HomeMy WebLinkAbout20260256 Record of Proceedings Minutes Board of County Commissioners Weld County, Colorado Monday, February 9, 2026 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado 80631 , on February 9, 2026, at the hour of 9:00 a.m. Roll Call: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Jason S. Maxey, Pro-Tem Commissioner Perry L. Buck Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppier seconded the motion and it carried unanimously. 1. Minutes from January 26, 2026 Read Ordinances by Audio: Commissioner Ross moved to read the below listed Code Ordinance by audio. The motion was seconded by Commissioner Buck and it carried unanimously. 1. Code Ordinance #2026-03 Certification of Hearings: Commissioner Maxey moved to approve the below listed Hearing Certificate. Commissioner Buck seconded the motion, which carried unanimously. 1 . PCSC25-0014 — Santos Vega and Luz Yadira Vega Amendments to Agenda: There were no amendments to the Agenda. 2026-0256 BC0016 Page 2 Monday, February 9, 2026 www.weld.gov Consent Agenda: Commissioner Ross moved to approve the Consent Agenda, as printed. Commissioner Peppier seconded the motion and it carried unanimously. Warrants: 1. General Warrants: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner Peppier seconded the motion and it carried unanimously. New Business — General: 1. Consider Appointment of Caleb Sulzen as Chief Building Official of Weld County Department of Planning Services: Caleb Sulzen, Department of Planning Services, shared his previous work history conducting inspections for different jurisdictions since 2004, stated he has, or is currently, serving on numerous committees over the course of the past 22 years, and he expressed his excitement to bring his expertise to Weld County. Commissioner Buck moved to approve said appointment. The motion was seconded by Commissioner Ross and it carried unanimously. 2. Consider Contract ID #10334 Memorandum of Agreement to Purchase Property Interest for Acquisition of Temporary Construction Easement for Galeton Drainage Improvements Project on County Road 74, Between Grandview Avenue and County Road 51, and Authorize Chair to Sign All Necessary Documents — Mojack Enterprises, LLC: Val Mino, Department of Public Works, stated the agreement allows for the County to purchase 1,574 square feet of Temporary Construction Easement (TCE), in the amount of $2,457.00, for improvements related to the Galeton Drainage Project. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign all necessary documents. The motion was seconded by Commissioner Buck and it carried unanimously. 3. Consider Contract ID #10337 Memorandum of Agreement for Purchase of Property Interest for Acquisition of Public Road Right-of-Way for Galeton Drainage Improvements Project on County Road 74, Between Grandview Avenue and County Road 51, Accept Property Conveyance of Same, and Authorize Chair to Sign All Necessary Documents — Dual Doc Farms, LLC: Ms. Mino stated, similar to the previous item of business, the agreement allows for the County to purchase 0.155 acres of right-of-way (ROW), in the amount of $1,560.00, for improvements related to the Galeton Drainage Project. Commissioner Ross moved to approve said agreement, accept conveyance of property, and authorize the Chair to sign all necessary documents. The motion was seconded by Commissioner Peppier and it carried unanimously. 2026-0256 BC0016 Page 3 Monday, February 9, 2026 www.weld.gov New Business — Ordinances: 1. Second Reading of Code Ordinance #2026-01, In the Matter of Repealing and Reenacting, with Amendments, Chapter 23 Zoning of the Weld County Code (Data Centers): Commissioner Maxey moved to read Code Ordinance #2026-01 by title only. The motion was seconded by Commissioner Ross and it carried unanimously. Bruce Barker, County Attorney, read the title for the record. Maxwell Nader, Department of Planning Services, reviewed the proposed changes regarding zone requirements related to data centers, stated there have been no additional changes since First Reading, and indicated staff recommends approval. Ken Brown, Town of Windsor resident, introduced himself as a real estate expert for more than 15 years, with his focus being heavily influenced by local, state, and federal zoning and license requirements. He expressed his concerns surrounding the proposed location of data centers being allowed in the I-1 (Light Industrial) Zone District, and stated the standards for development for the data center process should be limited to the 1-2 (Heavy Industrial) Zone District. Mr. Brown supported his concern based on careful consideration of the loud noise generated, the amount of energy and resources these massive tech driven businesses consume, and the health impacts that are just now coming to light from other locations throughout the nation. There being no further public testimony, Commissioner Ross moved to approve Code Ordinance #2026-01 on Second Reading. The motion was seconded by Commissioner Maxey. Chair James, Commissioner Buck, and Commissioner Maxey extended their appreciation to Mr. Brown and encouraged him to communicate with Mr. Nader and David Eisenbraun, Director of the Department of Planning Services, for any concerns that specifically impact the Water Valley area. There being no further discussion, the motion carried unanimously. 2. First Reading of Code Ordinance #2026-03, In the Matter of Repealing and Reenacting, with Amendments, Chapter 2 Administration of the Weld County Code (Article XVI — Emergency Management): Roy Rudisill, Director of the Office of Emergency Management, provided an overview of the proposed changes to Chapter 2 regarding Article XVI for administration of emergency management services. He elaborated Section 2-16-10 of the Weld County Code adds and clarifies the definitions of emergency operations such as epidemic, mitigation, preparedness and prevention. Mr. Rudisill highlighted the Emergency Management Director is also the director of the local Emergency Planning Committee, detailed responsibilities related to the collection of Tier II reports to help mitigate hazards, and stated staff recommends approval. There being no public testimony concerning the matter, Commissioner Maxey moved to approve Code Ordinance #2026-03 on First Reading. The motion was seconded by Commissioner Peppier and it carried unanimously. 2026-0256 BC0016 Page 4 Monday, February 9, 2026 www.weld.gov New Business — Planning: 1 . Consider Request to Extend Time to Record Map for Use by Special Review Permit, USR25-0014 — Lembke Family Preserve, LLC: Molly Wright, Department of Planning Services, stated staff received a request from the Denver Zoo (applicant) for extension to April 22, 2026, to record the USR map, which was conditionally approved on September 24, 2025. She explained the applicants are actively working on revising their USR plans and Drainage Report per staff's direction, and stated staff is supportive of the extension request and recommends approval. Commissioner Maxey moved to approve said request for extension. The motion was seconded by Commissioner Ross and it carried unanimously. Public Comment: No public comment was offered. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
