RE: APPROVAL OF RECORDED EXEMPTION NO. 438 - HENRY AND ERNA
KOHLHOFF
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 16th day of January, 1980 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels, as shown on the plat known as Recorded Exemption
No. 438, being the property of Henry and Erna Kohlhoff, described
as the Southwest Quarter of Section 22 , Township 7 North, Range
64 West of the 6th P.M. , Weld County, Colorado, being more parti-
cularly described as follows:
All of the Southwest Quarter of Section 22,
Township 7 North, Range 64 West of the 6th
P.M. , County of Weld, State of Colorado,
more particularly described as follows :
Beginning at the Southwest corner of said
Section; thence along the West line of
said Southwest Quarter North 00°39 '49"
East 2635. 10 feet to the West Quarter
corner of said Section; thence along the
East-West centerline of said Section South
89°59 ' 03"East 2607. 19 feet to the center
of said Section; thence along the North-
South centerline of said Section South
00°31 ' 57" West 2634 . 28 feet to the South
Quarter corner of said Section; thence
along the South line of said Southwest
Quarter West 2613 . 22 feet more or less to
the point of beginning.
The abovedescribed parcel contains a gross
acreage of 157 . 87 acres more or less.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the

Board desires to exempt this particular division of land from
the definitions of "subdivision" and "subdivided land" pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as
amended, and Section 2-lA(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Henry and Erna Kohlhoff be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
January, A.D. , 1980.

RE: Recorded Exemption #438
Dear Commissioners :
The attached application, plat , and related items are in reference
to a request from Henry and Erna Kohlhoff for a recorded exemption.
The parcel of land on which this request has been made is described
as the SW4 Section 22, T7N, R64W of the 6th P.M. , Weld County,
Colorado . This property is located 2 miles east and 2 miles north
of Galeton. The property contains approximately 160 acres of non-
irrigated soils. No soil classification information is available.
The request is to split the property into parcels of 20 acres and
137. 87 acres.
Mr. and Mrs. Henry Kohlhoff wish to convey the 20 acre parcel to
their son. As explained in the applicant 's letter, this is a family
farming operation and their son wishes to reside on the property.
The 137. 87 acre parcel has existing improvements located on it .
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The request conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone District
(Section 3. 3. A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that the uses will be compati-
ble with surrounding agricultural uses. The request will allow

agricultural and related uses to be the predominant land uses.
There will be no reduction in the amount of land currently being
used for agricultural production at the present time.
2. This request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.

Lot A, the smaller parcel , does not appear to have any improvements.
The parcel appears to be dryland agriculture (wheat) and pasture. The
larger parcel, Lot B, contains two residences, several barns and
machine sheds and a feedlot operation. Access from Lot B is to County
Roads 78 and 55 (unimproved) .
Topography is fairly level throughout the entire parcel. Surrounding
property is agricultural.
