RESOLUTION RE: APPROVAL OF USE BY SPECIAL REVIEW FOR AN OPEN-CUT WET GRAVEL PIT WITH ANCILLARY USES INCLUDING CONCRETE AND ASPHALT BATCH PLANTS AND CASTING PLANT - J-BAR-B , INC. WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , the Board of County Commissioners held a public hearing on the 25th day of July, 1984 , at the hour of 2 : 00 o' clock p.m. in the Chambers of the Board for the purpose of hearing the application of J-Bar-B, Inc. , 1805 Kipling Street, Lakewood, Colo- rado 80215 , for a Use by Special Review for an open-cut wet gravel pit with ancillary uses including concrete and asphalt batch plants and casting plant on the following described real estate, to-wit: S1 NE4 and SEa , Section 36 , Township 3 North, Range 68 West of the 6th P .M. , Weld County, Colorado WHEREAS , Section 24 . 4 .2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the re- quest of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence pre- sented in this matter, and having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 , 44 . 1 , 44 . 2 . and 44. 3 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. This request is in compliance with the Weld County Comprehensive Plan, and the Weld County Extraction Plan, Mineral Resources, Volume II . The Weld County area in question is located in a resource conservation area. The Weld County Extraction Plan states that extraction shall be encouraged in resource conservation areas, as long as appro- priate extraction standards are followed. The proposal is consistent with the Comprehensive Plan policies which which allow uses of an industrial LHR 380 �1-059- C r : 84037S Page 2 RE: USR-J-BAR-B INC . nature to occur where the resources are available (i.e. , gravel and sand operations as noted on pages 62-63 of the Comprehensive Plan) . b. The proposal is consistent with the intent of the Agricultural Zone District in that the proposed use does not interfere with other agricultural activities in the area or the County and as a Use by Special Review the activity can take place in the district. c. The activities proposed will be compatible with existing agricultural uses in the neighborhood, as well as with projected development in the future. d. The subject site is in a Flood Hazard Overlay District area. Operation Standards address this concern. e. Use by Special Review Operation and Design Stan- dards provide adequate protection of the health, safety and welfare of the neighborhood and County. NOW, THEREFORE , BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the application for a Use by Special Review for an open-cut wet gravel pit with ancil- lary uses including concrete and asphalt batch plants and cast- ing plant on the hereinabove described parcel of land be, and hereby is , granted subject to the following conditions: 1 . The attached Standards for Use by Special Review be adopted and placed on the Use by Special Review plat prior to recording. 2 . The prescribed Use by Special Review activity shall not occur nor shall any building or electrical permits be issued on the subject property until the Use by Special Review plat has been delivered to the Department of Planning Services Office and the plat has been recorded in the office of the Weld County Clerk and Recorder. 3 . The following note being placed on the Use by Special Review Permit plat: NOTE : The Mined Land Reclamation Board has the authority to issue permits for mining and reclamation activities. Activities related to mining and reclamation are, there- fore, under the jurisdiction of the Mined Land Recla- mation Board; however, Weld County has jurisdiction of those matters outlined in the Operation Standards . The applicant shall offer and agree to an acceptable program of road maintenance with the Weld County En- gineering Department of County Road used for hauling traffic. The agreement shall mitigate impacts on County Road by the gravel mining operation' s truck traffic. 5 . The property owner (s) and/or operator shall apply for a Well Permit with the Division of Water Resources to comply with CRS 37-90-137 prior to the extraction of sand and gravel . A copy of the Well Permit shall be forwarded to the Department of Planning Services. Martin OPERATION STANDARDS J-Bar-B, Inc. U.S.R. - 639:84:35 1. The uses permitted on said described parcel shall be the extraction of sand and gravel and a concrete and asphalt batch plant and casting plant as described in the application materials on file with the Department of Planning Services. 2. The open-cut gravel operation shall comply with section 44.4, Operation Policies as listed in the Weld County Zoning Ordinance. 3. All operations on said described parcel shall be in conformance with the Weld County Flood Hazard Regulations including: A. NO fill, berms or stockpiles shall be placed in the one hundred (100) year floodplain which would obstruct passage of flood flows; and B. All fuel tanks, septic tanks, temporary buildings, and any other hazardous items that might wash away during flooding shall be securely anchored and adequately flood-proofed to avoid creation of a health hazard. Following completion of mining, all temporary buildings shall be removed. 4. The operator shall comply with all the requirements of the Longmont Fire Protection District. 5. The applicant shall obtain a N.P.D.E.S. Permit from the Water Quality Control Division of the Colorado State Health Department prior to discharge of any water into the St. Vrain Creek. A copy of the N.P.D.E.S. Permit shall be forwarded to the Department of Planning Services. 6. Vehicular Traffic shall ingress and egress onto Weld County Road 13 as explained in the submitted application materials. The point of ingress and egress shall be paved a minimum of twenty (20) feet from the edge of Weld County Road 13 to the Use by Special Review area. 7. A minimum eighteen (18) inch by forty (40) foot culvert shall be constructed at the entrances. -8. The haul route shall be from the gravel pit as explained in the application materials onto Weld County Road 13 thence south to Weld County Road 24 to Interstate 25. Operation Standards J-Bar-B Inc. USR-639:84:35 Page 2 9. The applicant shall comply with the design standards for the Use by Special Review, Section 24.5 et seq. , of the Weld County Zoning Ordinance. 10. The applicant shall comply with the Operation Standards for Uses by Special Review, Section 24.6 et seq. , of the Weld County Zoning Ordinance. 11. Representatives or members of the Weld County Health Department and Weld _County Department of Planning Services shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with the Operation Standards stated hereon and all applicable Weld County Regulations. 12. The Use by Special Review area shall be limited to the plans shown hereon and governed by the Standards as stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Standards as shown or stated above shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County -Commissioners before such changes from the plans and/or Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Standards. Noncompliance with any of the above stated Standards may be reason for revocation of the -Permit by the Board of County Commissioners. 14. The concrete and asphalt batch plants and casting plant shall remain in the Phase One and Phase Two areas, as designated on the Use by Special Review Plat for as long as possible. Only when the Phase Two area is being mined shall the above mentioned plants be allowed in the designated Phase Three area. At no time shall any of the said plants be allowed within six hundred (600) feet of Weld County Road 26. 15. An earthen berm or stock pile, six feet in height, shall be placed on the south side of the batch plant and sock crusher facility prior to start of the batch plant facility in Phase III of the gravel operation. HEARING CRTIFICATIal DOCKET NO. 84-47 RE: USE BY SPECIAL REVIEW, OPEN-CUT WET GRAVEL PIT WITH ANCILLARY USES, J-BAR-B, INC. A public hearing was conducted on July 25 , 1984, at 2.00 P.M. , with the following present: - Commissioner Norman Carlson, Chairman Commissioner Jacqueline Johnson, Pro-Tem Commissioner Gene Brantner Commissioner Chuck Carlson Commissioner John Martin Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated July 16, 1984, and duly pub- lished in the La Salle Leader on July 12, 1984, a public hearing was conducted to consider the application of J-Par-B, Inc. for an open-cut wet gravel pit with ancillary uses. The ancillary uses include concrete and asphalt batch plants and a casting plant. Lee Morrison, Assistant County Attorney, made this request of record. Rod Allison, representative of the Planning Department, read the favorable recommendation of the Planning Commission into the record, along with the conditions and said there are 14 Operation Standards associated with this request. Mr. Allison also said that Condition No. 4 had already been complied with. Mr. O'Brien, representing the applicant, came forward to answer questions of the Board and explain this proposal. Commissioner C. Carlson had questions concerning water augmentation. Mr. O'Brien responded, saying that there is adequate water at this site. Tom Cech, manager of Central Water Conservancy District in Greeley, came forward to voice concerns about gravel pit development in this area because of the evaporation caused by gravel pits. Following discussion, Terri Gillatt and Frank Sewald came forward to voice concerns about the rock crusher, asphalt, batch and casting plants. Mr. Sewald also requested that the facility be placed at least 1320 feet back from the property line rather than the 600 feet which is in the Operation Standards. Commissioner C. Carlson suggested that an earth berm be placed on the south edge of the property in order to eliminate much of the noise. After further discussion, it was decided that the Operation Standards should be amended to•add that an earth berm or stock pile, six feet in height, should be placed on the south side of the property. Mr. Allison read suggested Operation Standard #15 into the record. Following further discussion, Com- missioner Martin moved to approve Use by Special Review for an open-cut gravel pit with ancillary uses for J-Bar-B, Inc. with amended Operation Standards. Commissioner Johnson seconded the motion. JOINT RESOLUTION NO. 84-1 GRAVEL PIT AUGMENTATION POLICY A Joint Resolution of the Central Colorado Water Conservancy District anti the Ground Water Management Subdistrict of the Central Colorado Water Conservancy District determining a gravel pit augmentation policy. WHEREAS, the excavation of gravel pits causes loss of water through evaporation and the pumping from said -pits of water for beneficial uses also causes loss of -water both which constitute depletions which generally are out of priority; NOW, THEREFORE, be it resolved by the Board of Directors of the Central Colorado Water Conservancy District and the Board of Directors of the Ground Water Management Subdistrict of the Central Colorado Water Conservancy District; That the District and Subdistrict shall require augmentation for evaporation and other uses from gravel pits within the counties of Adams, Morgan and Weld and such other counties as determined by the Board of Directors to affect constituents of. said Districts as follows: 1. Require two to four acre-feet of augmentation water per acre for each acre of open water surface created by mining. The amount required shall depend on the amount of evaporation per acre and other uses made of water from the gravel pits. 2. Water rights conveyed to the District for augmentation shall be Colorado Sig Thompson Project water or other water rights acceptable to the Board of Directors. Where C. B.T. water is proposed, it is subject to the approval of the Board of Directors of the Nothern Colorado Water Conservancy District. 3 . The quantity of water available from water rights proposed for augmentation is to be determined by engineers for the District based upon the historic average annual diversions attributable to the water rights. 9 . No credit is to be given for historic consumptive use resulting from unadjudicated sources such as sub-irrigation from ground water, ground water evaporation, wastewater, bogs and marshes. Such consumptive use is considered to be attributable to out of priority diversions from these sources and cannot be claimed for augmentation purposes. -1- 131, 5. Augmentation water rights are to be conveyed to the District, provided however, that C. B.T. water shall remain allocated to the land and titled in the name of the landowner, but shall be subject to a covenant tying it to the Augmentation Agreement. 6. The District shall own all augmentation water (other than C. B.T. ) and shall exercise all rights and responsibilities of ownership of rights transferred to the District, subject to the provisions of the Augmentation Agreement. 7. If any consumptive or beneficial use of water is made, excluding evaporation loss, the landowner shall file for conditional and absolute water rights on water stored in gravel pit ponds, filing to be undertaken as soon as possible after execution of the Augmentation Agreement and pursued diligently to final decrees. 8. The applicant shall pay to the District a reasonable amount to reimburse for legal and engineering expenses incurred in reviewing the mining proposal and preparing the Augmentation Agreement. 9. In the future, if required by Colorado statutes, the Colorado. State Engineer or other water users, the applicant agrees to file a formal Plan of Augmentation with the Water Court. Both the District and the applicant agree that the standards set forth in this policy shall govern their positions with respect to any formal plan of augmentation; in other words, the District agrees not to request additional augmentation water and the applicant agrees to waive any claims it might have to furnish less augmentation water. 0-1 DATED this 17 - day of April, 1984. The application indicates the mined area will be reclaimed for private lake recreation. Using an impoundment of water for recreational purposes, including fishery and wildlife, has been defined in EIS 37-92-103 as putting the water to beneficial use. Since the source of water for the ponds that will be created by the gravel pit operation is ground water and the ground water will be used beneficially, we require that a well permit be obtained from our office. The well permit must be obtained prior to excavation -of the gravel pit. Otherwise, U-Bar—B, Inc. will be in violation of CRS 37-9D-137. Since the proposed gravel pit would be located in an over-appropriated basin, the well permit could not be obtained until a court approved plan for augmentation has been developed. The correct procedure to obtain a well permit is as follows. J-Bar B, Inc. should first file for a well permit with this office. The well permit will be denied since the proposed _gravel pit is located in the over-appro- priated St. Vrain River basin. Before receiving this denial, J-Bar-B, Inc. could submit a plan for augmentation to the Water Court. The augmentation plan should replace the out-of-priority consumptive use associated with lake evaporation and any other out-of-priority consumptive uses. Upon the court's approval of the plan for augmentation, this office can issue the well permit. The Water Court can only act upon the plan for augmentation after we have denied the original well permit application or if we have not acted upon the well permit application within six months. The application states there will be some consumption of water for dust suppression on haul roads and on the plant site. Will water be required for the plant operation itself or for other purposes? The application also indi- cates that the operator owns senior water rights which will be converted to Mr. James R. Mayerl Page 2 June 22, 1984 industrial use. We would not abject to the use of the irrigation rights if they have been properly transferred in Water Court. We could not conutnt on the feasibility of a court transfer without knowing what water rights are being referred to. The irrigation water tights might -also be capable of forming the basis of the augmentation plan discussed in the second paragraph of this letter. A lateral of the Rural Ditch flows along the far west side of the pro- perty. Other ditches flow near the south boundary of the pit. The appli- cation does not indicate whether any wells exist near the mine site. We believe that J-Bar-B, Inc. should meet with owners in the area to discuss the potential impact of and possible mitigation for the dewatering operation. A monitoring system should be up to provide evidence should any injury claims occur. In summary, we cannot recommend approval of this application until the issues discussed in this letter are addressed. Further, we will order 2-Bar-B, Inc. to cease operations if our Water Commissioner determines ground water is being exposed ar pumped out without a weal permit or water is being diverted illegally. No east-west traffic should be allowed between County Road 24 and State Highway 66. '_ . Haul route restrictions should be posted at exits , visible to all users . 3. Entrances should be paved a minimum of 20 feet from the road to prevent damage to pavement edge and tracking of gravel onto the asphalt road. Adequate turning radii should be provided to avoid truck encroachment into opposite lane. 4. Minimum 18" diameter culverts will be required at entrances . 3. We have reinspected Weld County Bridge 13/26A as a result of this application. The bridge has been repaired and upgraded since the 1980 inspection from which the load limits in the application were taken. As a result, the bridge will handle legal truck loads . Thus, the application would be adequate in stating that the operator will abide by any possible future load restrictions placed on the structure. The application states that the operation may evolve into a "wet pit" if dewatering proves too costly. I would like to express our concerns if the operation does ultimately expose ground water. As you know, senior surface water rights in Weld County, downstream of the proposed gravel pit, would be reduced by three to five acre-feet for each surface acre of ground water exposed by the mining operation. This unap- propriated use of water will continue while mining occurs at the site, and also for the life of the lake. This could amount to a loss of huge quan- tities of surface water for senior diverters in Weld County if these evaporative losses are not replaced. If the entire 235 acre site is mined, the loss of surface water to downstream senior diverters could amount to 700 - 1,100 acre-feet of water each year. If the water was valued a $1,000 per acre-foot, the economic loss would approach $700,000 to $1,100,000. We do not feel it is appropriate for the county to recommend approval of a land use change that would result in an economic loss of nearly $1,000,000 to residents below the proposed development. Therefore, we urge you to require that the applicant mitigate these negative impacts by assuring water users that downstream property rights will not be harmed. This negative impact of the proposed mining operation can be mitigated in several ways. First, the applicant could agree to comply with the policy approved by our Board of Directors on April 17, 1984. Second, the appli- cant could comply with the policy of the St. Vrain & Left Hand Water Conservancy District regarding mining operations. Finally, the applicant could submit its own plan for augmentation to the State Engineer for review and approval. The proposed use is multiphased: (1) to extract and process sand and gravel and (2) to use a small portion of the site for a floating plant area, i.e. when mining is north of the creek, the plant area will be north of the creek, but when deposits on the north side are exhausted, the mining will move south and so will the plant area. The plant area will contain the usual processing equipment, but in addition, we are asking the county to consider approval of three ancillary uses to the gravel operation: (a) a portable batch plant with a (b) casting plant in conjunction and (c) a portable asphalt plant. Only the aggregate processing equipment will be on site for the life of the mine. The other plants will be moved in and out as demand requires. It is possible, however, that a plant may remelt on site for several years if the demand is sufficient. (3) All the lands used for extraction and plant area will be reclaimed for private lake recreation. b. Explanation of need for use : the Weld County Extraction Plan covers this subject very well. The need for additional sand and gravel extraction is caused by continued growth along the Front Range. The need is compounded by the depletion and loss caused by buildings erected on sand and gravel sources in other areas. c. Explanation of existing uses on surrounding properties: on the north side is irrigated agricultural land. On the north two-thirds of the east side are two sand and gravel extraction operations. The south one-third of the east side is irrigated agricultural land with a farm residence and yards at the southeast corner and near the quarter corner. On the west side are irrigated agricultural lands on the south two-thirds with a small area of non-irrigated creek bottom at the south end. d. For the distance to residential structure, please refer to the enclosed vicinity map. e. Not applicable. f. The number of employees will vary with season and demand, depending on whether there are plants included in the operation. The minimum number will be about four and the maximum about 45 . Operations in accordance with Weld County regulations will be during daylight hours. Usually there will be one shift 5 of workers, but the long daylight hours of summer may require overtime. g. The operator owns sufficient water rights to comply with Colorado law. h. The primary access route (haul route) will be from the site south on W.C. R. 13 to W. C. R. 24; thence west to I-25 . These are paved roads. The operator has been and will stay in contact with the Weld County Engineering Department. i. The sand and gravel operation will require use of two types of trucks--dump trucks at 24 to 27 tons and tractor trailer trucks at 37 to 39 tons. During the first stage of mining, dumps will be restricted to under 24 tons because of the restrictions on Bridge 13-26A across St. Vrain Creek. The number of truck trips will vary in the extreme. In mid-winter, perhaps 10 or fewer trips per day will be made; the summer high will be about 150 trips per day. Other trucks that may be used on the haul route are ready-mix trucks at 24 to 28 tons with the same bridge restrictions; asphalt dumps at 24 to 27 tons with the same bridge restrictions; tractor trailer flatbeds to haul castings at less than 39 tons. Trips for the ready-mix and asphalt trucks may each vary between zero and 25 trips per day depending on whether the plants are on site and running at peak or whether there is no plant on location. The flatbed for hauling the castings will make about zero to five trips at a maximum when operating at peak. j . Only a portable facility such as a super bowl is necesary. k. Not applicable. 1 . The following materials and supporting documents are submitted as a part of the Use by Special Review Application. a. This request for a special review involves an open cut mining operation for the extraction of sand and gravel. Apparently open cut applications vary slightly from the normal special review items. In order to indicate that the request is consistent with the Weld County Comprehensive Plan, it appears appropriate to assume that the Weld County Extraction Plan is consistent with the Comprehensive Plan and to then show consistency with the Extraction Plan. The bulk of the affected land, 155 .45+/- acres of 216 . 81+/- acres, is located in a resource conservation area along St. Vrain Creek. It is the operator ' s understanding that open cut mining in such areas is encouraged if proper planning and reclamation is present. The remaining 61 .36+/- acres is located on irrigated crop lands. The operator understands that for several good reasons, mining on such lands is discouraged. The operator is in general agreement with this policy; however, there are circumstances present which may make a deviation from this policy acceptable. Ownership of the entire 216 .81+1- acres is vested in J-Bar-B, Inc. The corporation is also the operator, although contracts for pit operations, concrete batch plant, asphalt plant and casting plant may be let to others. No ditches will be interrupted by the mining activity. No ditches traverse the property. One lateral runs along the west edge on its way to St. Vrain Creek. It enters the creek about a quarter mile north of the south property line. This lateral will not be disturbed by mining. About 60 acres will be removed from agriculture, but the reclaimed land will be part of an overall plan for a private water recreation area. The operator believes the plan is consistent with the Weld County Comprehensive Plan. b. The request covers two types of districts. We believe our statement in item la covers this item. c. Not applicable. d. The mining and reclamation plans for the Bailey Pit address requirements of the Weld County regulations, the Colorado Department of Health Division of Air Pollution and Water Pollution, the Colorado Department of Natural Resources Divisions of Reclamation, Wildlife and Water Resources, and the Army Corps of Engineers. Thus, protection of the health, safety and welfare of the inhabitants of the neighborhood and the county are assured. 7 The operator has been a good neighbor for many years and intends to remain a good neighbor. e. Agricultural development surrounds the property on the north, west, south and southeast sides. Sand and gravel operations are located along the northern three quarters of the east side. Reference to the vicinity map will indicate the location of the farmhouses within a half mile of the boundaries of the sand and gravel operation. The primary use, extraction of sand and gravel, is believed to be compatible with current use of agricultural lands and very low-density residential development. The ancillary uses of a concrete batch plant, asphalt plant and concrete casting plant are compatible with mining and will be located on one of two plant sites designated in the plan. The closest neighbors to these sites are other extraction facilities. f. The operator believes the reclamation plan of private recreation is competely compatible with the Weld County Comprehensive Plan for continued agriculture. g. In -April 1984 the State Board of Land Commissioners issued a permit to mine state minerals underlying the E/2 SE/4, Section 36 , the surface of which is owned by J-Bar-B, Inc. Current Conditions. Map Exhibit £ shows the outline of the affected land, touching landowners, topography, hydrologic factors and existing facilities. A small part of the property is occupied by a farm-house and outbuildings; the remainder is irrigated land on the south one-third and creek bottom on the northern two-thirds. Various areas in the northern part are cultivated from time to time. Three gas lines, two operated by Colorado Interstate _Gas Company and one operated by Panhandle Eastern Gas Company, cross the property on rights of way as shown on the map e-chi-bit (also see Appendix, "Gas Production Pipelines" ) . 5 Adjoining uses include irrigated lands on part of the -east side as well as the south, west and north sides . Farmhouses and yards are located on the southeast and south side. Two -sand and gravel mining operations adjoin on the east side. Geologic Setting. Mining -will -be from the Piney Creek alluvium on the St. drain Creek drainage. The -eastward dipping beds of Upper Cretac-eous age are overlain at -an angular unconformity by the Piney Creek alluvium. This area is on the west side of the asymetric D-J -Basin. The sand and gravel encountered in the Piney Creek alluvium are a result of -water erosion and redeposi- tion of rock materials from the front range of the Rocky Mountains. The deposition of this alluvium occurred durinxl a time -when the creek was a good deal larger than it is now. But, judging from the scarcity of large rocks found at the location, the velocity of the creek must have slowed sufficiently to have dropped -boulders and most of the lame cobbles -befo-re it reached this point . There does appear to be more than enough medium and small cobble to make this a good aggregate source. Nearby mining operations, both uperee-k and downcreek, indicate the thickness of the -sand and gravel will vary between 15 and 20 feet. Soils and Ov-erburden. There are three toil map units on or adjacent to the mining site (see Map Exhibit I-1/3-1) . Only two of the soil units will be affe-cted by -mining. The area covered by -Aquolls and Aquents, 'gravelly substratum, is in the creek bottoms adjacent -to St. Vrain Creek. This unit covers about 6 three-quarters of the area to be affected. Above the creek -bottom on the south end of the property the Altvan loam covers the alluvium to be extracted. Soils in the creek bottom vary between 0 and 4 feet in thickness. -The Altvan loam on the south terrace varies between 1 and 7 feet in thickness. Of the total 207+/- -acres to be disturbed by mining, approx- imately 133+/- acres will be water (either lake or creek) or road, leaving approximately 74+/- acres to be revegetated. Thus, it is obvious that sufficient quantities of soils are available to reclaim the disturbed lands to their present condition. The soils on the creek bottom alluvium may not be of high quality, but the soils to be salvaged and replaced are representative of what is there now. Mining Plan. Mining will be carried out in three stages so as to minimize surface disturbances on the affected 1-and at any one time. Map Exhibit D-1 delineates the proposed mining stages , the sequence of mining and estimated time duration of each mining stage. The map depicts what the area might be like when mining is about 25% complete in Stage 2 . Operations will commence along the west side of the property north of St . Vrain Cree=k in Stage 1 . Mining will progress to the east. Because of the pipeline 1t0W's, Stage 1 will be mined in three areas that will create three lakes as shown on the rec- lamation map, Exhibit F. When mining is complete north of St. Vrain Creek, operations will move south of the creek into Stage 2 and then progress south and vest into Stage 3 . Stages 2 and 3 will 7 have two areas of excavation that will become lakes. The operator will create two or more areas of shallow water to encourage the invasion of cattails and reeds that might be expected along a normal shoreline (see Revegetation Program in Exhibit E) . As operations start in each area, soils will be removed and stockpiled in setback and right-of-way areas for later use in resoiling and revegetating the slopes and other areas from which soils have been removed. Stripping ahead of the mining operation will be reduced as much as possible so as to minimize visual impact. It is not expected that any significant amount of unuseatle overburden will be encountered. Therefore, there will be no overburden stockpiles. Two methods of mining are under consideration fox this area. Both are standard mining practices used throughout the state. The operator would prefer to dewater and excavate under semi-dry conditions using front—end loaders , bulldozers and scrapers . Dewatering will begin prior to mining and will continue throughout the life of the mine. An NPDES permit will be obtained from the Department of Health. If dewatering proves to be prohibitively expensive , the sand and gravel will be extracted from the lakes using standard dragline procedures. No dewatering will take place. In either case, the extracted materials will be moved from the pit area to the plant site for processing. The processing equipment and necessary specification aggregate stockpiles will be located on part of the site that is designated for plants, 8 an area of approximately 15+/- acres. The plants may be located on two different sites during the life of the mine, one north and one south of the creek. Each site will -be mined out as operations reach the area. Some small areas may not be mined but will be included in the Reclamation _Kan in either case- The plant site will accommodate the processing equipment for the gravel operation and may also serve as a site for ancillary uses, such as a concrete batch plant , an asphalt plant and/or a concrete casting plant. It is intended that this application and the subsequent permit will cover such possible uses. Thus , mining equipment may include but is not limited to front-end loaders, scrapers, a dragline, bulldozers, conveyors, dump trucks and a water truck. As mining progresses from Stages 1 through 3 , the perimeter bank slopes may be constructed in two different ways. If large amounts of waste fines are encountered, some of the slopes may be mined on a 1 :1 slope and back-filled to 3 :1 of less, the final reclamation slope . The alternative is to mine the perimeter slopes to the final grade desired, thereby eliminating the necessity for backfilling. If the first method is used, bank₹filling will follow as closely as possible the mining of the perimeter areas. The -area of the farmhouse and outbuildings is included in the lands to be affected, although the land is not scheduled to be excavated at this time. -The buildings are owned by J-Bar B, Inc . When excavation reaches this area, the owner/operator may 9 decide to remove the buildings and mine the lands. In such event, a technical revision will to submitted. This mining operation will tither be wet or semi-dry. Therefore, the operator expects no unusual problem with fugitive -dust . Water consumption for dust suppression can only be estimated -because variables of operating -days, windy days, rainy or snowy days and the number of affected acres will fluctuate drastically. She operator ' s best estimate of annual water useage for dust suppression is 6 acre feet. Wherever mining is adjacent to St. Vr-ain Creek the excavation line (a line indicating the limits of the excavation) will be set back 100 feet from the existing boundary of the river. This is a safety factor only and should not be construed otherwise. She setback area will be used for stockpiling soil material and for access roads. When mining has progressed so that no further _disturbance of these areas is likely, the land will be reclaimed in the -prescribed manner. The existence of the gas pipelines will cause Stage 1 to be mined in three different excavations. Stage 2 will be mined in two excavations. The operator ' s representative has met on site with representatives fox the pipeline companies. Panhandle Eastern Gas Company ' s line, located along the east boundary of the }property, is a 4-inch line with a right-of-way that extends 50 feet on either side of the center. The Colorado Interstate Gas Company lines are 2-inch lines with rights-of-way that extend 40 feet on either side of the center. One of the 2-inch lines 19 crosses the property on the northern part of the affected land; the other 2-inch line crosses the property in the southern part of the affected land. Mining will be met back 20 feet from the rights-of-way so that excavations will be 60 and '70 feet respectively from the 2- and 4-inch pipelines. The two Colorado Interstate Gas Company lines each serve one gas well . When the gas wells are plugged and abandoned, the pipelines will be removed. If this happens during the life of the mine, the -abandoned RCN' s will be mined under a technical revision . Lidcewise, if the _pipelines are moved or abandoned fox any reason, the operator will file a technical revision to permit mining of the rights-of-way. Mining Timetable. The continuin-g uncertainty of economic conditions in the construction industry precludes an accurate forecast of 'demand during the life of the mine. therefore, the operator has elected to estimate a mining timetable based an an average year and expects a specific year to vary widely from the average. The operator proposes the planned reclaimed future use of the property to be a aeries of private lakes with surrounding green areas. It is possible that limited residential building may occur at a later time on elevations out of the flood plain. The plan is to create a 'quiet haven with facilities for fishing, bird hunting and possibly swimming. For the purpose of this permit, the operator is the owner of the surface and minerals so that the requirement to consult with the owner in regard to future use is inapplicable. In general , the lakes that will result from the excavation work will have irregular shapes ; none of them will be perfect squares , rectangles, triangles or circles. But on those sides that have long, relatively straight sides, during the mining process the operator will create irregularities (as previously defined by the Board) to establish a more pleasing appearance. Setbacks will define the _outside limits of the area to be mined so that any irregularities will be composed of product -material left in -place or waste material backfilled into the excavation. Slopes of at least 3 : 1 will be established from 5 feet above to 10 feet below the water level as part of the Reclamation Plan (also see discussion in Exhibit D, Mining Plan. If the operator decides to create a small area for swimming, slopes of approximately 10 : 1 will be sand covered. 13 Of the 216 . 81 +/- acres of affected land, the seven lakes to be created will cover approximately 126 .74 acres and the creek will include about 10 .33 acres There will be about . 25 acres of permanent road and abort 19 . 21 acres of undisturbed land. The remainder of the affected land, approximately 6_0 .28 acres, will resoiled and revegetated. As outlined in the Mining Plan, the site will be mined i-n three stages. As mining progresses through Each stage, the slopes along the perimeter areas -will be left at or backfilled to 3 :1 or less so that as mining is completed, only minor slope work will be required. This will also insure that if mining ceases at any time before completion, a minimal amount of reclamation will to required. Other procedures in this plan are designed to minimize the effect of midstage stoppage. an Example of such is the stockpiling of soils on the setback areas so that haulage to the area of use will be limited as much as possible to simply re-spreading. Map exhibits are designed to contain complete details and progression of mining stages and reclamation phases. Soils are to be stripped and stockpiled as mining proceeds through each stage. The operator expects to salvage sufficient amounts of soil to permit respreading on all disturbed areas that are to be revegetated with between 10 and 14 inches of soil. Some areas in the creek bottom contain no sail -while other areas contain upwards of four feet. There appears to be more than enough soil to complete the work as planned. Only about a third of the total area -will be revegetated. 14 The operator plans to complete final grading, fertiliziing and seeding within one year of the completion of each mining stage . When possible, planting and fertilizing will occur in each planting year between the middle of March and the first week in April . If spring planting is impossible and fall planting is unavoidable, the operator will plant between mid-September and late October. During the balance of the reclamation phase, reclamation progress will be monitored and remedial work will be performed where necessary. Reclamation Performance Standards. The operator intends to operate the site in compliance with the Reclamation Performance Standards of Rule 6 . Grading will be performed to create a final topography appropriate to the planned future land use. When backfilling is necessary, the operator will place fines and waste rock materials in the mined area and will insure that heavy equipment used for this purpose is compacting the earth sufficiently well to achieve good stability. All grading will be done in a manner to control erosion and to protect areas outside the affected land from slides or other damage. Backfilling and grading will be completed as soon as feasible after the mining process. Refuse will be handled and disposed of in a manner that will control unsightliness and protect the drainage system from pollution. There are no acid-forming or toxic materials involved in this operation. There will be no drill or auger holes left on the land. Maximum slopes will be within the limits set forth 15 in the Rules and Regulations of the Board, and slopes will be capable of being traversed by farm machinery. This will be either a wet or semi-dry operation as outlined in the mining plan. Water quality and quantity is a consideration in this mine . The owner-operator possesses water rights that date back many years. They should be adequate to meet all Colorado requirements so that no other water right is injured. If dewatering is required, an NPDES permit will be obtained from the Colorado Department of Health. This mining operation will comply with all other applicable federal and Colorado water quality laws and regulations. There will be no dredge and fill operations, siltation structures or earth dams. Since the future use of this property is one in which wildlife plays a significant part, the operator has contacted the Division of Wildlife and will continue to work with the Division throughout the life of the mine and thereafter. In removing the soils to reach the mineral deposit , the topsoil will be segregated and stockpiled separately . If the topsoil is not replaced in a backfilled area within a short enough time to avoid deterioration (loss by erosion) , a vegetative cover will be employed to protect the topsoil from wind and weather erosion and keep it free of contaminants so that it is useful for sustaining vegetation when that process begins. Topsoil stockpiles will be maintained to minimize erosion. The stockpiles will be located in areas where disturbances by ongoing mining operations will be at a minimum. The topsoil will be handled 16 as little as possible until it is replaced in disturbed areas. The operator will take measures necessary to insure the stability of the replaced topsoil on graded slopes, spreading it as evenly as possible. Fertilizer and other soil amendments will be used as required in the reclamation plan or as soil tests indicate. Revegetation will be carried out in such a way as to establish a diverse, effective and long-lasting vegetative cover that is capable of self-regeneration without continued dependence on irrigation, soil amendments or fertilizers. The plan is designed to create a vegetative cover that is at least equal in extent to the cover of the natural vegetation of the surrounding area . The use of species native to the area will be included. Since the intended use of the reclaimed land is lake recreation, the land will be restored to slopes commensurate with such use . Seed will be drilled wherever possible. Where drilling is not possible, seed will be broadcast. The revegetation plan provides for the greatest probability of success in plant establishment and vegetative development by considering environmental factors such as seasonal patterns of precipitation, temperature and wind. Other factors such as soil texture, fertility, slope stability and the direction in which slopes face, have been con- sidered. Weed control is considered in the program. Revegetation Program. The topsoiling plan discussed earlier and the revegetation program were devised after careful review of existing soil conditions and present vegetation, both on the site and in the reports prepared by the Soil Conservation 17 Service. The SCS reports are included in Exhibit 1/J. The reveg- ttation program to be implemented by the operator is detailed below. 1 . Fertilizer . Soils will be carefully tested prior to -seeding. Samples will be collected from redeposited topsoil and will be submitted to the soil testing laboratory at Colorado State University. Fertilizers to produce the best growth in the shortest time will be added prior to seeding. 2 . Seedbed Preparation. When the soil has been spread and the fertilizer distributed, the surface where seed is to be drilled will be smoothed of large clods and worked until moderately fine. The surface will be left fairly rough where it is necessary to broadcast the seed. 3 . Seed Mixture. The following mixture will deposit about 80 live seeds per square foot and will be drilled in all areas to be revegetated between mid-Match and the first week in April. The mixture is designed to be drilled at a depth of 1/4 to 3/4 inch; if it is necessary to broadcast the seed, seed rates will be doubled and will be spread on a rough surface and dragged thoroughly after seeding. A mulch of 4000 pounds per acre of straw or other acceptable material will be applied after grass seeding is complete. 5 . Irrigation. No irrigation is planned. The grass mixture is designed to survive and grow under existing natural conditions. 6 . Weed Control. There is no way to know how serious a problem weeds will become , but their growth will be monitored carefully each spring for the first couple of years. Weed control will be initiated if the problem becomes serious; the weeds will be mowed where possible in order to avoid chemical damage to grasses. -7 . Trees and Shrubs . Very few trees now exist on the site. There are a few mature , decayed cottonwoods widely scattered across the bottoms. Most of these trees will be removed during the mining process. In order to facilitate the final land use, the operator will plant approximately 300 bare-root and 200 three- quarter to one-inch diameter Russian Olives along the outside property line. In addition, about 200 bare-root and 100 three-quarter to one-inch diameter cottonless cottonwoods (not Siouxland variety) will be planted along St. Vrain Creek in groups of 3 to 5 . In the open areas between the cottonwoods and along the sides of the pipeline rights-of-way, the operator plans to seed currant, gooseberry and skunkbush. 8 . Invaders. During the mining process, the operator will create two or more areas of shallow water along the shoreline of the lakes so that there will be some larger areas suitable 19 for Cattails and Reeds. It is expected that Cattails and _Reeds will invade shallows as well as water areas immediately offshore, thereby providing excellent wildlife habitat and littoral conditions. S. Grazing. No grazing will be permitted during the first two or three years after revegetation because of the harm that it would do to young plants. Reclamation Timetable. The reclamation phases listed below may be correlated to Map Exhibit F. The phases correspond to the mining stages and are numbered accordingly. Please refer to pocket. 21 EXHIBIT G WATER INFORMATION The Bailey Pit straddles St. Vrain Creek at a point about eight miles east of Longmont, Colorado. There will be no mining in the creek. There are no creeks or St. Vrain tributaries crossing the affected land. There is one irrigation ditch which appears to be a lateral of the Rural Ditch. The ditch runs north along the far west side of the property from the south line a distance of approximately 1550 feet to the north where it emptied into St. Vxain Creek. This lateral will not be affected by the mining operation. Currently, about 30 percent of the land is irrigated from concrete and dirt ditches. It appears that a much larger area was cultivated in the past. The operator plans to dewater the pit during mining by pumping settled water to St. Vrain Creek under an NPDES permit to be obtained from the Colorado Department of Health. There is some possibility that dewatering will not be feasible, in -which case materials will be mined by dragline from a wet pit. There will be some consumption of water for dust suppression on haul roads and on the plant site, even though the mining area is expected to be relatively dust-free even if the pit is dewatered. The operator owns water rights of quite early dates. Even when these water rights are partially converted to industrial use, they will be adequate to meet the consumptive water use of this operation. The operator is aware of at least some of the requirements 22 of the State Engineer and the Division of Water Resources. At such time as the applications for a Weld County Special Use Permit and for a Mined Land Reclamation permit are approved, the added requirements of the State Engineer will be addressed. Current natural drainage is toward the creek. Operations will not disturb this drainage pattern except in the immediate area of each lake, where drainage will be into the lake. There will be no effect on surrounding properties. No water will be used for reclamation. It is not planned to irrigate the revegetated areas . Whenever possible, waste material will be used to backfill and reduce the water area. -The operator ' s intent is to minimize disturbances to the prevailing hydrologic balance of the affected land and of the surrounding area and to the quality and quantity of water in surface and groundwater systems , both during and after mining and during reclamation. The operator believes it will be in compliance with federal and state laws and regulations governing water and water rights. There is no application of the river dredge law or siltation structure removal requitement. 23 EXHIBIT H WILDLIFE A request for an evalution of this site was forwarded to the Division of Wildlife on April 16 , 1984 . The Division's response, slated May 14 , 1984 , appears on the following page. The ;wetlands Mr. -Bogart refers to in his letter are outside the area to be mined. The operator does not plan to place fill on any location on the affected lands. Nevertheless, the Corps of Engineers was contacted on May 29, 1984 , for an opinion concerning the wetlands. Their response is expected in the near future. The fourth paragraph of Mr . Bogart ' s letter discusses the dewatering process . iiis concerns will be addressed in the application to the Department of Health for an NPDES permit. The operator appreciates the Division' s offer of assistance in wildlife concerns. As mining activity proceeds, the operator intends to remain in contact with the Division of Wildlife, and in particular with Mr. Bogart. Finally, the operator agrees with Mr. Bogart that irregular shorelines will enhance the appearance of the site. The riparian area along what appears to be the -historic floodplain is somewhat more productive of the wildlife resource. However, _due to the heavy use by domestic livestock this resource is rather limited. There also -seems to be very little re- production of cottonwood and the ones that are there are scattered and for the most part mature and many are decadent. at is recommended that the pumping to dewater the pits, first be settled before returning it to the St. Vrain. If recommendations are needed for the reclamation to a private recreation and wild- life area, sae will be happy to assist. It is assumed that these plans are probably formulated tut were not included in our packet. If as is indicated this is to be developed as a private. _club, rather than the straight line type of shoreline, the area would be greatly enhanced by the creation of an irregular shoreline.
