A public hearing was conducted on February 18, 2026, at 10:00 a.m., with the following
present:
Commissioner Scott K. James, Chair
Commissioner Jason S. Maxey, Pro-Tern
Commissioner Perry. L. Buck
Commissioner Lynette Peppier— Excused
Commissioner Kevin D. Ross
Also present:
Acting Clerk to the Board, Jess Reid

The following business was transacted:
I hereby certify that pursuant to a Notice dated November 13, 2025, and duly published
November 15, 2025, in the Greeley Tribune, a public hearing was conducted on
December17, 2025, to consider the request of WETCO WCR 49 HWY 34, LLC, for. Use
by Special Review Permit, USR25-0011, for Open Mining (topsoil) outside of subdivisions
and historic townsites in the A (Agricultural) Zone District. At said hearing the Board
continued the matter to February 18, 2026, to allow the case to be heard by the Planning
Commission on February 3, 3026. Karin McDougal, Deputy County Attorney, made this
a matter of record.
Angela Snyder, Department of Planning Services, stated this case, at the February 3,
2026, Planning Commission hearing, was continued to April 7, 2026. She requested the
Board of County Commissioners' hearing be continued to April 22, 2026, to allow the case
to be heard by the Planning Commission.
No public testimony was offered concerning this matter.
Commissioner Maxey moved to continue the matter to April 22, 2026, at 10:00 a.m., to
allow the case to be heard by the Planning Commission on April 7, 2026. The motion was
seconded by Commissioner Ross, it carried unanimously, and the hearing was adjourned.
