RE: APPROVAL OF RECORDED EXEMPTION NO. 663 - LENA SCHLOTTHAUER
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Ruld Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners at a public meeting held in the Chambers of the Board,
that the division into two parcels of land, as shown on the plat
known as Recorded Exemption No. 663 , having been reauested by
Lena Schlotthauer, described as part of the NE4 NEa, Section 22 ,
Township 7 North, Range 67 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A" , said
plat to be recorded, does not come within the purview of the de-
finition of the terms, "subdivision" and "subdivided land" , pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and
WHEREAS , this request is to divide the property into parcels
of 34 . 6 acres and 1 . 3 acres, more or less, allowing the separation
of an existing residential improvement from the balance of the
farm.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land be, and hereby is , exempt from the definition of
the terms "subdivision" and "subdivided land" .
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 18th day of
January, A.D. , 1984 .

Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Lena Schlotthauer for a recorded exemption. The parcel of land on which
this request is being made is described as pt. NE' NE`s, Section 22, T7N, R67W
of the 6th P.M. , Weld County, Colorado.
The property is located three miles north of Severance on WCR 80. The
property contains approximately 36 acres of Class II, III, IV irrigated and IV,
VI nonirrigated soils.
The request is to divide the property into parcels of 34.6 acres and 1.3
acres, more or less. The recorded exemption application would allow the
separation of an existing residential improvement from the balance of the
farm.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The request complies with Section 9-2C. of the Weld County
Subdivision Regulations submission requirements; and
2. The request complies with Section 9-2E. of the Subdivision
Regulations as follows:
- The 36 acres, more or less, under consideration will
be compatible with the existing surrounding land uses and
with future development of the surrounding area as
permitted by the existing agricultural zoning.
- The proposal was reviewed by the city of Severance and was
found to comply with their long-range Comprehensive Plan.

- The proposal is in compliance with Section 1-3 of the Weld
County Subdivision Regulations and the proposed land
division complies with the Weld County Comprehensive Plan.
Therefore, the proposed use is consistent with efficient
and orderly development.
- The proposal does not exist in an overlay district area.
- The proposed lots meet minimum lot size requirements for
land division.
- North Weld County Water District has indicated adequate
water service is available for this proposal.
- The proposed lots are not part of a recorded exemption
within the last five (5) years.
- The two lots proposed will have adequate access from WCR
80.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.
2. The applicant shall submit evidence of an easement allowing lot A
access to Weld County Road 80. The easement document shall be
submitted to the Department of Planning Services within ninety (90) days
from the date of approval by the Board of County Commissioners.

COMMENTS:
The property contains 3 separate sets of improvements on what would be 3 separate lots if the

mobile home is located on the subdivision exemption lot. The property appears to have
been in alfalfa or irrigated pasture. There is a small ditch at the far eastern edge
of the property which runs north and south. There is one access to the three improvements
from County Road 80 which is gravel surfaced. The property slopes to the east and south
from the improvements area. Mature trees and landscaping surround the improvements on
Lots A and B.

RE : Schlotthauer and Gebhart Applications
Gentlemen:
This letter accompanies certain applications by Lena Schlotthauer ,
whom I represent, and certain of her children, for certain exemp-
tions and permits .
Lena Schlotthauer became the sole owner of the Northeast Quarter
of Section 22 , Township 7 North, Range 67 West of the 6th P.M. ,
Weld County, when her husband died in 1979 . In her last will and
testament, Mrs . Schlotthauer has given 40 acres of this quarter-
section to each of her four children. She now has elected to make
gifts by deed to her children at this time during her lifetime
for estate planning purposes and to effect a substantial saving
in probate and administration costs .
This quarter of land has been in the Schlotthauer family for many
years and the respective 40-acre tracts being given to the children
by deed at this time will be used by those children and their res-
pective families for the construction of family homes and for con-
tinued agricultural purposes .

AGREEMENT FOR DRIVEWAY EASEMENT
AGREEMENT made this January 16, 1984, between Lena Schlotthauer,
a single person, (hereinafter Grantor) and Helen Gebhardt and Leon
Gebhardt, as joint tenants, (hereinafter Grantees) , WITNESSETH:
RECITALS
A. The parties have an interest adjoining real estate situated
in Weld County, Colorado, and described as follows :
Grantor is the owner of Lot B of Recorded Exemption
No. 0705-22-1-RE 663, situated in the Northeast
Quarter of the Northeast Quarter (NE/4NE/4) of Sec-
tion 22, Township 7 North, Range 67 West of the 6th
P.M. , Weld County, Colorado.
Grantees are the owners of Lot A of Recorded Exemption
No. 0705-22-1-RE 663, situated in the Northeast
Quarter of the Northeast Quarter (NE/4NE/4) of Sec-
tion 22, Township 7 North, Range 67 West of the 6th
P.M. , Weld County, Colorado.
B. The parties desire to create a common driveway between the
above described adjoining lots owned by them for the benefit of each
of them.
THEREFORE, the parties agree as follows:
1 . An easement for a common driveway in favor of said Lot A,
owned by Grantees, is created over the strip of land described as
follows:
A strip of land fifteen (15) feet wide for road
purposes, more particularly described as:
Beginning at the Northwest Corner of the Northeast
Quarter of the Northeast Quarter of said Section 22;
thence East on the North line of said Northeast Quar-
ter of Northeast Quarter a distance of fifteen (15)
feet; thence South at right angles a distance of
440.67 feet, more or less, to the Southwest Corner of
said Lot A of Recorded Exemption No. 0705-22-1-RE 663;
thence West at right angles a distance of fifteen (15)
feet; thence North at right angles a distance of
440.67 feet, more or less, to the point of beginning;
for the purpose of creating a common driveway fifteen (15) feet in
width for the benefit of both of the above described tracts.
2. This easement is superior and paramount to the rights of any
of the parties hereto in the respective servient estates so created,
and the parties further agree that it is a covenant that shall run
with the land.
