HomeMy WebLinkAbout20260305 Resolution Approve Memorandum of Understanding for Kinship, Foster, and Adoptive Parent Pre-Certification Training Requirements, and Authorize Chair to Sign - Project 1.27 Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, the Board has been presented with a Memorandum of Understanding for Kinship, Foster, and Adoptive Parent Pre-Certification Training Requirements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Project 1.27, commencing upon full execution of signatures, with further terms and conditions being as stated in said memorandum of understanding, and Whereas, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for Kinship, Foster, and Adoptive Parent Pre-Certification Training Requirements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, and Project 1.27, be, and hereby is, approved. Be it further resolved by the Board that the Chair be, and hereby is, authorized to sign said memorandum of understanding. On December 16, 2024, the Board approved Amendment #1, extending the term date through January 31, 2026, known to the Board as Document ID# 2023- 3675. The Department is now requesting Board approval of a Memorandum of Understanding which is effective as of the date of the last signature and will remain in effect for a period of two (2) years, unless terminated earlier by either party. This MOU may be amended at any time by mutual written agreement of both parties. Sincerely, Jamie Ulrich, Director 2026-0305 Memorandum of Understanding For Foster and Adoptive Family Requirements Between Project 1.27 and Weld County Department of Human Services Parties agree to: 1. Information meetings: Project 1.27's foster care informational meetings meet the requirements of the State of Colorado and Project 1.27. This time also includes a one-on- one interview with prospective foster parents. 2. Kinship, Foster and Adoptive Parent Training: In compliance with the Colorado Child Welfare Caregiver Certification Program all competencies will be met. Each Project 1.27 family will complete the following training provided by Project 1.27 staff using the National Training and Development Center (NTDC) model. 1) Project 1.27 Information meeting 1 2) Interview with Case manager 1 3) NTDC Pre-certification I 12 4) NTDC Pre-certification II 12 5) NTDC Pre-certification III 4 ,30 hours Families are made aware of additional state-required training not provided by Project 1.27. 1) CPR and First Aid 8 2) Reasonable and Prudent Parenting (web-based) 0.5 3) Mandatory Reporting (web-based) 2 4) Safe Sleep (web-based) 0.5 11 hours Total training hours 41 Project 1.27 provides NTDC Certification Training, which is the preferred foster parent curriculum of the Colorado Department of Child Welfare (CDHS). This training meets all MOU updated 01/2026 by Weld County Department of Human Services requirements and is approved by CDHS. Project 1.27 training will be conducted in a church host facility and may be monitored by the Agency. 3. Families Transitioning to the Agency: Project 1.27 will provide training certificates to the family's certification agency and place a copy in the family's Project 1.27 electronic file. 4. Child Placement Process: The goal of the Agency is to make the best match for each child. That decision is made by The Department of Human Services staff, attorneys and ultimately the Court. 5. Information Sharing: Project 1.27 families and staff may share limited case information in the process of recruitment and providing on-going support. 6. Entire Agreement: This MOU contains the entire agreement and understanding between the parties with respect to the subject matter hereof and may not be changed or modified except as stated herein. This MOU shall be binding upon the parties hereto, their successors, heirs, legal representatives, and assigns. Contractor and the Agency may not assign any of its rights or obligations hereunder without the prior consent of both parties. 7. No Third-Party Beneficiary: It is expressly understood and agreed that the enforcement of the terms and conditions of this MOU, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this MOU shall give or allow any claim or right of action whatsoever by any other person not included in this MOU. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this MOU shall be an incidental beneficiary only. 8. Governmental Immunity: No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act §§24-10- 101 et seq., as applicable now or hereafter amended. 9. Independent Contractor: Contractor agrees that it is an Independent Contractor and that the Contractor's officers, agents or employees will not become employees of the Agency, nor entitled to any employee benefits from the Agency as a result of the execution of this MOU. Contractor shall perform its duties hereunder as an Independent Contractor. Contractor shall be solely responsible for its acts and those of its agents and employees for all acts performed pursuant to this MOU. Contractor, its employees and agents are not entitled to unemployment insurance or workers' MOU updated 01/2026 by Weld County Department of Human Services compensation benefits through the Agency and the Agency shall not pay for or otherwise provide such coverage for Contractor or any of its agents or employees. Unemployment insurance benefits will be available to Contractor and its employees and agents only if such coverage is made available by Contractor or a third party. Contractor shall pay when due all applicable employment taxes and income taxes and local head taxes (if applicable) incurred pursuant to this MOU. 10. Severability: If any term or condition of this MOU shall be held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, this MOU shall be construed and enforced without such provision, to the extent that this MOU is then capable of execution within the original intent of the parties. 11. Term: This MOU is effective as of the date of the last signature and will remain in effect for a period of two (2) years, unless terminated earlier by either party. This MOU may be amended at any time by mutual written agreement of both parties.
