Division review indicates the Letter of Intent for the Use and Distribution of Biosolids is incomplete. The following items have not been provided pursuant to the Biosolids Regulation 64 (5 CCR 1002-64): 64.10.A(3)(p) Other information deemed by the Division as appropriate to evaluate potential human health and water quality impact of the proposed use. Provide an aerial map of the site with site "fields" identified. Also include a list of field ID's and acres per each field. Also, the biosolids application rate worksheet appears to be utilizing a 1 foot soil sample for the determination of the nitrogen fertilizer recommendation. Further consideration as to the issuance of a Notice of Authorization for the Use and Distribution of Biosolids at the above referenced site will not be given until the Division has received the above referenced items. Division review indicates the Letter of Intent for the Use and Distribution of Biosolids is incomplete. The following items have not been provided pursuant to the Biosolids Regulation 64 (5 CCR 1002-64): 64.10.A(3)(b) Site owner and operator information including the name, address, legal contact,proof of ownership, and the phone number of the site owner or the owner's legal representative. Legal description on the Landowner certification form does not match the legal description on the LOI. 64.10.A(3)(m) The results of groundwater depth evaluations demonstrating compliance with groundwater depth criteria as described in section 64.15(D) of these regulations. The information supplied in the LOI indicates that "depth to groundwater" is a potential concern for this site, especially in the northwest area of the site. 64.10.A(3)(n) A Biosolids Management Plan describing the application of biosolids to the site, the crop(s) cultivated, applicable site access restrictions and, if onsite storage of biosolids is anticipated, facts demonstrating compliance with the requirements of section 64.13 of these regulations. The Biosolids Management Plan and page 2 of the LOI state that all 137 acres are irrigated. The Division has reviewed the Letter of Intent(LOI) for the above-referenced site and has determined that the LOI has failed to demonstrate compliance with: - site property ownership limitations. The LOI application site includes more than one property and there are two different owners for the properties. See 64.10.A(3) of the Biosolids Regulation 64 (5 CCR 1002- 64)and definition 64.9.H.
