WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 11th day of January, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of Valley Energy, Inc . , 7955 East Arapa- hoe Court, Englewood, Colorado 80112 , for a Use by Special Re- view for a natural gas processing plant on the following de- scribed real estate, to-wit: Part of the SWa, Section 25 , Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in the matter, and having been fully informed, finds that this request shall be approved for the following reasons; 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Weld County Comprehensive Plan. b. The proposal is consistent with the intent of the "A" (Agricultural) Zone District in which it is located. c. The uses that would be maintained will be compa- tible with the existing surrounding land uses and with future development of the surrounding area as projected by the Comprehensive Plans of Evans and Greeley. NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application for a Use by Special Review for a natural gas processing plant on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . No building or electrical permits shall be issued for the Use by Special Review Permit area until the Stand- ards for the Use by Special Review have been placed on the Use by Special Review plat and the plat has been delivered to the Department of Planning Services Office. The uses permitted shall be a natural gas processing facility as described in the application materials on file with the Department of Planning Services. 2. A six (6) foot chain link fence, topped with three strands of barbed wire, shall enclose the Use by Special Review area. 3. An air emissions permit for the facility must be obtained from the Air Pollution Control Division, Colorado Department of Health, 4210 East 11th Avenue, Denver, CO 80220. 4. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 5. The site is situated on soils that are susceptible to wind erosion when the soil surface is not adequately protected. The entire subject site shall be covered by either gravel or a vegetative cover, as recommended by the Soil Conservation Service, to prevent wind erosion. Said subject site shall be restored to its original condition by the operator and/or owner upon cessation of the prescribed natural gas processing facility. 6. The Use by Special Review area shall be limited to two (2) access points as shown on the application materials on file with the Department of Planning Services. 7. Construction of a flare pit shall be prohibited in the Use by Special Review area. 8. Liquified petroleum gases (LPG) is considered a hazardous substance per C.R.S. 29-22-107(2) (a) . Prior to the issuance of building permits, the applicant shall list the maximum quantity of LPG expected at the site with the State Health Department, Division of Waste Management and with the Weld County Emergency Response Coordinator. Evidence of this listing shall be provided to the Department of Planning Services prior to the issuance of building permits. 9. The storage tank located in the southwest corner of the property shall be set back a minimum of one hundred (100) feet from the centerline of Weld County Road 52 and fifty (50) feet from the west property line to comply with the Greeley Fire Code Separation Standards. 10. Within thirty (30) days after final approval by the Weld County Building Department, or after the plant is on line, the LaSalle Fire Protection District shall be contacted and invited to attend instructional training and meetings concerning shutdown and fire control at the plant site. A key allowing access to the said site shall be delivered to a representative of the La Salle Fire Protection District. 11. The proposal shall comply with all City of Evans Ordinances pertaining to truck traffic. 12. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 13. The applicant shall comply with the Operation Standards for Uses by Special. Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. OPERATION STANDARDS Valley Energy, Inc. Representatives or members of the Weld County Health Department and Weld County "Department of Planning Services shall be granted access onto the -site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 15. The Use by Special Review shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County -Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the -approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the Permit by the Board of County Commissioners. Lee MDrrison, Assistant County Attorney, read the request into the record. Jim Mayerl, representing the Planning Department, read the favorable recommendation of the Manning Commission into the record. Ron Barcroft, representing Valley Energy, Inc. , spoke on the safety features of this type of plant. He stated that the applicant had no problems with the proposed Operation Stand- ards. Fig Ishiguro questioned the traffic pattern for trucks using this plant. He was assured that trucks leaving the facility will head West. After further discussion, Commissioner C.Carlson movedto approve this request for a Use by Special Review for Valley Energy, Inc. , with the Operation Standards as proposed. The motion, which was seconded by Commissioner Martin, carried unanimously. There is no doubt that natural gas processing plants are a natural part of the continuing development of our area's oil and gas resources. Practical aspects of the specific site tieing considered for a gas plant are summarized herein. The use is consistent with the district it is located inasmuch as the use is considered agri-business. Further, it is a practical use for the land area. This land has never been cultivated. The specific property has slope and soil constraints which make farming operations impossible. The processing plant will be located on one of the few level areas of the total property owned by applicant. South of the site are the Hill N' Park Sanitation District Sewage Lagoons. To the North, are the KFKA transmitting towers. The site lies just above the South Platte River flood plain. Development in the area will probably be limited for several more years. In the general vicinity, there are junk yards and several small older homes, some being vacant. Lower median priced homes are located approximately one-half mile further West. Public utility mains have limited capacity effectively precluding any major development until services are upgraded. The proposed use requires no domestic or raw water service. In view of flood plain considerations eventual development can only be North and West of the site in any event. Ultimately, this area will be a part of Evans. The site fronts on 49th Street which is currently an agricultural and industrial arterial feeding off U.S. #85 in Evans. While most industrial traffic does not currently flow as far West as the site, it is reasonable to assume that the industrial developments along U.S. #85 will expand Westerly in the future. Practically speaking, the gas plant will be serviced once or twice daily by a single truck and will therefore have a minimal impact on traffic counts or road usage. The site is not located within one of the "overlay districts" of Weld County. Specifics of the gas plant's operations are enclosed herewith. • The following is submitted in- response to Section 5.a.-o. of The Procedural Guide for Use by Special Review Application: 5.a. The proposed use is a natural gas processing facility to prepare natural gas produced from wells in the vicinity for delivery to Greeley Gas Company for subsequent consumption by consumers. In the process of treating the natural gas, water and hydrocarbon liquids such as propane and butane will be removed from the gas stream to meet the required specifications of Greeley Gas Company. b. Refer to location map for location of residential structures. c. The facilities will be operated 24 hours per day, 350 days per year. Instrumentation and controls are provided to operate the facilities automatically requiring only routine maintenance and operating checks by Valley personnel. Structures will consist of 15' x 25' metal utility building, three skid mounted processing units approximately 10' x 30' , and one 8' Diameter x 40' long product storage tank. All processing equipment will be mounted on concrete piers. The equipment will be enclosed by a 6 foot high chaib link fence with three strands of barbed wire on top. h. Operating personnel will travel to the site daily by pick up. Product will be removed by tank truck (maximum weight 80,000 lbs. ) on an average of once per day. i. None j . None k. None 1. The construction of the facility will start on receipt of use by special review permit and will require four to five weeks to complete. m. Special landscaping is not required. n. After abandonment of the facilities, all equipment and material will be removed from the site and the land will be placed back into the same condition as it is currently. o. The facility will be equipped with suitable fire fighting equipment and the plant operators will be trained in its use. The plant controls will be designed to automatically shutdown the facilities in the event of fire and to notify the plant operator and the local fire department. During the training of the operators, the local fire department personnel will be invited to observe the training and the equipment available.
