HomeMy WebLinkAbout820748.tiff April 13, 1982 Board of County Commissioners Weld County Greeley, Colorado Board Members: I am issuing a complaint about a dust control problem. I live at 1912 44th. Avenue , Greeley, Colorado (Lot 5, Block 7 , College Green third filing) . Starting about mid March, with almost any type of wind gusts , two or three inches of dirt would be deposited around the perimeter of my yard. After cleaning that up, on April 2 a major wind storm buried my complete front yard, in places over one foot deep. After considerable expense and time this was also cleaned up as best as could be. At this time I contacted a principle of a corporation that owns a large piece of the undeveloped ground from which dirt was coming from. In my conversation with him I was told that the only thing they were required to do was keep the weeds down. After conversations with City Officials , no actions were considered or proposed. At this point I contacted my attorney and was told of a Statute that would cover my circumstances , specifically, The Soil Erosion-Dust Blowing Act of 1954. At this time I was under the impression that the developer might take voluntary actions to alleviate the problem. On April 12, 1982 another major wind storm occured burying my yard a second time . That occurance coupled with the inaction of the developer has brought me to you to forcefully try and correct the problem of neglect on the part of landowners in that area. There are two major pieces of ground that no steps, whatsoever, have been taken to control wind erosion, and several individually owned lots . Specifially S & G Associates and Eisenman Enterprises Inc . are the major owners of ground boardering 20th. Street and 47th. Avenue from which I have witnessed and recorded on film massive amounts of dirt blowing from. At this point I have not had the time to investigate the ownership of the individual lots owned. The legal description of the area in need of wind erosion control measures is: SW% section 11 township 5 Range 66, all of the undeveloped property between 44th. Avenue Court and 47th. Avenue between 16th. Street and 20th. Street plus Blk 4 College Green 3rd filing Lots 2-8. I would hope that the board will consider my request as a reasonable one and some sort of action can be taken immediately to alleviate this problem. As explained earlier the Board of County Commissioners is the only entity I am aware of with the legal right to be sure the responsibility of land owners , in regard to wind erosion, has not and will not be neglected.
