RE: APPROVAL OF RECORDED EXEMPTION NO. 437 - ULLMAN FARMS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 9th day of January, 1980 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 437, being the property of Ullman Farms, described
as part of Section 6, Township 3 North, Range 67 West of the
6th P.M. , Weld County, Colorado, being more particularly described
as follows :
The N1 of Section 6, Township 3 North,
Range 67 West of the 6th P.M. , Weld
County, Colorado;
EXCEPTING therefrom that parcel as con-
veyed to Benjamin Bowles by Warranty
Deed dated April 16, 1898 and recorded
December 6, 1898 in Book 155 at Page 502;
ALSO EXCEPTING that parcel of land as
conveyed to Charles J. Campbell by
Warranty Deed dated January 1, 1901 and
recorded January 7 , 1901 in Book 181
at Page 409;
ALSO EXCEPTING that parcel of land as
conveyed to Robert L. Martin, William
E. Worman and Jasper N. Bowles by Quit
Claim Deed dated February 12, 1902 and
recorded March 17 , 1902 in Book 163 at
Page 125;
ALSO EXCEPTING that parcel of land as
conveyed to the Miantenoma Reservoir
Company by Warranty Deed dated September
4 , 1908 and recorded March 2, 1909 in
Book 292 at Page 515;
ALSO EXCEPTING all that part as conveyed
to Jacob A. Rinn and Ruth E. Core by
Quit Claim Deed, dated November 19 , 1904
and recorded December 2, 1904 in Book 212
at Page 49 .
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and

WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Ullman Farms be, and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 9th day of
January, A.D. , 1980 .

RE: Recorded Exemption #437
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Ullman Farms, a partnership, for a recorded exemption.
The parcel of land on which this request has been made is described as
the N1 of Section 6, T3N, R67W of the 6th p.m. , Weld County, Colorado.
This property is located 3 miles east and 2 miles north of Mead. The
property contains approximately 274. 874 acres of Class II and III
irrigated soils. The request is to split the property into parcels of
8. 874 acres and 266 acres.
The applicant has contracted to sell the property to Lois E. Booth.
The property is being purchased by Mrs . Booth as a source of feed for
a cattle feeding operation in the vicinity owned by the Booths. The
farms will be farmed by tenant farmers living in the area and, therefore,
Mrs . Booth will have no need for the improvements located on the proposed
Lot A. The proposed Lot A is currently under contract for sale subject
to acquisition by Mrs . Booth and subject to obtaining the Recorded
Exemption. Lot A contains no cultivated acres.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services staff recommends the request
be approved for the following reasons :
1. The request conformgwith Section 9-2 of the Weld County Subdivision
Regulations , Section 3. 3A. of the Weld County Zoning Resolution,
and the Weld County Comprehensive Plan in that the use will be
compatible with surrounding agricultural land uses . Each
resulting parcel does have an existing set of improvements. The
request will allow agriculture and related uses to be the
predominant land use. There will be no reduction in the amount
of land currently being used for agricultural production.

2. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.

To Whom it May Concern:
Pursuant to the enclosed request for Recorded Exemp-
tion on our Weld County farm as per the plat and ap-
plication attached hereto, we wish to set forth the
following reasons for said request .
We are making this request for Recorded Exemption as
present fee owners of subject property, however, we
have contracted to sell said property to Lois E. Booth
with a projected closing date of January 10 , 1980.
The property is being purchased by Mrs . Booth as a
source of feed for a cattle feeding operation in the
vicinity owned by the Booths. The farms will be farmed
by tenant farmers living in the area and, therefore,
Mrs . Booth will have no need for the improvement sites.
The particular building site detailed in this Recorded
Exemption is currently under contract for sale subject
to acquisition by Mrs . Booth and subject to obtaining
the Recorded Exemption and said building site contains
no cultivated acres. The closing on the building site
will be subsequent to the closing of our total sale to
Mrs . Booth.
We respectfully request approval by the Planning Com-
mission and the Board of County Commissioners of Weld
County of the enclosed Application for Recorded Ex-
emption.

COMMENTS :
Lot B, the larger parcel, is primarily irrigated agriculture (corn) .
Lot B contains one residence and large metal building for farm equipment ,

Lot A contains one residence, several barns and metal sheds_ There
appear to be two additional structures located on the southern end of
the parcel. The southwestern boundary of the improvements parcel
appears to be a ditch. Surrounding pronerty is primarily irrigated
agriculture.
