigation purposes. He explained, as part of the High Plains Boulevard project, between County Roads 32 and 34, the ditch crosses into property owned by Mark and Linda Getman, which the County has already acquired as right-of-way for construction purposes. Mr. Parrott indicated in order to proceed with the project, Mr. Carlson agreed to allow the County access to cross the ditch, for an amount of $10,000.00, which is accounted for in the 2026 budget. Commissioner Buck moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Peppier and it carried unanimously. New Business — Ordinances: 1. First Reading of Code Ordinance #2026-06, In the Matter of Repealing and Reenacting, with Amendments, Chapter 7 Adoption of Miscellaneous Standard Codes of the Weld County Code (Article I — Colorado Wildfire Resiliency Code): Bruce Barker, County Attorney, reviewed the proposed changes to Chapter 7 regarding the Colorado Wildfire Resiliency Code. He recalled the State legislature made a law requiring the creation and use of a State Wildfire Resiliency Code to then be approved and adopted by each local 2026-0433 BC0016 Page 4 Monday, March 2, 2026 www.weld.gov government agency on or before April 1, 2026. He confirmed what is proposed complies with that statute and he recommends approval. There being no public testimony concerning the matter, Commissioner Ross moved to approve Code Ordinance 2026-06 on First Reading. The motion was seconded by Commissioner Maxey and it carried unanimously. New Business — Planning: 1. Consider Acceptance of Request to Withdraw Application for Use by Special Review Permit, USR24-0019, for Uses similar to Organic Composting (Biochar processing), outside of subdivisions and historic townsites in the A (Agricultural) Zone District, and Rescind Resolution #2025-2968, Dated November 5, 2025 — NGL Water Solutions DJ, LLC: Diana Aungst, Department of Planning Services, stated staff received a request from the applicant on February 5, 2026, to withdraw their application for Use by Special Review Permit, USR24-0019, conditionally approved on November 5, 2025. She indicated plans for the property have changed, since approval, thus the applicant does not intend to pursue the permit, and stated staff is supportive of the request. Commissioner Maxey moved to accept said request to withdraw USR24-0019, and rescind Resolution #2025-2968. The motion was seconded by Commissioner Ross and it carried unanimously. 2. Consider Vacation, VAC25-0022, of Use by Special Review Permit, USR-642 — Margaret Vogl: Molly Wright, Department of Planning Services, stated the applicant requested to vacate USR-624, which was recorded March 6, 1985, for a gravel mine. She indicated the permit was never permitted through the Colorado Department of Natural Resources, Division of Reclamation, Mining and Safety (DRMS), nor was the land ever mined; therefore, staff supports the request. Commissioner Buck moved to approve said vacation. The motion was seconded by Commissioner Peppier and it carried unanimously. 3. Consider Vacation, VAC25-0018, of Use by Special Review Permit, USR20-0013 — Jerrilyn Stinar and Margaret Vogl: Ms. Wright stated the applicant requested to vacate USR20-0013, which was recorded November 17, 2020, for a gravel mine. She indicated, in 2020, the property was permitted through DRMS Permit, #M-1998-013AM-03; however, in 2024, there was an acreage reduction to remove the property as it was never mined, therefore, staff supports the request. Commissioner Maxey moved to approve said vacation. The motion was seconded by Commissioner Ross and it carried unanimously. Public Comment: No public comment was offered. However, David Springer, Director of the Department of Fleet Services, introduced Matt Kendall as the new Deputy Director. Mr. Kendall shared a bit of his professional background.
