(PVREA) Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Contract for Electric Service Installation and Maintenance of Streetlights for the Roundabout Project at Intersection of County Roads 54 and 13, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Poudre Valley Rural Electric Association, Inc. (PVREA), commencing upon full execution of signatures, with further terms and conditions being as stated in said contract, and Whereas, after review, the Board deems it advisable to approve said contract, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Contract for Electric Service Installation and Maintenance of Streetlights for the Roundabout Project at Intersection of County Roads 54 and 13, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Poudre Valley Rural Electric Association, Inc. (PVREA), be, and hereby is, approved. Be it further resolved by the Board that the Chair Pro-Tem be, and hereby is, authorized to sign said contract. The agreement is for PVREA to procure, install, maintain, and provide electrical service for the CR 54/13 Roundabout streetlights. The agreement was reviewed in a pass around by the BOCC which was returned on February 17, 2025. Four out of five commissioners approved the agreement to be placed on an upcoming BOCC agenda. The agreement is for an amount not to exceed $86,385.18. The County Attorney's office has reviewed and approved the form of the agreement. Public Works has included the cost of the streetlighting in its 2026 budget. I will attend the BOCC meeting to answer any questions the BOCC may have. Sincerely, /4114/14/0 Clay Kimmi Senior Engineer Public Works Department 2026-0395 z/z5 cc100V-I BOARD OF COUNTY COMMISSIONERS PASS-AROUND REVIEW PASS-AROUND TITLE: Intersection Lighting Installation Agreement with Poudre Valley Rural Electric Association (PVREA) on the CR 54/13 Roundabout Project DEPARTMENT: Public Works DATE: February 12, 2025 PERSON REQUESTING: Curtis Hall, Don Dunker, Cameron Parrot, &Clay Kimmi Brief description of the problem/issue: In order to ensure the CR 54/13 roundabout project is safe for nighttime travel, the roundabout has to be lit with street lights. Public Works provided a lighting design for the street lights which showed that light pollution from the street lights will not leave the ROW and will not impact adjacent properties. PVREA has provided a work order showing the cost to install the lighting (see attached work order). The street lighting is expected to be installed in July or August of 2026 prior to the roundabout opening to the public. The agreement has been reviewed by the County Attorney's office and has been approved as to form. What options exist for the Board? 1. The Board can put the Intersection Lighting Agreement on the agenda for consideration at an upcoming hearing. 2. The Board can ask for a work session to obtain more information prior to putting the agreement on the agenda for an upcoming hearing. Consequences: PVREA requires the entire cost of the intersection lighting be paid up front. Once the agreement has been signed and payment has been received, PVREA will start ordering the lighting components. There is an 8 to 12 week lead time for PVREA's contractor to be ready to install the lights. Public Works has budgeted for the Intersection Lighting Agreement costs in its 2026 budget. Impacts: If the agreement is not signed and the costs are not paid, PVREA will not order the street light poles and the associated materials. If the materials are not ordered, the project could be delayed and Public Works will not be able to maintain its current project schedule. Costs(Current Fiscal Year I Ongoing or Subsequent Fiscal Years): The cost for the intersection lighting is estimated to be $86,385.18. Public Works has allocated the cost in the 2026 budget. Ongoing costs are monthly electric bills. The electric bills are estimated to be$2,100/year. Recommendation: Public Works recommends option 1, which is to place the agreement on an upcoming BOCC agenda for approval. Your$14.14/light rate will begin thirty (30) days after the facilities are installed, or when the meter is set. The person(s) signing any contract(s) and or easement(s)grants to the Association the right to ingress and egress for meter readers, tree trimmers, engineers, line personnel, or any agents of the Association for the purpose of reading meters, engineering services, line repair, maintenance, tree trimming, and/or right-of-way clearing as deemed necessary by the Association. GENERAL a. The Applicant will, when electric energy becomes available, purchase from the Association all electric energy used on the premises described below and will pay for at the applicable rates and terms in accordance with the"Schedule of Rates for Electricity and Rules and Regulations"(hereinafter called the Rules and Regulations)as may from time to time be established by the Association. This contract shall continue in force for a minimum number of years as specified in paragraph 4(c)below from the date service is made available hereunder and said contract shall be automatically renewed on a yearly basis until cancelled by at least thirty(30)days written notice given by either party to the other,at the addresses specified herein. b. The minimum monthly or annual charge for electric service,regardless of the kilowatt hours consumed,shall be the higher of the following charges: 1)The minimum specified in the applicable rate schedule. 2)The transformer charge specified in the applicable rate schedule. No agent or representative of the Association has the power to amend,modify,alter,or waive any of the provisions of the terms of this contract. Any promises,agreements,or representations made by any agent or representative of the Association not herein set forth shall be void and of no effect. c. Acceptance of this contract by the Association shall constitute a binding agreement between the Applicant and the Association. This contract will not alter the terms of any other contract between the Applicant and the Association. 2. RESPONSIBILITY a. The Applicant will comply with the Rules and Regulations of the Association. b. Failure on the part of the Applicant to accept service from the Association or to comply with the Rules and Regulations of the Association,or to perform under the terms and conditions of this contract,shall not relieve the Applicant from making all the payments and performing all the conditions set forth in this contract. In the event the applicant becomes delinquent in any payments, the applicant will forfeit all construction deposits therefore made,and the Association shall have the option to declare all of the remainder of the payments due under this contract immediately due and payable. The Association,at its option and without further notice,may remove all or part of the facilities. c. The Association may record this instrument in the office of the County Clerk and Recorder in the County in which the real estate is situated. d. This contract shall be binding upon the successors,legal representatives,heirs,devisees,and assigns of the respective parties hereto. e. The Association shall use reasonable diligence to provide the Applicant with a constant and uninterrupted supply of electric power and energy;but if such supply shall fail or be interrupted or become defective through acts of God,or the public enemy,or by accident,strikes,labor troubles,or by action of elements or inability to secure rights-of-way,or other permits needed,or any other cause beyond reasonable control of the Association,the Association shall not be liable therefor. 3. RIGHTS-OF-WAY a. The Applicant hereby grants and conveys unto the Association the right,privilege,and easement to construct,operate,and maintain the facilities together with right of ingress and egress,including the installation of Association owned locks and/or lock boxes,etc.,as may be necessary to extend,maintain,and operate this service. b. The Applicant hereby gives to the Association without cost or expense,the further right and privilege to cut and trim any trees or shrubbery near said overhead lines of the Association,so that adequate and proper service may be extended hereunder. c. The Applicant further agrees to assist in obtaining needed rights-of-way that may be required to provide service hereunder. d. The Applicant acknowledges that he/she has been instructed to disclose locations of underground obstructions. Except as may be prohibited by law,the Applicant agrees to indemnify the Association against loss or damage to underground property of the Applicant or to underground property of others on the Applicant's property. The Association will use reasonable care in locating and digging holes or trenches for poles,anchors,or under-ground service but will not be responsible for damage to sewers,water lines,or other underground facilities if the exact location of such underground property cannot be determined before construction begins. 4. CONTRACT PROVISIONS a All financial obligations of Applicant that extend beyond the current fiscal year are subject to annual appropriations. b. Service will be rendered at the Association's standard voltage. The Association's meter shall constitute the point of delivery to the Applicant and the Applicant will own and maintain all poles, wires,equipment,and other facilities beyond the point of delivery. c.
