A public hearing was conducted on February 4, 2026, at 10:00 a.m., with the following
present:
Commissioner Scott K. James, Chair
Commissioner Jason S. Maxey, Pro-Tem
Commissioner Perry L. Buck
Commissioner Lynette Peppler
Commissioner Kevin D. Ross
Also present:
Acting Clerk to the Board, Jess Reid
Deputy County Attorney, Karin McDougal
Department of Planning Services Representative, Diana Aungst
The following business was transacted:
I hereby certify that pursuant to a Notice dated November 25, 2025, and duly published
November 29, 2025, in the Greeley Tribune, a public Show Cause hearing was conducted
to determine whether good cause exists for the revocation of Use by Special Review
Permit, USR15-0042, for Mineral Resource Development Facilities, Oil and Gas Support
and Service (office/shop and storage of vehicles and equipment) in the A (Agricultural)
Zone District, held by Peitz Land Investments, LLC. At said hearing the Board continued
the matter to February 4, 2026, to allow the permittee additional time to come into
compliance. Karin McDougal, Deputy County Attorney, made this a matter of record.
Diana Aungst, Department of Planning Services, presented a brief summary of the USR
and provided the general location of the site. She stated, since the last hearing date, the
permittee submitted a survey to confirm the boundary of the outdoor storage, sent photos
of the storage of equipment and parking areas, and provided an inventory list of all of the
equipment being stored and parked on the site. Additionally, she noted the storage
volume for the water quality pond was reevaluated and the supporting documentation
was submitted. Ms. Aungst displayed images from a recent site visit, relayed the site is in
compliance, and recommended dismissal of the Show Cause case.

Eric Wernsman, Wernsman Engineering and Land Development, LLC, and
Brian Kraisinger, HP Oilfield Services, LLC, represented the applicant and had nothing to
add.
In the matter of Show Cause hearing, PCSC25-0012, for USR15-0042, Commissioner
Ross moved to dismiss the case. The motion was seconded by Commissioner Maxey,
and it carried unanimously. There being no further discussion, the hearing was completed
at 10:10 a.m. (Clerk's Note: Teams recording start timestamp 3:04)
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Hearing Certification, on motion duly made and seconded, by the following
vote on the 18th day of February, A.D., 2026:
