HomeMy WebLinkAbout820362.tiff 1 RESOLUTION IN THE MATTER OF A RESOLUTION PROPOSING CREATION OF THE TRI-TOWN AMBULANCE SPECIAL TAXING DISTRICT TO PROVIDE AMBULANCE AND EMERGENCY MEDICAL TREATMENT SERVICES BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners has the power and authority under the Weld County Home Rule Charter, and Part 9, Article 35 , Title 30 , C.R.S. 1973 , as amended, to create a Special Taxing District to facilitate the furnishing of services and improvements and the collection of ad valorum taxes or charges for such services or both such taxes and charges, and WHEREAS, this Board has the authority, pursuant to C.R. S. 1973 , X30-35-904 (2) (a) to propose a formation of such a district. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado: 1 . That the attached Resolution in the matter of a Resolution creating the Tri-Town Ambulance Special Taxing District to provide ambulance and emergency medical treatment services, marked as Attachment "1 , " considered as a proposal for the creation of said district, and further, 2 . That a hearing be held on October 4 , 1982 , at 10 : 00 a.m. , at which time any registered elector of the County may be heard on the proposal, including questions of inclusion and/or exclusion from the district, and at which time all such objections shall be considered by this Board on the basis of public interest, taking into consideration the needs of the people, and the availability of the service to the territory which is the subject of any such objection, and further, ; .. 820362 3 . That notice of said hearing be published pursuant to statute. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO: WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has the power and authority under the Weld County Home Rule Charter and Part 9 , Article 35 of Title 30 , CRS 1973 , as amended, to create a special taxing district to facilitate the furnishing of services and improvements and the collection of ad valorum taxes or charges for such services or both such taxes and charges, and WHEREAS, the municipalities of Dacono, Erie , Firestone , Frederick, and Mead have, pursuant to CRS 1973 , §30-35-103 (2) , consented to the inclusion of the property located within said municipalities in this special taxing district and WHEREAS, the furnishing of ambulance service and emergency medical treatment are services that a County is authorized to provide, and WHEREAS , it is not practicable to serve the County by means of a single ambulance service, the cost of providing ambulance service varies within the County and there is the potential for duplication of services between the Weld County Ambulance Service and the other ambulance services within Weld County, and WHEREAS , the Board has determined that there are no tracts or parcels of real estate used for manufacturing, mining, railroad, agricultural, or industrial purposes, for which no direct benefit will be provided by the services of the Tri-Town ambulance special taxing district. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Tri-Town ambulance special taxing district is established according to the following terms and conditions : I . BOUNDARIES The legal description of the Tri-Town special taxing district shall be as described in Exhibit "A" which is attached hereto and incorporated by this reference. For descriptive purposes this includes all those areas currently incorporated into the St. Vrain School District RE-1J. II . SERVICES The Tri-Town ambulance special taxing district shall provide to the residents of said district ambulance and emergency medical treatment services. The services shall be provided in a manner consistent with Weld County Ordinance No. 77 . III . FINANCING The method of financing the Tri-Town ambulance special taxing district shall be as follows : A. By means of fees for services rendered to be charged to the users of the services. Said fees shall be as set forth by Resolution of the Weld County Board of County Commissioners acting in its capacity as the governing body of the Tri-Town ambulance special taxing district. B. The collection of ad valorum taxes. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the day of , A.D. , 1982 .
