RE: APPROVAL OF RECORDED EXEMPTION NO. 598 - DOUGLAS B. STEPHENS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 598 , being the property of Douglas
B. Stephens, described as the West ;, Northwest a of Section 15 ,
Township 4 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A" ,
said plat to be recorded, does not come within the purview of
the definition of the terms , "subdivision" and "subdivided land" ,
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973 , as amended.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Douglas B. Stephens be, and hereby is,
exempt from the definition of the terms, "subdivision" and "sub-
divided land" .
BE IT FURTHER RESOLVED that this approval is conditional
upon the applicant submitting a mylar plat to the Department of
Planning Services' Office to be recorded in the office of the
Clerk and Recorder. The plat shall be drawn in accordance with
the requirements of Section 9-2C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within ninety (90) days
from the date of approval by the Board of County Commissioners.

Re: Recorded Exemption #598
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Douglas B. Stephens for a recorded exemption. The parcel of land on which
this request is being made is described as the West 1/2, Northwest 1/4, Section
15, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado.
The property is located approximately 1.5 miles north of Gilcrest on Weld County
Road 31. The property contains approximately 80 acres of Class IIs, IIIe irrigated
and IVe nonirrigated soils.
The request is to divide the property into parcels of 79 acres and 1 acre, more
or less. The intent of this recorded exemption is to create a building site
on a farm so the son may build a 1,500 sq. ft. home and be near daily operations.
Based upon the submitted information and policies of the County, the Department
of Planning Services staff recommends the request be approved for the following
reasons:
1. The request complies with Section 9-2 C. of the
Weld County Subdivision Regulations submission
requirements.
2. The request complies with Section 9-2 E. of the
Subdivision Regulations as follows:

The 80 acres, more or less, under consideration will allow
agricultural and related uses to be the predominant uses.
The uses will be compatible with existing surrounding
agricultural uses. These facts support the proposed as
being consistent with the intent clause of the agricultural
zone district.
- The proposal was reviewed by the Town of Gilcrest and was
found to be compatible with the interests of that town.
The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land division
complies with the Weld County Comprehensive Plan; therefore,
the proposed use is consistent with efficient and orderly
development.
The proposal does not exist in an overlay district area.
The proposed lots meet minimum lot size requirements for
land division.
The Colorado Division of Water Resources has indicated in a
letter dated March 16, 1983, that adequate water service is
available for this proposal.
The proposed lots are not part of a recorded exemption within
the last five (5) years.
The two lots proposed will have adequate access from Weld
County Road 31 and Weld County Road 46.
The Weld County Health Department has indicated, in a letter
dated March 4, 1983, that both lots will have adequate
sewage capacity.
The Department of Planning Services staff's recommendation for approval is con-
ditional upon the applicant submitting a mylar plat to the Department of Planning
Services' office to be recorded in the office of the Clerk and Recorder. The plat
shall be drawn in accordance with the requirements of Section 9-2 C. (4) of the Weld
County Subdivision Regulations. The plat shall be submitted within ninety (90)
days from the date of approval by the Board of County Commissioners.

and outbuildings. There is no slope to the subject site.

To Whom It May Concern :
I am applying for a Recorded Exemption for one acre of land that is
located on a 160 acre farm owned by David Stephens my father . He will
deed the acre of land to me, as my wife and I plan to build a 1500 sq .
foot home , so that I am not commuting back and forth from Gilcrest to
Greeley , since I will farming that farm along with others .
I have spoke with a driller for a well and have also applied for the
permit . As far as the sewage system I plan to put in a septic tank
and leachfield , the soil is sand and gravel so there shouldn ' t be a
problem with the leaching of sewage .
The home will have easy access as the road runs north and south and
will be on the west side of the home . The house will sit at the top
of the farm so flooding should not be a problem.
