Resolution Approve Bargain and Sale Deed for Property Conveyance Resulting from County Road 41 and State Highway 52 Intersection Improvements Project, and Authorize Chair to Sign Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Bargain and Sale Deed for Property Conveyance Resulting from the County Road 41 and State Highway 52 Intersection Improvements Project from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to the Colorado Department of Transportation, commencing upon full execution of signatures, with further terms and conditions being as stated in said deed, and Whereas, after review, the Board deems it advisable to approve said deed, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Bargain and Sale Deed for Property Conveyance Resulting from the County Road 41 and State Highway 52 Intersection Improvements Project from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to the Colorado Department of Transportation, be, and hereby is, approved. Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign said deed. The Board of County Commissioners of Weld County, Colorado, approved the above and foregoing Resolution, on motion duly made and seconded, by the following vote on the 11th day of February, A.D., 2026: [Insert Resolution Attestation Block Post Meeting] 2026-0310 EG0084 BOARD OF COUNTY COMMISSIONERS PASS-AROUND REVIEW PASS-AROUND TITLE: Bargain and Sale Deed to Convey Property to Colorado Department of Transportation (CDOT) (WCR 41 / SH 52 Intersection Improvements) DEPARTMENT: Public Works DATE: 02/03/2026 PERSON REQUESTING: Erich Green/Don Dunker/Curtis Hall Brief description of the problem/issue: Northeast of the recently improved intersection of WCR 41 / SH 52, a small remnant piece of property (261 square feet) needs conveyed from Weld County to CDOT. This piece of property adjoins existing SH 52 right-of- way, and the transfer will help to create clear CDOT maintenance responsibilities near the outlet of a storm culvert installed with the intersection improvements. The conveyance form has been reviewed by the Weld County Attorney's Office and is also acceptable to CDOT staff. What options exist for the Board? 1. Allow the Bargain and Sale Deed to be placed on the next available BOCC Agenda. 2. Request a work session and additional information. Consequences: If the Bargain and Sale Deed is not placed on the BOCC Agenda and approved for signature, continuation of Weld County ownership may create unclear maintenance responsibilities between Weld County and CDOT in the subject area. Impacts: This property conveyance may save future questions, coordination with CDOT, and Weld County staff time if allowed to proceed. Costs(Current Fiscal Year/Ongoing or Subsequent Fiscal Years): There is no cost or compensation for this land conveyance. Recommendation: Public Works staff recommends placing the Bargain and Sale Deed on the next available BOCC Agenda for consideration.
