Resolution Approve Filing of Proceedings in Eminent Domain, Pursuant to C.R.S. §38-1-101, Against Steven Viscariello Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, Weld. County is in need of acquiring property for the High Plains Boulevard roadway, in a portion of Section 14, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado, as more fully described and depicted in the attached Exhibits, and • Exhibit A, Legal Description and Depiction of Right-of-Way (RW-4) and Permanent Slope Easement (PE-4) Whereas, in an appraisal prepared by Titan Appraisal, Certified Appraiser hired by Steven Viscariello, the value of parcel RW-4 is $38,638.00, the value of PE-4 is $22,488.00, and damages in the amount of$57,644.00, for a total of$118,769.00, and Whereas, said Property is owned by Steven Viscariello, and Whereas, negotiations with the Property Owner have included multiple phone calls, emails and letters from John Doty, Acquisitions Agent for Western States Land Services (on behalf of Weld County), to Steven Viscariello, Whereas, Weld.County has made multiple offers to purchase the property, with a final offer made on September 22, 2025, for $38,600.00 for RW-4, $22,500.00 for PE-4, $18,400.00 incentive, $57,600.00 for damages and $68,720.00 for a privacy fence for a total compensation of$205,820.00. Whereas, the County and the Property Owner have attempted to negotiate compensation, but to date, the parties have been unable to reach an agreement for the purchase of said Property, and Whereas, the purpose of High Plains Boulevard is to create a crucial north-south alternative to Interstate 25 in Northern Colorado, enhancing regional connectivity, easing traffic congestion, and supporting future population and economic growth, especially around areas like Mead and Johnstown. Whereas, the High Plains Boulevard project has been on the Capital Improvement Project (CIP) list since November 2022. Whereas, the Board finds that the High Plains Boulevard project is needed to further a necessary public use and that this property is an integral part of that project which cannot be completed without the acquisition of the necessary right-of-way and easements. Now, therefore, be it resolved by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to file a proceeding in eminent domain, pursuant to C.R.S. §38-1-101 et. seq., against Steven Viscariello, in the Weld District Court to acquire the Property described and depicted in the attached Exhibits. Be it further resolved by the Board that the acquisition of such Property is deemed necessary for the health, safety and welfare of the citizens of Weld County, Colorado. Be it further resolved by the Board that the Controller shall cause to be paid $205,820.00 into the Registry of the Court, being the amount that Weld County estimates is the appropriate value of the property, including all damages, for the purpose of acquiring the aforementioned Property upon the filing of a motion for possession of the Property, or if in conjunction with a joint and stipulated motion for immediate possession or a stipulated Rule and Order, payment may be made to Respondent as an alternative to depositing such sums into the Registry of the Court. I introduced myself, explained my role in the project John Doty and suggested that the County would like to schedule a meeting sometime in the near future. I asked him to (JD) call me back so we could discuss the project and any impacts to his property in more detail. 8/27/24 I spoke with Steven briefly about the project and explained that the County would like to meet soon to (JD) review the current plans in person. Steven was happy to meet and just asked that I reach out in advance to coordinate. He confirmed that he prefers communicating by phone over email. 9/17/24 I corresponded with Steven via text message today and confirmed a meeting with myself and the County for (JD) next Tuesday (9/24) at 3:45. 9/24/24 I met with Steven at his property, Cameron Parrott with the County was there as were representatives from (JD) Kraemer and RMS. We shared the updated plans with Steven and discussed the acquisition process. Steven is very familiar with the project in general but stated that the plans have changed since he last saw them. He mentioned that he was originally under the impression the County was going to purchase his entire property and relocate him. The current plan to only acquire the property necessary for the construction of the project seems more impactful to him. He stated his concerns with impacts to his remaining property, he talked about the noise, loss of storage, loss of hunting and several other property impacts. He made it seem as though he would work with us although it was clear he would still prefer to sell the entire property. We left it with him that the team still needs to advance the current plans before we acquired the ROW but we would be back in touch when we were read to do a••raisals and start the ac•uisition 'rocess. 12/27/24 I sent a Notice of Intent to Acquire Property for the purchase of right of way and permanent easement for the (JD) construction of High Plains Boulevard. I sent the package via US Mail, Priority Mail w/Tracking. Notice included: 1. Right of Way Exhibit 2. Legal Descriptions 3. Colorado Revised Statues Section 38-1-121 4. Minimum Appraisal Guidelines 1/23/25 I spoke with Steven to discuss the NOI letter, he said he never received it in the mail so I offered to hand (JD) deliver a copy later today. I explained what was in the letter and talked through the next steps of getting an appraisal and then presenting an offer. I let him know he can get his own appraisal if he chooses which it sounds like he will. I stopped by his house and left a packet inside his screen door. I sent him a text message letting him know where I left it. 1/27/25 I sent a text message to Steven letting him know the County plans to have the ROW staked later this week (JD) and that we would follow up to schedule the appraisal inspection. 2/4/25 Steven and I corresponded via text to coordinate the appraisal inspection for 2/11. (JD) 2/11/25 Today we met onsite for the appraisal inspection. We reviewed the staking with the County's appraiser, Jon (JD) Vaughan. Steven mentioned some of his concerns and had some questions for Jon regarding the process and what types of items would be considered in the appraisal. 3/31/25 I received the appraisal for Steven prepared by Andre Suissa on 3/26 and today I received the appraisal (JD) prepared for the County by Jon Vaughan. Suissa's report came in at $105,475 and Vaughan's report was $63,350. 4/14/25 The County has identified the need to increase the permanent easement on Steven's property to help with (JD) site triangle issues. If Steven utilizes his remaining property up to the currently proposed ROW line it could create visibility issues for traffic rounding the corner. We notified Steven and the appraisers and asked them to update their reports with the revised legal descriptions for the additional slope easement. 4/26/25 I received the revised appraisal drafts from Suissa and Vaughan, these reports include the additional slope (JD) easement to accommodate the site triangle on Steven's property. Suissa's updated number is $118,769 and Vaughan's updated number is $70,250 6/3/25 Today I mailed a revised NOI and Offer to Purchase Letter to Steven Viscariello with an updated legal Page 2 of 4 (JD) description for permanent slope easement. The letter also contained an offer in the amount of$118,700 for the property and an additional $18,400 as an incentive or a total of$137,100 provided he accepts by no later than July 3, 2025. The Offer package included: 1. Right of Way Exhibit 2. Memorandum of Agreement with Exhibit(s) attached) 3. Deed of Dedication 4. Permanent Slope Easement 5. Legal Descriptions 6. CRS 38-1-121 7. Minimum Appraisal Guidelines 8. Possession and Use Agreement 9. W-9 tax identification form 6/13/25 I left a message for Steven following up on the offer letter. (JD) 6/16/25 I spoke with Steven over the phone he was reviewing the offer and said he would get back to me with (JD) comments. He said he was looking to get an estimate to provide a wall or some sort of screening and would share that with me as soon as he has it. 6/18/25 I spoke with Steven after he had reviewed the offer packet, he asked if the County could stake the (JD) permanent easement so he can see what it looks like in the field. I made that request and asked for feedback on the offer. Steven feels it's low, he thinks there should be compensation for the impact to his property, he is thinking the County should install a berm or fence or something to help with the visual and sound impacts. He wants to meet and look at the stakes when they are set. 6/20/25 Steven sent me an email with a proposed berm layout. It included an estimate to install trees and shrubs to (JD) help screen the highway. The total cost of the estimate was just under $400,000 which would be in addition to the compensation offered for the easements. 6/24/25 I met with the County and Kraemer team on site to review the new staking with Steven. He was surprised to (JD) see how far into his property the new stakes go, he feels this is an even bigger impact than he was anticipating and expressed his concern for the remaining property. He is going to lose some of his garden, parking and he again mentioned hunting and a few other uses. The team acknowledged his concerns and committed to looking at mitigation options but couldn't commit to anything at this time. He believes his berm and plantings are reasonable but the County would like to look at some other options such as a fence or other type of screening. 7/30/25 I forwarded an email to Steven with an alternative wall proposal. The email provided a link to some wall (JD) materials that the County believes would be suitable in place of the berm and plantings Steven had proposed. 8/6/25 Steven sent over a wall estimate of his own, he reached out to a contractor and got a proposal in the amount (JD) of$219,000 to install a large 12' tall wall around three sides of his property. 8/14/25 I called and left Steve a voicemail to let him know the County doesn't believe the measurements on his (JD) estimate are accurate or necessary. I followed up with an email and a snip showing the dimensions the County believes should have been included in the estimate. 8/19/25 Steven and I spoke by phone, he still believes his proposed wall is necessary. He thinks it is a compromise at (JD) this point and the wall materials the County is proposing would not be sufficient. I let him know I would continue to discuss with the County and let him know what they are willing to agree to. 9/22/25 I mailed a Final Offer letter via Certified Mail, return receipt requested. The letter contained a final offer in (JD) the amount of$205,820 which included an additional $68,721 to pay for a privacy fence as calculated by the County. The letter included an acceptance deadline of October 8,2025 and the following documents: 1. Memorandum of Agreement 2. Deed of Dedication 3. Slope Easement 4. Legal Descriptions 5. W-9 form 9/24/25 I emailed a scanned copy of the final offer letter to Steven and asked him to let me know of any questions or (JD) comments. 10/1/25 Steven replied to my email and stated that he had not yet received the hard copy of the final offer letter. I (JD) told him I would hand deliver a copy to his house tomorrow. _ 10/2/25 I hand delivered a copy of the final offer letter to Steven's house. (JD) Page 3 of 4 10/20/25 I sent a follow up email to Steven with a breakdown of the additional $68,721 the County has offered for the (JD) privacy fence. I provided a link to the materials website again. I also mentioned that I had a conversation with his appraiser and asked if Steven has had a chance to talk with Andre recently regarding the additional compensation he is requesting. 10/21/25 I spoke with Steven over the phone, he doesn't believe the County's estimate would allow him to build a (JD) fence that would mitigate his concerns. He still believes the wall estimate he obtained is reasonable and necessary. We talked more about next steps. I told him I would continue working with the County but since we are beyond the acceptance deadline in the final offer, it was my understanding the County may choose to initiate condemnation to move things forward. He said he would discuss his options with an attorney but did hope to reach a mutual agreement. I suggested he also speak with Andre to get his opinion on the wall/fence situation. 10/31/25 I spoke with Steven over the phone, he had talked to Andre and let me know Andre recommended he try and (JD) settle with the County. Apparently Andre didn't support the claim for the wall and reminded him that he would testify in court base don his appraised value. Steven said he still doesn't believe the offer is fair. We talked briefly about the option of purchasing the entire property, I told him I could ask the County if that was still an option at all but asked Steven to come up with a counter offer to the County's final offer if he would like to take one last shot at getting to an mutual agreement. We agreed to talk early next week. 11/3/25 I spoke with Steven again, he said he and his wife discussed the buyout option and thought they would need (JD) at least $1.1M to replace the current property. I told him I would share that with the County and asked what their bottom line on the partial acquisition was. Steven told me the lowest they would be willing to accept is $500,000 for the ROW and PE. I let him know I would share that with the County and let him know if they were wilting to accept.
