RE : APPROVAL OF RECORDED EXEMPTION NO. 518 - ROGER L. AND
DIANA M. MACE
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting held
on the 23rd day of September, 1981 in the Chambers of the
Board that the division into two parcels of land, as shown
on the plat known as Recorded Exemption No. 518 , being the
property of Roger L. and Diana M. Mace, described as part
of Section 8, Township 1 North, Range 66 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as
follows :

the Southeast quarter of the Southeast quarter
and the South one rod (16 . 50 feet) of the North-

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners finds that this
particular division of land is not within the purposes of the Weld
County Subdivision Regulations and the Board desires to exempt
this particular division of land from the definitions of
"subdivision" and "subdivided land" pursuant to its authority
under Colorado statutes and Section 2-1A (3) of the Weld
County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners that the hereinabove described parcel of land
owned by Roger L. and Diana M. Mace be, and hereby is ,
exempt from the definition of the terms "subdivision"
and "subdivided land" .
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 23rd
day of September, A.D. , 1981.

Re: Recorded Exemption #518
Dear Commissioners:
The attached application, plat and related items are in reference to a
request from Roger Mace for a recroded exemption. The parcel of land
on which this request has been made is described as part of the SEI,
Section 8, T1N, R66W of the 6th P.M. , Weld County, Colorado. This
property is located one mile south of Fort Lupton. The property contains
approximately 37 acres of Class II and IV irrigated soils. The request
is to split the property into parcels of 11 acres and 25 acres.
A nearby landowner wishes to purchase the 25 acres of hay ground. The
present owner wishes to keep his residence and pasture (approximatley
11 acres) .
Based on the information submitted and Weld County regulations the staff
recommends approval for the following reasons:
1. In the opinion of the Department of Planning Service's staff
the request complies with the County's Comprehensive plan,
the intent of the exemption procedure and the intent of the
Agricultural District. The property is located near the town
of Fort Lupton in an area proposed for low density residential.
Also, because the intended purchaser has a present home on
adjacent property, no new residence is contemplated for the
near future. The division promotes the prime agricultural
land to remain productive while allowing the property to be
developed in the future in an orderly manner consistent with
City and County policies.
2. Section 9-4 A. of the Subdivision Regulations have been met.
