Resolution Action of the Board at Show Cause Hearing, PCSC25-0012, Concerning Use by Special Review Permit, USR15-0042, for Mineral Resource Development Facilities, Oil and Gas Support and Service (office/shop and storage of vehicles and equipment) in the A (Agricultural) Zone District — Peitz Land Investments, LLC Whereas, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and Whereas, on November 19, 2025, a Probable Cause Hearing was held before the Board to consider setting a Show Cause Hearing to determine whether or not the current owner, Peitz Land Investments, LLC, 22911 County Road 39, LaSalle, Colorado 80645, was in compliance with certain Development Standards contained in Use by Special Review Permit, USR15-0042, for Mineral Resource Development Facilities, Oil and Gas Support and Service (office/shop and storage of vehicles and equipment) in the A (Agricultural) Zone District, on property being further described as follows: Lot B of Recorded Exemption, RECX15-0112; being part of the E1/2 SE1/4 of Section 33, Township 3 North, Range 66 West of the 6th P.M., Weld County, Colorado Whereas, at said hearing the Board determined there was sufficient probable cause to schedule a Show Cause Hearing to consider whether or not said Use by Special Review Permit, USR15-0042, should be revoked for failure to comply with certain Development Standards, as follows: 6) The fencing and lighting on the site shall be maintained. 7) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 26) The property owner or operator shall be responsible for complying with the Design Standards of Chapter 23 of the Weld County Code. 28) The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. Whereas, at said hearing, the Board heard all of the testimony and statements of those present and reviewed the request of the applicant for a continuance and, having been fully informed, deemed it advisable to continue the matter to February 4, 2026, at 10:00 a.m., to allow the permittee additional time come into compliance. Photos were taken just recently showing the location of the storage of equipment and parking areas. The storage volume for the water quality pond has been re-evaluated and submitted for the file.Additionally,the inventory list of all the equipment being stored/parked on the site was also submitted. All the required items have been provided to the County and the site is currently in compliance with USR15-0042. December 10, 2026 Summary: After the November 19, 2025, Probable Cause hearing the applicant's representative submitted a request for a PreApplicaiton meeting which was held on November 25, 2025 (PRE25-0240). It was confirmed that the owner is not leasing the property to other users. The applicant agreed to submit a survey to confirm outdoor storage boundaries and provide photos and the location details of the water quality pond. An inventory list of all the equipment being stored/parked on the site will also be submitted. The applicant is working with the County to correct this violation. November 19, 2026 Summary: USR15-0042 was approved in 2015 for an office and/or a shop and storage of vehicles and equipment. The USR map shows the extent of the storage yard, set back from the road with no requirements for fencing. The buildings shown on the map were not built. In the past two(2)years the site has undergone expansion without submitting or receiving approval for an amendment to the land use permit. Despite multiple attempts to contact the property owner, there has been no response to date. Additionally, there is evidence suggesting that the site may currently be leased and used for storage purposes within a designated water quality area. The current USR on the site: USR15-0042 is approved for, "A Site Specific Development Plan and Use by Special Review Permit for Mineral Resource Development Facilities, Oil and Gas Support and Service, PCSC25-0012—Pietz Land Investments, LLC Page 1 of 3 (office/shop and storage of vehicles and equipment) in the A (Agricultural) Zone District." This USR15-0042 was approved by the Board of County Commissioners on November 4, 2015, and recorded on July 29, 2016, reception #4223242. June 9, 2025 COMP25-00267 Complaint of large amounts of trucks and the screening fence was broken or missing. June 19, 2025 Courtesy letter sent requesting that the property owner bring the site into compliance and contact staff. August 19, 2025 Notification of violation letter sent. No contact from the property owner. October 22, 2025 Notification of hearing letter sent. No contact from the property owner. November 5, 2025 Notification of hearing letter emailed to the property owner. Show Cause Code Section/Considerations: Section 2-4-50.0. of the Weld County Code: Where the Board is considering the revocation or suspension of a permit or license, including but not limited to uses by special review and permits issued under Chapter 21, but specifically excluding liquor licenses, the Board shall consider evidence and statements in mitigation and in aggravation of the violation prior to determining the appropriate penalty. Such evidence and statements may relate to and include, but not be limited to, the following: 1. The compliance history of the party against whom the complaint was made with respect to the permit at issue or other County-issued permits. 2. Good faith efforts on behalf of the person against whom the complaint is made to comply. 3. Duration of the violation. 4. Impact on, or threat to, the public health or welfare or the environment as a result of the violation. 6. Malfeasance. 7. Whether legal and factual theories were advanced for purposes of delay. In addition to the factors set forth in this Subsection, the following circumstances shall be considered as grounds for reducing or eliminating penalties: 8. The voluntary and complete disclosure by the person against whom the complaint is made of such violation in a timely fashion after discovery of the noncompliance. 9. Full and prompt cooperation by the person against whom the complaint is made following disclosure of the violation, including, when appropriate, entering into a legally enforceable commitment to undertake compliance and remedial efforts. 10. The existence and scope of a regularized and comprehensive environmental compliance program or an environmental audit program. 11. Substantial economic impact of a penalty on the violator. 12. Other mitigating factors. Where a civil penalty in lieu of suspension is available, the Board shall first impose the revocation or a term of suspension. The amount of the civil penalty shall then be determined on the basis of imposing an economic penalty equivalent to the loss which would have occurred had the facility not operated during the term of the suspension. A portion of the civil penalty may be deferred on the condition that certain actions to correct the violation be taken. The failure to pay the civil assessment will result in imposition of the suspension. The following items are still outstanding: 1. Inspection to confirm the site is in compliance with USR15-0042. Or 2. Submittal of an application to amend the current USR. Additionally, there is evidence suggesting that the site may currently be leased and used for storage purposes within a designated water quality area. The current USR on the site: USR15-0042 is approved for, "A Site Specific Development Plan and Use by Special Review Permit for Mineral Resource Development Facilities, Oil and Gas Support and Service, (office/shop and storage of vehicles and equipment) in the A (Agricultural) Zone District." This USR15-0042 was approved by the Board of County Commissioners on November 4, 2015, and recorded on July 29, 2016, reception #4223242. According to the current data the site is not in compliance with the following Development Standards: USR15-0042 Development Standards#6, 7, 26, 28, and 29 state: 6) The fencing and lighting on the site shall be maintained; PCSC25-0012—Pietz Land Investments, LLC Page 1 of 3 7) Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant to Chapter 15, Articles 1 and 11, of the Weld County Code; 26) The property owner or operator shall be responsible for complying with the Design Standards of Chapter 23 of the Weld County Code; 28) The Use by Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Substantial changes from the plans or Development Standards, as shown or stated, shall require the approval of an amendment of the Permit by the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted.Any other changes shall be filed in the office of the Department of Planning Services. 29) The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. Show Cause Code Section/Considerations: Section 2-4-50.0. of the Weld County Code: Where the Board is considering the revocation or suspension of a permit or license, including but not limited to uses by special review and permits issued under Chapter 21, but specifically excluding liquor licenses, the Board shall consider evidence and statements in mitigation and in aggravation of the violation prior to determining the appropriate penalty. Such evidence and statements may relate to and include, but not be limited to, the following: 1. The compliance history of the party against whom the complaint was made with respect to the permit at issue or other County-issued permits. 2. Other mitigating factors. Where a civil penalty in lieu of suspension is available, the Board shall first impose the revocation or a term of suspension. The amount of the civil penalty shall then be determined on the basis of imposing an economic penalty equivalent to the loss which would have occurred had the facility not operated during the term of the suspension. A portion of the civil penalty may be deferred on the condition that certain actions to correct the violation be taken.
