HomeMy WebLinkAbout830035.tiff K*1944656 RESOLUTION RE: ADOPTION OF AN AMENDMENT TO THE WELD COUNTY SUBDIVISION REGULATIONS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 17th day of October, 1983, at the hour of 10 : 00 o' clock a.m. in the Chambers of the Board for the purpose of considering the adoption of an amendment to Section 15 of the Weld County Subdivision Regulations relating to the payment of fees to a State reviewing agency for the review of subdivision applications submitted to the County, and WHEREAS, the proposed amendment to the Subdivision Regula- tions as approved by the Planning Commission on September 6 , 1983, was studied by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners desires to amend Section 15 of the Weld County Subdivision Regulations to read as follows: 15 Fees B 1011 REC 01944656 10/25/83 09 : 17 $0. 00 1/002 F 0790 MARY ANN FEUERSTEIN CLERK & RECORDER WELD CO, CO 15. 1 Fees for all Subdivision applications provided for in the Subdivision Regulations shall be established by resolution of the Board of County Commissioners in con- junction with a hearing process that will consist of a ten (10) day public notice prior to the Board of County Commissioners' hearing. Notice of said hearing is to be published once in the newspaper designated by the Board of County Commissioners for publication notices. 15 . 2 Review fees charged by a State agency for the review of any subdivision applications shall be made payable, by check or money order, to the State reviewing agency in the amount set by State law. The fee shall be paid at the time the application is submitted for considera- tion by the County. Failure to pay said fee shall re- sult in the subdivision application being considered an incomplete application and will not be assigned a case number or hearing date until the fee is paid. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the amendment to Section 15 of the Weld County Subdivision Regulations, as stated herein be, and hereby is, adopted. Lcc Morrison, Assistant County Attorney, read the notice into the record. Chuck Cunliffe, Director of Planning, stated that the Weld County Planning Commission reccnmended approval of this item because it will clarify the responsibility of persons applying for subdivision applications that require review by a state agency. State Statutes mandate that certain state agencies review subdivision requests submitted to the County. Colorado Statutes further provide that those agencies may charge fees for their review services. The amendment places the responsibility of paying for those services on the subdivision applicant. After review, Commissioner N. Carlson moved to approve said amendment to Section 15 of the Weld County Subdivision Regulations relating to the payment of fees to a State reviewing agency for the review of subdivision applications submitted to the County.
